hearing date, The certified "Proof of Publication" affidavit for the newspaper must be available for inspection the night of the
hearing.

FINDINGS OF FACT SPECIAL USE
1. The Special Use in Flood Plain District, Ordinance Z -160, Section 21.6 as amended (does not) apply and all
prerequisites have been met by Petitioner as verified by:
The site is not in a flood zone A
2. The Special Use will be consistent with the Character and Permitted Land Use of the zoning district and
Carmel /Clay Comprehensive Plan because:
This is a common and popular recreational use in a residential district provided specifically for the use and
enjoyment of the neighborhood residents.
3. The Special Use is physically suitable for the land in question because:
The overall land use plan was set Up to accommodate the pool on this site.
4. The Special Use will not injuriously or adversely affect the adjacent land or property values because:
it will increase the value of the homes by making this amenity available to the
residents.
5. The Special Use will not adversely affect vehicular or pedestrian traffic flow, nor the adequate availability of water,
sewage, or storm drainage facilities, or police or fire protection because:
Parking and access for the project meets code requirements and the project has very limited need for
utility services.
6. The Board has reviewed the requirements of Ordinance Z -160, Section 21.3 (1 -25) as they relate to this Special
Use, and does not find that those criteria prevent the granting of the Special Use:
The pool will provide a desired recreational facility for the residents of Clavbourne
DECISION
IT IS THEREFORE the decision of the Carmel /Clay Board of Zoning Appeals that Special Use Docket Number
SU 114 03 is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by
reference and made a part hereof.

L. Site Narrative
The Claybourne Pool will provide recreational facilities for the 258 home sites in Claybourne and
Shelborne Estates. The pool is located in Block "L a common area platted as part of Claybourne,
Section 2 in 2003 and covers 2.047 acres.
M. Water Service
Water service for the project will be supplied by the City of Carmel. Water mains serving the project
have been installed across the frontage of the site as part of the construction for Claybourne,
Section 2.
N. Sanitary Sewer Service
The sanitary sewer service will be provided by Clay Township Regional Waste District. Sewer
mains serving the project have been installed across the frontage of the site as part of the
construction for Claybourne, Section 2.
0. Storm Drainage
The storm water runoff will be collected in storm sewers and routed through the future section of
Claybourne and into the existing Lake #6 that was constructed and part of Claybourne, Section 2.
Storm water detention for the pool site was part of the overall detention design for the subdivision.
The storm sewers will be dedicated to the Hamilton County Drainage Board as regulated drains and
the system design will meet the requirements set by the Hamilton County Surveyor.

We have reviewed the prints for Claybourne Pool and have some corrections to your plans listed below.
Also, listed are our standard specifications we the City Utility require. As- builts, which include both sewer
collection and water service measurements are to be turned into the distribution and collection office at the
time the water is due to be turned on. We will need 2 sets of paper /hard copy as- builts as well as 2
copies of electronic as- builts on a CD. These CD drawings must include streets, lots, water mains,
valves, sewer mains, manholes, laterals and service lines. Posi -Caps or the equivalent is now required
on all water valve installations. You will need to call for an on site meet with the inspector. You will also
need to have an approved stamped set of prints before starting any construction. Tracer wire must be
installed with all water main laid in Carmel. Warning tape must be installed 12" to 18" above the water
main. We also need a detail sheet that includes a restraint joint chart.
Water Corrections:
1. The water meter is to be a 1".
2. You must install a 1" RP (Reduced Pressure) device

We have reviewed the construction plans submitted to the Hamilton County Surveyor's
Office on November 12, 2003 for this project and have the following comments:
1. This project will be part of the Claybourne Arm of the Albert Shaw Regulated
Drain, subject to approval from the Hamilton County Drainage Board.
2. Please submit the following procedural items to this office, petition for regulated
subdivision, non enforcement request for subdivision., engineer's estimate, and all
associated bonds for 100% of construction cost. The applications are available on
our website at www.co.hamilton.in.us, dick on Department Directory, then
Surveyor's Office. Please contact me for directions on completing the forms.
3. Proposed entrance off of Antonia Boulevard will require existing underdrains to
be replaced with HDPE pipe across entrances.
4. Proposed entrance off of Antonia Boulevard will require a crossing permit, which
is available on our website.
6. Add Hamilton County Regulated Drain Standard 0-5 and D -10 or D -11 (which
ever is appropriate to the existing lake) to sheet C802

1. An approval letter from Scott Brewer has been requested and will be forwarded as
soon as it is received.
2. A copy of the adjacent property owners is attached.
3. It is my understanding that the trees can be placed anywhere on the site rather than in a
ring around the pool. Therefore, as discussed in TAC, a specific bufferyard delineation
is not shown.
4. A fence detail/ cut sheet will be provided by the developer.
5. No dumpster is planned.
6. Sample information will be presented at BZA.
7. No site lighting is planned.
8. The pavement in the right -of -way and valley curb detail are on the plans.
