It is my understanding that the trees can be placed anywhere on the site rather than in a ring around the pool. Therefore, as discussed in TAC, a specific bufferyard delineation is not shown. 4. It is the intent of the Division to resolve non compliance issues and avoid referring this project to the Indiana Department of Environmental Management (IDEM) for an enforcement action. The rule requires an erosion and sediment control plan be submitted to the Soil and Water Conservation District prior to initiating land disturbing activities. The plan must meet the minimum requirements of the rule. Construction activity associated with this project has commenced without an adequate erosion and sediment control plan. You are currently operating without a permit and are in violation_of 327 IAC .15 -5. Please. submit an erosion and sediment control plan that meets or exceeds the minimum requirements of the rule to the Hamilton County SWCD on or before September 22, 2003. Because the project started without an approved plan and the basic perimeter practices have not yet been fully installed, I am recommending a Notice of Violation for this project.
