The site is zoned PUD /Planned Unit Development. The y basements of the building 4 W w ere to be partially used for storage. However, d ue t t he h water table, the basements w no be built. Now, storage will be used on the second floor /mezzanine of Buildings A B, as well as office and a meeting room in Building B. Also, pool equipment was also supposed to be stored in the basements. Since a basement will not be built, the equipment will be stored in an area that will extend from the western portion of Building B, which will include a roof that is flat (not sloped). The Committee has unanimously approved the modified design of the buildings at the January 6, 2004 Plan Commission Special Studies Committee Meeting. Anal ysis: The unique geological feature of this site renders it unsuitable for basements. Since the proposed storage must be relocated to another floor of the building, a building extension is needed to house all of the equipment. Findings of Fact: 1.) The approva of this variance w of the will not be injurious to the public health, safety, morals, and general welfare comm unity because: Foregoing basement installation w not be injurious to the commun Other floors of the building can be 15 used for storage. The building extension will add an architectural element to the building that also serves as storage use. 2.) The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The use and value of the area adjacent to the property will not be affected in a substantially adverse manner by allowing no basements and a flat roof on the building extension. The building extension will add a unique architectural element to the building. 3.) The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: The strict application of the PUD Ordinance may result in practical difficulties in the use of the property due to a lack of storage and meeting space for the intended uses. Recommendation: The department recommends positive consideration of Docket No. V- 133 -03. 16
