SPECIAL STUDIES COMMITTEE
TUESDAY, AUGUST 6, 2002
MINUTES
The regularly scheduled meeting of the Special Study Committee met on August 6, 2002 at 7:00 PM in
the Caucus Rooms of City Hall.
Committee members in attendance: Leo Dierckman, Chairperson; Pat Rice; Paul Spranger; and Wayne
Wilson. Marilyn Anderson was also in attendance as an ex- officio member.
Department of Community Services Staff in attendance: Laurene Lillig; Adrienne Keeling; and Jeff
Kendall.
1. Docket No. 45 -02 DP Amend, ADLS Amend;
103rd Street Medical Building Expansion
The applicant seeks Development Plan and ADLS amendment approval to construct a
building addition and site improvements. The site is located at 200 West 103 Street.
The site is zoned B -3 /Business.

Paul Reis, Drewry, Simmons, Pitts Vornehm, 8888 Keystone Crossing, Suite 1200,
Indianapolis 46240 appeared before the Committee representing the applicant. Also in attendance
were Les Olds of CSO Architects and Mark Monroe.
The building was originally approved as a single user, corporate headquarters. The proposed
expansion will complement the current renovation of the building and will provide medical office
space. The IU School of Medicine Physicians will be occupying the building in the fall. The plans
to expand the building are consistent with the plans initially filed that provided for future
expansion. The proposed expansion will mirror what is already in place on the north side of the
building.
A variance was obtained from the Board of Zoning Appeals for additional height to allow for the
rooftop, air handling units. The anticipated tenants for this space are also for medical use,
providing out patient, special care medical services, between the hours of 6:00 AM and 6:00 PM.
At the time of the public hearing, there were two issues raised by the Homeowners Associations
of Reserve I and Reserve IL Those issues dealt with perimeter landscaping and sound /noise

emitted from the existing HVAC equipment on the west side of the building. The applicant has
met several times with the homeowners in Reserve I and II, specifically the officers of the HOA
and some of the affected neighbors, to review the landscaping and the sound. The landscape plan
has been revised based upon discussions and site visits with the neighbors and the Urban Forester
of the Department of Community Services.
The Kite Companies engaged Roger Knoppe, a Sound Engineer from California to study the
sound issue. Mr. Knoppe studied the unit, met with the neighbors, and then went out into the
neighborhood to take sound readings to determine the effect of the chiller in the neighborhood.
Mr. Knoppe's proposal involves certain improvements to the building and the enclosure that
should reduce the noise from 30 to 40 The improvements are similar to those made at the
Carmel Public Library. Notably, sound absorbing materials will be installed on the west side of
the building —part of the noise is coming from the unit and deflecting off the building into the
neighborhood. Sound absorbing materials will be put inside the enclosure wall. The installation of
the sound absorbing material may affect the mechanical performance of the unit. At the
beginning of phase II construction, a reading will be taken on the mechanical performance and run
it through the manufacturer to make sure it will properly perform. In other words, there must be
adequate air -flow for the unit to function; if not, certain modifications will have to be made.
Department Report, Laurence Lillig confirmed that Scott Brewer approved the revision to the
landscape plan. The noise control information was just presented this evening, but it sounds like a
viable solution. The lighting plan has also been revised. The Department is recommending this
item be returned to the full Commission with a favorable recommendation, conditioned upon
dedication of additional right -of -way prior to the issuance of the I.O.P.
Jean Fronek, Reserve II, 373 Millridge Drive, Indianapolis, spoke in agreement with the
applicant's approach on the sound issue. The HOA Board is also in agreement with the landscape
plan.
Comments were submitted from committee member Jerry Chomanczuk regarding the aesthetics of
a metal screen panel for the air cooling unit.
Les Olds stated there is a masonry wall surrounding the unit —the work will go on inside the
masonry wall, below the edge, and the metal panel will not be visible.
Paul Spranger moved to recommend approval of Docket No. 45 -02 DP /Amend, ADLS Amend,
103' Street Medical Building Expansion, to the full Commission, subject to the right -of -way
dedication. The motion was seconded by Pat Rice and Approved 4 -0.
Note: Items 2 and 3 were heard together.
2. Docket No. 46 -02 DP /ADLS; Carmax Auto Superstore
The applicant seeks Development Plan and ADLS approval to construct an auto
superstore. The site is located at the northwest corner of Gray Road and 96th Street. The
site is zoned B -3 /Business.

3. Docket No. 47 -02 PP, Carmax Auto Superstore, Primary Plat
The applicant seeks approval to plat a 2 -lot subdivision. The site is located at the
northwest corner of East 96 Street and Gray Road. The site is zoned B -3 /Business.

Dave Coots, Coots Henke Wheeler, 255 East Carmel Drive, Carmel, appeared before the
Committee representing the applicant. Also in attendance were: Tony Kirp of Carmax; Ned
Sparkman, IDI Construction Management; Bill Peale; and Earl Smith, Piper O'Brien, architects;
and Doug Corey, Mid States Engineering.
At the July committee meeting, the applicant agreed to review the materials, both color and type,
and return to the August committee. The drawings have been revised and materials changed in
order to comply with the Committee's request.
Tony Kirp went over some changes in elevation. The open truss has now been closed off. A blue
canopy has been added over the secondary entrance. The applicant is now proposing to use
Quick Brick and color samples were provided. The south and east elevations off Gray Road were
shown as quick brick; the north and west elevations are split -face masonry, painted to match the
color of quick brick. The EFIS design across the south elevation (a portion of the service
building) is 300 yards back from the south elevation and will be painted to match the block —with
the distance factor, it will not be a visible difference.
The entry doors and vestibules protrude and they are a function of the floor plan. The layout of
the sales room provides for the "air lock" and transitions the air from the outside to the inside.
The whipwall and dumpster enclosure are made of split -face block material; the dumpster is
within and a part of the wall. The "whip- wall" is surrounded by landscaping and virtually totally
obscured. The split -face block will be painted the same color as the Quick Brick. The steel
guardrail along 96 Street will be painted black and the two or three season landscape growth will
thoroughly screen the guardrail.
The signs on the south wall and east walls are sized according to the Ordinance and located
beneath the triangular archway. The sign variance being sought from the Board of Zoning
Appeals is for the second sign on the east wall containing the "service" depiction. The two
ground signs are landscaped; coloring at the base of the signs will match the building, i.e. the dark
brown, with the EFIS background material being the same as is on the building, and the Carmax
Blue" on the signs. Color samples were displayed. The sign material is the same as the roof
material in terms of its color.
The lighting meets the requirements of less than three- tenths foot candle at the perimeter on 96
Street and this issue has been resolved. The number of poles has been reduced, and the height has
been reduced to 20 feet in the front area and poles have been removed from the west boundary in
order to reduce the lighting on the western perimeter. There are still some numbers that exceed
"point three" at the western boundary adjacent to O'Brien, but at the roadways, the point candle
is met.

Department Report, Laurence Lillig referred to item D on the Department Report under
aarchitecture -the entry doors need to be looked at —the applicant did not have a copy of the
floor plan available. Also, Jon Dobosiewicz had understood the wall was to be quick brick and
EFIS; this is apparently not now the case. The guardrail will be painted black. The signage has
changed slightly —there is no yellow to be incorporated into the signs; the petitioner confirmed
that the signs will be all blue. The sign elevation for the monument sign is a masonry monument.
The petitioner said the base is quick brick with the EFIS background, and a white EFIS cap. The
Department requested the street address be mounted on the ground sign, perhaps on the brick.
There is a minim size requirement for addresses —six inches in height for a sign this close to
the right -of -way.
In regard to the lighting, Laurence thought the plan was still a little too intense on the south line.
The range is still zero point five to zero point eight at the lot line. If acceptable to the Committee,
this would probably serve for 96 Street. Technically, the lot line should meet the standard, but
since it is internal to the project, it is not that great in importance. The Dept. is recommending
this item be returned to the full Commission with a favorable recommendation once all concerns
have been addressed.
Regarding the Primary Plat, the City Engineer and the Petitioner are to come to some sort of final
determination on roadway improvements. The Department is recommending that the Primary Plat
be given a favorable recommendation with the condition that roadway improvements dictated by
the City Engineer are accomplished.
Dave Coots said he had talked with Dick Hill Monday and the City Engineer has the proposal
from Mid States Engineering. It is high in priority on the Engineer's list, and this will be
addressed. The plans include a turn lane in/out off Gray Road, and a passing blister on the east
side of Gray Road. The intersection of 96 and Gray Road was improved with the widening of
96 Street; the entrance /exit to Carmax off 96 Street is right in/right out. The median is
extended from the intersection of Gray Road past Grant Road to the west.
It was the consensus of the Committee that the vestibule "air locks should be taken interior to
the building or install glass above it to the ceiling; it looks like an after thought and out of place.
Tony Kirp of Carmax responded the problem with bringing it inside is that it changes the entire
layout of the sales area and the building would need to be enlarged to compensate. Also, the
yellow band across the entire elevation is 8 inches wide. Pat Rice saw no reason to keep the
yellow band.
After further discussion, the petitioner agreed to remove both air locks and take them internal to
the site. This could be accomplished by moving the south wall out no more than ten feet, and the
96 Street air lock (east air -lock) would probably not be affected by moving the east wall to
create the air lock.
Paul Spranger moved to recommend approval of Docket No. 46 -02 DP /ADLS, Carmax Auto
Superstore, conditioned upon petitioner making changes to the airlocks by either taking both of
them internal to the building, or extend the south wall a distance up to ten feet to accommodate

the air locks. Both air locks will be removed from the exterior (east and south) and year `round
evergreen landscaping will be provided on the whip -wall without substitution, as committed by
petitioner. Following a second by Pat Rice, the motion was APPROVED 4 -0.
Note: The petitioner will provide revised elevations for the Plan Commission to review.
Paul Spranger moved to recommend approval to the full Commission of Docket No. 47 -02 PP,
Carmax Auto Superstore, Primary Plat, conditioned upon the City Engineer's office approving
site improvements and roadway design, and drainage requirements per the Department Report.
Following a second by Pat Rice, the motion was APPROVED 4 -0.
4. Docket No. 66 -02 DP Amend /ADLS; Hamilton Crossing Building #5 (Revised)
The applicant seeks amended development plan and ADLS approval to construct an office
building. The site is generally located at the southwest corner of 131S Street and U.S.
Highway 31.

Blair Carmosino of Duke Realty, 600 East 96 Street, appeared before the Committee
representing the applicant. Allen Tucker, architect, and Steve Granner, Bose McKinney Evans,
were also in attendance.
There were two issues to be addressed on this project. One is the sight line from the intersection
of 131 st Street and US 31, inducing an increased elevation in anticipation of a 131 st Street over
ramp for US 31. The second issue was trying to create more mass to the building by raising the
parapet wall about two feet.
Allen Tucker, architect, displayed the rendering presented at the last Committee meeting. A new
rendering was shown that adds eight (8) inches between the first and second floor, eight inches
(8) between the roof structure and eight (8) inches on the parapet —this adds two feet and the
building is not "top heavy," there is a two foot parapet so it is not necessary to increase for any
snow loads. The other issue was to look at the building from the overpass —there was concern
about the screen wall. The elevation is approximately eye level in a car on a proposed over pass
on 131 st Street. It is about 19 feet up in the building, and no units will be visible. The screen wall
will be light to match the light accents on the building.
Department Report, Laurence Lillig said the Department is recommending final action on the
ADLS portion of this petition. The Development Plan portion will need to return to full
Commission. As outlined in the Department Report, there are certain Thoroughfare Plan
considerations regarding reservations for US 31 improvements. The Development Plan is being
recommended for return to the Commission with a favorable recommendation.
No signage is proposed at this time, and the petitioner will return to the full Commission.
Paul Spranger moved for approval of Docket No. 66 -02 ADLS portion for Hamilton Crossing
Building #5 (Revised), with the understanding that the landscaping on potential right -of -way of
US 31 is deferred until roadway improvements are completed. Also, the Development Plan

must return to the full Plan Commission for approval. The motion was seconded by Pat Rice
and APPROVED 4 -0.
5. Docket No. 67 -02 DP Amend /ADLS; West Carmel Center, Block D, Lot 2-
Fifth Third Bank
The applicant seeks amended development plan and ADLS approval to construct a
financial institution. The site is located at the northeast corner of US 421 and Retail
Parkway. The site is zoned B -3 /Business and is subject to the requirements of the US
421/Michigan Road Overlay Zone.

Tom Engle of Barnes Thornburg, 36 South Meridian Street, Indianapolis, appeared before the
Committee representing the petitioner. Also in attendance were: Jerry Hittle, Schneider
Engineering, Jeff Klump of Klump Associates, Architects; and Jeff Hartley.
The scale of the canopy element at the drive through has been reduced as requested by the
Committee. The ATM machine has been revised to show brick on all four sides. The sign is 3
square feet and is in compliance with the Sign Ordinance; the letters project out 3 /4 of an inch. As
to the landscaping, the landscape plan has been revised and all shrub heights are now 24 inches.
The connection to the outlot on the northwest corner now shows on the plans as future
construction.
Regarding the signage on the building, the lighting on the red stripe is backlit, and will be white.
The sign will appear red during the day, white at night, and will have a flat lens.
Department Report, Laurence Lillig referred to the architectural design and asked if the brick on
the ATM would match the brick on the building —the petitioner responded in the affirmative. The
base course is not the same as the building. Scott Brewer has not yet had an opportunity to
review the revised landscape plan. The signage will be reverse channel, not internally illuminated
channel. The red band will remain red—opaque. The connection to the outlet does not show on
the plans.
Signage: The only outstanding item has to do with the Target signs that will be located on the
property. Allen Tucker reported there is an existing Target sign on the site. Laurence Lillig
commented the off premise sign is in violation. As yet, there has been no final answer from the
developer for a unified sign. Laurence Lillig stated that as long as the sign violation occurs on the
property, no sign permit can be issued.
Pat Rice commented there are too many lanes at the drive through. The drive through facility has
4 lanes plus the ATM lane. Jeff Klump explained there are 5 cars per lane, two lanes serviced by
one individual. The issue is with stacking otherwise there would be a traffic back -up into the
entrance drive area.
The lower canopy on the drive through is fine, however, from an architectural standpoint, the
petitioner agreed to add EFIS and create a gable. The lower canopy creates a classic architecture

look and sight line. The facing of the ATM machine should carry the classic design with brick or
preferably real limestone that would tie in with the keys and archways.
Marilyn Anderson noted there are 142 yews on the landscape plan. Marilyn encouraged the
petitioner to use more variety and work with Scott Brewer for suggestions.
Laurence Lillig questioned the materials on the door of the ATM—it is brick. The base course on
the ATM will be limestone.
Paul Spranger moved to recommend approval of Docket No. 67 -02 DP Amend /ADLS, West
Carmel Center, Block D, Lot 2 -Fifth Third Bank, with the following conditions. The roof line
is to be amended per Committee discussion and commitment by petitioner; the material on the
ATM machine will be brick and will incorporate lower band of coloration to include limestone for
consistency; the number of yews will be reduced in order to add variety— subject to final approval
by Scott Brewer, Urban Forester. Following a second by Pat Rice, the motion was APPROVED
4 -0.
6. Docket No. 89 -02 ADLS Amend- Merchants' Pointe, Lot #6
Petitioner seeks an amendment of the Architectural Design, Lighting, Landscaping
Signage approval granted under Docket No. 200 -00 ADLS. The site is located at 2325
Pointe Parkway. The site is zoned B -8 /Business.

Jim Nelson, 12481 Medalist Parkway, attorney with Nelson and Frankenberger, appeared before
the Committee representing the applicant. Buddey Hennessee of The Linder Company, and
Barbara Eden, Carson Design Associates.
The Linder Company is requesting an Amendment to a previously approved ADLS plan for a
two -story office building in Merchants' Pointe. Merchants' Pointe is rapidly nearing completion.
The office building on lot 6 will be 30,000 square feet and designated as the flagship building for
Merchants' Pointe.
At this time, the suburban office market is very soft and efforts to obtain pre leasing for the two
story office building have not been productive. However, there has been great interest in the
lower level of the building for retail use. An amendment is being requested to the ADLS approval
that would permit retail use on the first floor —high quality retail use—up to a maximum of three
retail tenants, and the second floor being used for offices. In fact, the second floor would become
the corporate offices for The Linder Company.
The changes in the building provide for three, separate retail entrances on the ground floor level,
and the entrance to the second story office would be on the west end of the building. The overall
building height has been increased by one foot, thereby providing for 11 feet high ceilings.
Sidewalks and planter box approaches to the retail space have been provided at the front. The
blue canopies on both the west and north elevation will match the existing.
As a point of information, the tenant signs will require a variance from the Board of Zoning

Appeals. Under the Sign Ordinance, this building is designated as a multi- tenant, multi -level
building and as such, individual tenants are not permitted individual signage on the facia of the
building.
Commitments made at initial Development Plan approval need to be modified and a petition to
that effect will be heard at the August 20 Plan Commission meeting. Initially, the petitioner
committed to a minimum of 30,000 square feet of office; the request is to change this to 15,000
square feet minimum of office space. A commitment was made to a maximum of two retail
tenants per building; current provision is for 3 retail tenants and this would need to be amended.
Department Report, Laurence Lillig said Jon Dobosiewicz had requested additional information
regarding the signs. The application does not specify the type of signage. Jim Nelson said this
has now been provided —the sign is self illuminated, white face, dark bronze with black returns.
The size would be as permitted under the Ordinance. Wall mounted lights--detail on second
level? Barbara Eden of Carson states the lights are exactly the same but may look different due to
shading. Laurence Lillig said the Department is recommending favorable consideration by the
Special Study Committee conditioned upon approval of the commitment amendment. The
petitioner understands he must appear before the Board of Zoning Appeals regarding the tenant
signage.
Paul Spranger asked for clarification of the signs. Jim Nelson stated the signs are white face,
black/bronze returns, individually mounted, internally illuminated. Paul Spranger added a caveat
that the sign package should be reduced in size 20% from the existing sign ordinance. The Sign
Ordinance does not exactly cover this type of situation. The petitioner has committed to
landscape lighting on the trees on Merchants' Pointe Boulevard to give the entire project an
upscale look, and this should be accomplished within 60 days.
Pat Rice was concerned about the type of tenant in the retail space and the signage that they
would require.
Paul Spranger asked that the signage be consistent in regard to font and letter style so that it
matches the balance of the center and incorporates the blue fabric awnings.
Paul Spranger moved for approval of Docket No. 89 -02 ADLS Amend, Merchants' Pointe,
Lot #6, conditioned upon signage being reduced by 20 the font and letter style of the signs are
white to match the balance of the center; and blue fabric awnings are to match the existing
throughout.
The motion was seconded by Pat Rice and APPROVED 4 -0.
7. Docket No. 95 -02 ADLS Amend; Community Health Pavilion Signage
Petitioner seeks approval to amend their Architectural Design, Lighting, Landscaping
Signage for a ground sign and two wall signs. The site is located at 11911 North Meridian
Street. The site is zoned B -6 (Business) and is within the US Highway 31 Corridor
Overlay Zone.

Steve McVicker of Sign Craft, and Brandon Rogers, Community Health Network, appeared
before the committee representing the applicant. The petitioner is seeking an amendment to the
existing ADLS approval. The original commitments were site specific for the occupants of the
building.
The building signs are base white with channel letters, white acrylic construction, dark bronze
returns. The color of the Community Health Network logo is gold. The monument sign is
constructed of aluminum and the only thing illuminating on the monument sign is the copy and the
logo. The logo background is gray, (G -29 color swatch).
Laurence Lillig reported the Department is recommending favorable consideration of this petition
and that it only requires Committee approval.
Paul Spranger commented the ground sign should have a brick base commensurate with the brick
of the building; each end should also be bricked. The petitioner is agreeable. Paul Spranger said
the sign should be back illuminated, reverse channel. The petitioner was willing to accommodate
the back illuminated sign providing the Committee would not require the brick base on the ground
monument sign. Regarding landscaping, Scott Brewer is to approve the landscape plan.
Paul Spranger moved for approval of Docket No. 95 -02 ADLS Amend, Community Health
Pavilion Signage, conditioned upon the sign on the building facing US 31 being back -lit, with
individual letters, gold logo with gray background. Further, the plantings around the base of the
monument sign are to be approved by Scott Brewer. Following a second by Pat Rice, the motion
was APPROVED 4 -0.
8. Docket No. 100 -02 ADLS Amend- Carmel Walk Shopping Center
Petitioner seeks an amendment of the Architectural Design, Lighting, Landscaping
Signage approval granted for a retail shopping center. The site is located at 1305 South
Range Line Road. The site is zoned B -8 /Business.

Jim Burris of Lamson Condon Architects, Indianapolis appeared before the Committee
representing the applicant, Fineberg Assoc. The applicant is seeking to give the existing strip
center a "face lift" and a fresh look. Photographs were shown of the existing center.
Photographs of the existing center were shown. The sign canopy was an addition to the building
in the late 1970's. The owner would like to face with EFIS and accent and re- install existing
tenant signage onto the building. The existing brick under the sign band is not structural and is
falling apart. The current proposal is to remove the existing brick under the sign band and re -do
with EFIS.
At present, there is a stand -alone bank building to the immediate north of the main shopping
center connected by a canopy. The applicant would like to modify the canopy so that it extends
only over the drive through portion of the bank building. Columns or spheres and accent lighting
would be added. The sign band would be a light EFIS color; the accent area around the sign band
would be a darker EFIS. The rear of the building is masonry and would be painted to match the

EFIS.
The existing road sign will be freshened with paint —not changed or replaced. There is no
detached ATM machine in the center. The lighting is a flat lens design, and no problem. The
rear wall packs incorporate a down lighting.
Department Report, Laurence Lillig stated the existing pole sign is a non conforming sign, and
any changes or replacement (other than ordinary maintenance) would mean removal and
replacement with a conforming sign. Assuming the petitioner addresses the Committee's
concerns, the item is recommended for approval.
Pat Rice commented the center certainly needs renovation, but the proposal is a step backward.
Paul Spranger noted there is not one element of the plan that begins to be satisfactory for Carmel,
and he recommended the petitioner go back to the drawing board.
Paul Spranger suggested cornices, blue awnings such as those seen in Merchants' Square and
Merchants' Pointe, and eliminating the pole sign and replacing with a ground sign.
The Petitioner will return to Special Study Committee September 3 rd at 7:00 PM in the Caucus
Rooms of City Hall.
9. Docket No. 102 -02 ADLS Amend Allstate
Petitioner seeks an amendment of the Architectural Design, Lighting, Landscaping
Signage approval for a ground sign. The site is located at 531 North Range Line Road.
The site is zoned B -5 /Business within the Old Town Overlay Zone.

Teresa Bartlett of Express Graphics appeared before the Committee on behalf of the applicant.
The site at 531 North Range Line Road was formerly occupied by Carmel Portrait Studio. The
sign for this location is constructed of redwood—no lighting. A landscape plan will be presented
with the sign permit.
The sign for Allstate is 52X40 inches; the Gift Boutique is 26X8 inches.
Department Report, Laurence Lillig requested the dimensions of the sign. Clarification: the
building is two levels; there are two tenants, Allstate and Rosabella's Gift Boutique. Upon quick
review, it looks as if it meets the minim standards of the Old Towne District. For a multi
tenant building, tenants are required to share equally in sign area. Even though the proposed
signs are different dimensions, they are equal in area. The aesthetics of the sign is up to the
Committee.
Pat Rice commented it looks as if the Allstate sign is merely an elevated real estate sign—nothing
attractive. Rosabella's Gift Boutique sign does not blend with the other sign —they are different
fonts and colors —the Allstate sign looks out of place and appears to be heavy—it should be

beneath the other sign.
Paul Spranger commented the signs are totally dissimilar, even though there is some ironwork to
create an effect, it just doesn't work.
Ms. Bartlett said the Allstate sign has already been constructed and the applicant is doing his
absolute best to make it fit the environment.
The petitioner will redesign the sign and return to the September Committee meeting. It is
possible that a Variance made be needed through the Board of Zoning Appeals.
10. Docket No. 101 -02 ADLS Amend- Tharp Convenience Center
Petitioner seeks an amendment of the Architectural Design, Lighting, Landscaping
Signage approval to modify the signage for a retail shopping center. The site is located at
808 West Main. The site is zoned OM -SF Old Meridian Single Family.
Filed by Mark Keen of Sign Fab for Don Tharp.
Mark Keen of Sign Fab appeared before the Committee on behalf of the applicant. The name of
the center is "Silver Express," owned by Don Tharp of Tharp Investments.
The proposed signage is copper color, with white graphics, individual letters, internally
illuminated. The applicant would like to go with a red logo. Currently there are two signs
displayed at this center.
Department Report, Laurence Lillig referred to Jon Dobosiewicz's report that noted signs were
installed without permits. Mr. Tharp was aware that approval of the sign was required prior to
any signs being mounted, per Dawn Pattyn of the DOGS. There are also signs on the Marathon
canopy, and approval was not received for any of the signs.
Leo Dierckman commented there are numerous sign violations on the property, and the parties in
ownership should be present so there is no misunderstanding as to what needs to be done before
there is any dialogue regarding granting sign approvals.
Paul Spranger said the lighting also needs to be looked at as part of the ADLS review. The
previous fixtures under the canopy were flush lighting; those fixtures were replaced by drop
fixtures with high glare illumination. This center has gone from a somewhat well designed center
to a hodge -podge of egregious lighting as well as the signage.
The petitioner agreed to return to the Committee September 3r with a re- design of the signage.
11. Docket No. 103 -02 ADLS Amend- Lot 7, Merchant's Pointe McAlister's Deli
Petitioner seeks an amendment of the Architectural Design, Lighting, Landscaping
Signage approval to add an awning to the west elevation of a building. The site is located
at 2271 Pointe parkway. The site is zoned B -8 /Business.

Chris Pierce of Design Team Sign Company, Atlanta, Georgia, appeared before the Committee
representing the applicant. Mr. Pierce was complimentary of the Carmel area, his first trip.
Mr. Pierce displayed conceptual drawings. The patio awning is a part of one of the schemes
McAlister's uses within their set -up and is one of the attributes of their success.
There were comments from the Committee. The green stripe will not exist on the awnings on the
west side of the building.
The Department had several questions regarding the awning—is it in place all year `round? (yes)
Will it withstand snow loads (yes-35 pounds per square foot,) and what are the poles supporting
the awning?
Mr. Pierce said the awning will be in place all year `round and will withstand snow loads of up to
35 pounds per square foot. The support poles for the awnings are 3 inch square steel and will be
painted "Merchants Square Blue" to match the awnings.
Pat Rice moved for approval of Docket No. 103 -02 ADLS, Lot 7, Merchants' Pointe,
McAlister's Deli. The motion was duly seconded by Wayne Wilson and APPROVED 4 -0.
