The Construction plans for the Claybourne Pool have been revised according to the
conditions attached to the BZA approval in the November 22, 2003 Carmel BZA
meeting. The revisions are:
1. The sidewalk in front of the pool house has been widened by 2' as discussed with Jon
Dobosciewicz.
2. The sidewalk has been extended to the R/W at the north side of the property as
requested.

The Construction plans for the Claybourne Pool have been revised according to your
TAC comments dated November 17, 2003. The revisions are:
1. An approval letter from Scott Brewer has been requested and will be forwarded as
soon as it is received.
2. A copy of the adjacent property owners is attached.
3. It is my understanding that the trees can be placed anywhere on the site rather than in a
ring around the pool. Therefore, as discussed in TAC, a specific bufferyard delineation
is not shown.
4. A fence detail/ cut sheet will be provided by the developer.
5. No dumpster is planned.
6. Sample information will be presented at BZA.
7. No site lighting is planned.
8. The pavement in the right -of -way and valley curb detail are on the plans.
9. The landscaping plan is being revised completely.

We have reviewed the construction plans submitted to the Hamilton County Surveyor's
Office on November 12, 2003 for this project and have the following comments:
1. This project will be part of the Claybourne Arm of. the Albert Shaw Regulated
Drain, subject to approval from the Hamilton County Drainage Board.
2. Please submit the following procedural items to this office, petition for regulated
subdivision, non- enforcement request for subdivision, engineer's estimate, and all
associated bonds for 100% of construction cost. The applications are available on
our website at www.co.hamilton.in.us, click on Department Directory, then
Surveyor's Office. Please contact me for directions on completing the forms.
3. Proposed entrance off of Antonia Boulevard will require existing underdrains to
be replaced with HDPE pipe across entrances.
4. Proposed entrance off of. Antonia Boulevard will require a crossing permit, which
is available on our website.
5. Add Developer's Fax number to sheet C100.
6. Add Hamilton County Regulated Drain Standard 0 -5 and D -10 or D -11 (which
ever is appropriate to the existing lake) to sheet C802

7. The landscape plan show plantings directly above and within the easement of the
proposed regulated drain. Please add a note to the landscape plan, and submit a
letter from the developer, stating "Tree placement will be coordinated with the

Dear Mr. Thompson:
This office has been notified by John South, PE District Manager, for the Hamilton County SWCD
that your project known as Claybourne Sec. 2 is out of compliance with the National Pollution
Discharge Elimination System (NPDES) General Permit Rule 327 IAC 15 -5.
It is the intent of the Division to resolve non compliance issues and avoid referring this project to
the Indiana Department of Environmental Management (IDEM) for an enforcement action.
The rule requires an erosion and sediment control plan be submitted to the Soil and Water
Conservation District prior to initiating land disturbing activities. The plan must meet the minimum
requirements of the rule. Construction activity associated with this project has commenced without
an adequate erosion and sediment control plan. You are currently operating without a permit and
are in violation_of 327 IAC .15 -5. Please. submit an erosion and sediment control plan that meets or
exceeds the minimum requirements of the rule to the Hamilton County SWCD on or before
September 22, 2003. The plan should be mailed or delivered to:

The enclosed On -Site Evaluation documents that an insufficient effort has been made to comply
with the conditions and requirements of 327 IAC 15 -5. The report clearly outlines the deficiencies
observed at the site and the requirements to bring the project back into compliance. Failure to
implement and maintain appropriate erosion and sediment control measures is a serious violation
and deserves your immediate attention. It is requested that on or before September 22, 2003 that
corrective action is taken to address the deficiencies specified in the enclosed on -site evaluation.

Current Site Information: 75% of the rough grading is completed. The north west pond is 85% completed. Swales are cut
to direct water to the sediment basins. The north central sediment basin is cut but the outlet is not installed.

Proper implementation of the erosion and sediment control plan and inspections of the construction site by the developer or a
representative are necessary to minimize off -site sedimentation. The developer should be aware that unforeseen construction
activities and weather conditions may effect the performance of a practice or the erosion and sediment control plan. The plan
must be a flexible document, with provisions to modift or substitute practices as necessary.

Comments:
Spot elevations are needed to correctly stake the temporary diversion swale along the west property line.
The construction sequence is very good. However, it ends before the construction of utilities and final
grading and seeding of all lots.
