FINDINGS OF FACT DEVELOPMENT STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
The C -1 /City Center District is specifically intended to foster a unique commercial character reminiscent of an
earlier period in small -town development. The type and character of the proposed sign furthers this intent, and is,
therefore, a benefit to the general welfare.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The value of all properties in the City Center area are expected to increase in value as redevelopment and
investment in the area by the City and private developers continues. The proposed signage furthers the design
objectives for the area; and increases the overall attractiveness to investors interested in the area by helping to
establish the character of the district.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because:
The strict application of the terms of the Zoning Ordinance will not result in practical difficulties in the use of the
property in the narrowest sense, in that the occupancy of the commercial tenant spaces would likely be unaffected
by the absence of the sign. However, the overarching interest of the City in establishing the character for
redevelopment protects in the City Center district would be adversely affected by the overly sterile environment that
the lack of the sign would create.
DECISION
IT IS THEREFORE the decision of the. Carmel /Clay Board of Zoning Appeals Hearing Officer that Development Standards
Variance Docket No. V- 115 -03 is granted, subject to any conditions stated in the minutes of this Board, which are
incorporated herein by reference and made a part hereof.
