Vance 7650 Walnut Dr. Indianapolis, IN 46268 VIA CERTIFIED MAIL RE: ZONING/CITY CODE VIOLATION - RUBBISH AND GARBAGE Dear Sir / Madam: This letter is being provided to inform you that an inquiry was made to the Department of Community Services regarding a possible City Code Violation at 33 Circle Dr., in the City of Carmel, a properly listed under your ownership. An inspection revealed that the concern appears to be valid and that the property is in violation of the Carmel / Clay Land Use Regulations § 25.05 which states, `trash, garbage and all solid was shall not be stored outside of any building for a penod of longer than seven (7) days, except when construction is in progress". The bags of trash along the side of the house are also in violation of the City of Carmel Property Maintenance Code § 6-222 (d) Rubbish and GajbAge, which outlines: (2) Disposal of Rubbish and Garbage. Every occupant of a structure shall dispose of all rubbish and garbage in a clean and sanitary manner by placing such rubbish or garbage in approved containers. i. Rubbish and Garbage Storage. The owner of every occupied premise shall supply approved covered containers for rubbish and garbage, and the owner of the premises shall be responsible for the removal of rubbish and garbage. Please remove all rubbish and garbage (all bags of garbage lying on the ground on the premises, etc.) from the premises, or place in approved garbage containers, by February 6, 2010. Failure to resolve the violation(s) by the specified deadline will result in further Enforcement action by the City of Carmel, to include City abatement (to which property owner is billed), and / or the issuance of daily citations as long as the violations persist (which also requires a mandatory appearance in Carmel City Court).
