The applicant seeks the following development standards variance:

General Information:
The petitioner requests to place a "Charter One Bank" sign on the south facade of the Marsh
grocery store building at 2140 E 116 Street, located in Merchants' Square shopping center. The
petitioner seeks a variance for sign size. The proposed sign is 114.6 square feet, while the
maximum size allowed by the Zoning Ordinance is 105 square feet. The sign criteria states that
the "distance of the sign from a street right -of -way (Medical Drive) is to be calculated as 150 -ft
and is to be considered consistent for the entire building. Using this measurement produces a 105
square —foot allowable sign. The petitioner is requesting a variance of 9.6 square feet for a larger
sign.
Background Information:
The Linder Company has set forth sign criteria for Merchants' Square. The petitioner has
complied with these criteria.
Analysis:
Since Charter One Bank is located within Marsh supermarket store; it should have signage
representation on the building facade. While the bank does not utilize as much floor space as the
supermarket, signage in Merchants' Square should have an overall conformity with color and
size.
Findings of Fact:
1.) The approval of this variance will not be injurious to the public health, safety,
morals, and general welfare of the community because: The second sign on the
building's 380 -ft wide facade will communicate to patrons that a bank can be accessed
within the store. The size of the sign is appropriate and will fit within the context of the
shopping center, and will give better visibility from 116 Street, which is about 600 feet
away.
2.) The use and value of the area adjacent to the property included in the variance will
not be affected in a substantially adverse manner because:

is to allow a sign that is 9.6 square feet larger in size.
3.) The strict application of the terms of the Zoning Ordinance to the property will
result in practical difficulties in the use of the property because:
The strict application of the Zoning Ordinance may result in practical difficulties in the
use of the property due to the reduced size of the size will not be able to be seen well
from E 116 Street. This might cause a loss of banking customers.
Recommendation:
The department recommends positive consideration of Docket No. V- 128 -03.
