They are checking on the depth the water would flood over the main access to Lots 1 -3 during the 100 year flood and will then provide this depth to emergency response and see if this is acceptable. I do not see how they can provide access to Lot 4 during the 100 -year flood. They will still have access for all other times; so I feel that they can still plat the lot. When they pull and ILP for Lot 4, we might have issues if an emergency access route is not established (perhaps by easement through the property to the west). At present they are not proposing any fill in the flood plain. They have indicated that they will provide a commitment that in the event that more than 0.25 -acres of land disturbance occurs (collectively, for the whole development) they will work with us to provide the requisite storm water detention and storm water treatment or seek the necessary variances. The sight distance issue would be remedied with modifications to 136 Street under the commitment from Drees for the Village Green. I guess we need to have Drees follow through on this work... We understand that this will be necessary when a plan is put together for the development of that area; however, as there are no plans at this time, we have not contacted them. We walked the site last week after we received your comments and felt good about committing the additional areas on the site tree preservation plan. During home construction we will fence off the tree areas adjacent to the home sites along with additional individual trees on the lots that can be saved. Fortunately, in the building pad areas for lots #1 -3 there are only one or two viable trees and we will attempt to design around them. Please let me know what other areas need to be addressed. We would have to get a DNR permit to cross the floodplain with a driveway if we were ever to access this space or if we couldn't do it that way we would have to obtain access by joining our property to the others to the west which may happen in the future. Either way, we believe we could make a good argument for why it should be separated from the other lots and would like to continue with the request. Most of these issues relate to the base flood elevation of Cool Creek. Apparently, the FEMA map was changed (erroneously we believe) recently and we will be working to change it back to the correct elevations. A lot of progress has been made but its created a few questions relating to our filing and notice. 1) Lot #1 would be difficult to build on under the existing zoning because of setbacks. However, if Smart Code were to be approved the new setbacks would allow for a reasonable sized home on the lot. Can we plat the lot under the existing ordinance and just keep it un built until zoning changes are made? 2) We would like to split off the back land and create a "lot #4 Gary thought this made sense so that we could have a separate deed from lot #3 for this large undeveloped tract. Does adding a lot require that we table for a month and notify TAC again? I don't see how their comments would change at all. Since we haven't sent notice yet are we still covered if the notice this week explains that there will be four total lots? 1 Please advise as we will need to get notice sent within a few days. We are leaning towards moving forward with the three lot plan based on a few issues. 1) There are several excellent trees within the building area. With more than three homes some or all of those trees would have to come down. 2) With three lots we do not need waivers on having 50' at the r /w. If we need waivers we open up the debate about private streets, etc.... I believe that the engineering dept. will have a problem with not having a turnaround if we have five lots. When we add a turnaround we get into issues such as building a road in the floodplain, etc... which is costly and time consuming. I'd probably end up building the extra two homes for no profit just to cover the cost of the additional infrastructure. 3) I do have some timing concerns with filing pertaining to my closing obligations with the owner. If I went with five lots believe I'd have to wait for Smartcode to be approved prior to filing. However, if I move forward with the three lots I could file my prelim. plat request within weeks and be on the January agenda and likely have an early February approval at subdivision comm. Just wanted to keep you apprised of my thoughts. I'm going to have my engineer work up a proposed prelim. plat for your review. The ordinance text reads that the overall parcel must comply with the US 31 requirements, even if a parcel is partially covered by the overlay. Thinking of platting four or five Tots on the usable ground that is adjacent to Monon for single family homes. I would then keep the remaining five acres of ground for future development. The more I've looked at the site I've come to realize that the creek divides the two sections of usable ground so there is no reason I can't move forward with a portion of the development now in order to cover some of my land costs while I'm waiting on the remaining piece which may be several years down the road.
