Carmel /Clay Advisory Board of Zoning Appeals
Monday, October 28, 2002
The regularly scheduled meeting was held at 7:00 PM in the Council Chambers of Carmel City Hall
on October 28, 2002. Those members in attendance: Leo Dierckman, Michael Mohr, Earlene
Plavchak, Pat Rice, and Charles Weinkauf, thereby establishing a quorum.
Department of Community Services Staff in attendance: Planning Administrators Laurence Lillig
and Jon Dobosiewicz, and Intern Brian Hanson. John Molitor, Legal Counsel was also present.
Den 13 Pack 124 Cub Scouts from Orchard Park Presbyterian Church led the Pledge of Allegiance,
followed by their Roll Call.
The minutes of the September 23, 2002 meeting were approved as submitted.
John Molitor reported the Executive Session discussion preceding this meeting was limited to the
discussion of pending litigations. Another Executive Session, coordinated by the Department of
Community Services, may need to be scheduled in the next two weeks.
Laurence Lillig noted Items 10 -12j, Carmel Clay Historical Society, UV- 178 -02; V- 179 -02, V -180-
02, and Items 1 -2k, Clay Junior High School, SUA- 160 -02, V- 166 -02, are tabled per the petitioners'
requests. The Department recommended Item 1 j, Burton Accessory Building, V- 92 -02, be
dismissed per the petitioner's verbal request to withdraw the petition. The Department also
recommended canceling the December 23, 2002 meeting. By the November 25, 2002 meeting the
Department will know if a meeting needs to be scheduled for early January.

Burton Accessory Building (V- 92 -02)
Petitioner seeks approval of a Developmental Standards Variance of Section
25.1.1(B)(1): Maximum Height in order to construct a 19' 10" accessory building.
The site is located at 3227 East 136 Street. The site is zoned R -1 /Residence.

2j. Merchants' Pointe, Lot 6 (V- 170 -02)
Petitioner seeks approval of a Development Standards Variance of Section 25.7.02
8(b)(i): Number Type in order to establish three (3) ground floor tenant Identification
Signs.
The site is located at 2325 Pointe Parkway. The site is zoned B -8 /Business.
Filed by James J. Nelson of Nelson Frankenberger for Merchants' Pointe Associates,
LLC.
Present for Petitioner: Jim Nelson, 12481 Medalist Parkway, Carmel, IN. Six businesses are
completed and operational at Merchants' Pointe. The variance is to establish signs on the final
building in Merchants' Pointe. The planned 30,000 square foot, two -story building will be
located directly west of Borders Book Store. In August 2002, the Plan Commission approved a
revision to the plans to provide for three retail tenants on the first floor of this building, with the
second floor being reserved exclusively for office use. The approved plans were shown. Under
the Carmel Sign Ordinance, this building is classified as a multi- tenant, multi -story building. The
ordinance provides for building identification, rather than tenant identification. This building is a
return to the past, with storefronts on the ground level and office space above. The request is for
three separate tenant identification signs in keeping with the sign package that was approved by
the Plan Commission.
Members of the public were invited to speak in favor of or opposition to the petition. No one
appeared and the public hearing was closed.
Mr. Lillig gave the Department Report. The Plan Commission has approved both Commitment
Amendment and ADLS Amendment petitions for this project and the Department is
recommending favorable consideration.
Discussion followed regarding the 15,000 square foot office space identification on the second
floor.
Mr. Nelson stated any signage would need approval from the Plan Commission. It could be a
ground sign with a directory of the tenants.
Mr. Dierckman moved to approved V- 170 -02, Merchants' Pointe, Lot 6. The motion was
seconded by Mr. Weinkauf and APPROVED 5 -0.
Mr. Mohr thanked Den 13 Pack 124 from Orchard Park Presbyterian Church, led by Pat Rice, for
leading the Pledge.

3 -9j. Carmel/Clay Schools New Collegewood Elementary (SU- 171 -02; V- 172 -02; V -173-

Petitioner seeks approval of a Special Use under Section 5.2: Special Uses in order to
construct a school of general elementary education. In addition, the petitioner also seeks
the following Development Standards Variances:
V- 172 -02 §25.7.01 -2: Definitions: Traffic Directional Sign three (3) 14.5- square-
foot TDS
V- 173 -02 §25.7.02- 5(b)(i) two (2) Institutional Signs
V- 174 -02 §25.7.02- 5(c)(i) 96.25- square -foot Institutional Wall Sign
V- 175 -02 §25.7.02- 5(c)(ii) 24- square -foot Changeable Copy Sign
V- 176 -02 §25.7.02 -5(d) 6'2" Ground Sign
V- 177 -02 §5.4.1: Maximum Height 31 -foot building height
The site is located at 12415 Shelborne Road. The site is zoned S -1 /Residence Estate.
Filed by William E. Payne of Fanning /Howey Associates for the Carmel/Clay School
Corporation.
Present for Petitioner: Bill Payne, Fanning /Howey Associates, 9025 N. River Road,
Indianapolis, IN, architects and engineers for this project. This new school is the same design
and site layout as the Towne Meadow Elementary School. It will be located on the large site with
the new middle school that is now under construction. This school is located at the southwest
corner of the site, immediately south of the internal access drive, which is part of the middle
school project. It encompasses approximately 15 acres and is accessed from the internal drive.
Construction is expected to begin in the next month or so. The school is one story, K -5, and will
serve 725 students. It will blend with the new middle school. The main entrance will face
Shelborne Road. There will be a circular sidewalk that extends around the entire school, with
playground areas around the perimeter. The main bus queuing area is on the north side of the
school. The signs are standardized for what has already been approved for the new middle school
and other elementary schools. A sign detail sheet was shared. The gymnasium is a low slope,
with relatively flat roof, for competition and PE use.
Members of the public were invited to speak in favor of or opposition to the petition. No one
appeared and the public hearing was closed.
Mr. Lillig gave the Department Report. The Department is recommending favorable
consideration of SU- 171 -02 with the condition that all Technical Advisory Committee issues be
resolved satisfactorily prior to the issuance of an Improvement Location Permit. The Department
is also recommending favorable consideration of the Development Standards Variance petitions
(V- 172 -02 through V- 176 -02) for signage and V- 177 -02 for a thirty- one -foot building height.
Discussion followed regarding traffic on Shelborne Road.
Mr. Payne stated the middle school is the flagship building of this site and its location is relative
to the mature tree stand on the corner with the internal access drive wrapped around. The internal
access drive gives the alternative to enter and exit either on Shelborne Road or 126 Street.
Passing blisters and a turning lane will be provided for access into the middle school and the
internal access road will be used to direct all the major traffic into the site.

Mr. Weinkauf moved to approve SU- 171 -02, Carmel/Clay Schools New Collegewood
Elementary with TAC conditions. The motion was seconded by Mrs. Plavchak and
APPROVED 5 -0.
Mr. Dierckman moved to vote on V- 172 -02 through V- 177 -02 together. The motion was
seconded by Mrs. Plavchak and APPROVED 5 -0.
Mr. Dierckman moved to approve V- 172 -02, V- 173 -02, V- 174 -02, V- 175 -02, V- 176 -02,
V- 177.02, Carmel/Clay Schools New Collegewood Elementary. The motion was seconded
by Mrs. Rice and APPROVED 5 -0.

Carmel/Clay Historical Society Archival Conservation Center (UV- 178 -02; V-
179-02; V- 180 -02)
Petitioner seeks a Use Variance of Section 8.1: Permitted Uses in order to construct a
648- square -foot expansion to an existing museum. In addition, the petitioner seeks the
following Development Standards Variances:
V- 179 -02 §8.4.3(B): Minimum Side Yard <5 -foot east Side Yard
V- 180 -02 §27.5: Amount of Parking Spaces Required
The site is located at 211 2 nd Street Southwest. The site is zoned R -2 /Residence within
the Old Town Overlay District.

V- 166 -02 §5.4.1 45' 4" auditorium height
The site is located at 5150 East 126 Street. The site is zoned S -1 /Residence Low
Density.
