c. Please increase the right -of -way on the south side of Street A to provide a minimum of
ten feet of right -of -way beyond the back of curb of the parking lanes. Please provide
sufficient of right -of- way to accommodate the multi -use path within the right -of -way.
Unless the proposed grading of the parking space is allowed by the PUD, the crown
of the road must be continued into the parking space.
e. The cross section in the upper right corner of this sheet does not accurately represent

36. General Comments:
a. We acknowledge that this project is subject to the City's Storm
Water Management and Storm Water Quality Ordinances and
these have been mastered planned.
b. The following note will be indicated on the Construction Plans:
"IF IT WILL BE NECESSARY TO RELOCATE EXISTING
UTILITIES, THE EXPENSE OF SUCH RELOCATION
SHALL BE THE RESPONSIBILITY OF THE DEVELOPER.
ALL UTILITY POSES SHALL BE LOCATED WITHIN ONE
FOOT OF THE PROPOSED RIGHT -OF- WAY."

Please find enclosed 1 set of Construction Plans, which were revised per a
comment letter dated February 5, 2010. Those comments were addressed as
follows:
1. Per Section 102.02 vii, Storm Sewers will be private.
2. Per Section 102.02 xi, the plans will include the following
information:
a. (g) Construction drawings will note the structure numbers and
agree with those numbers presented in the Drainage Report.
b. (h) Indication will be noted that the system will be private.
c. (k) Emergency flood routing path(s) and their invert elevations
from detention facilities to the receiving system will be provided
on the Construction Plans.
d. (m) A drainage summary, which summarizes the basic
conditions of the drainage design, including site acreage, off
site /upstream acreage, allowable release rates, post- developed
10 -year, and 100 -year flows leaving the site, volume of detention
required, volume of detention provided, and any release rate will
be provided on the Construction Plans.
3. The Construction Plans will provide a structure data table which will
conform to Section 102.02 xiv of the City's Storm Water Manual.
4. Structure 262 will have a 2 foot sump which will be indicated as
such on the Construction Plans.
5. The Construction Plans will indicate grades and details of the on
street parking along the south side of Street A to confirm there will
be positive drainage to the proposed storm structures.
6. The symbol has been revised per your request.

7. It is intended to run a subsurface drain under the inverted pavement
and above proposed storm Structures 264 and 263 and adequate

My suggestions for the species diversity for the landscape plans for Livingstone Cottages are as follows:
1, Species shall be kept to 15% and genus shall be kept to 20 For your 37 trees on the plan, that would be 6 per
species and 8 per genus.
2. If you could replace the red maples with red oaks and keep the 2 red oaks you have, that would be satisfactory for
the shade trees. The red oaks are better street Trees than the red maples.
3. If you could add a 3 species of ornamental trees to go along with Serviceberries and dogwoods, that would work the
numbers out there.

Thank you for your preliminary comments. On behalf of Adult Family Living, Inc. (AFL),
below, in italics, please find the responses to your comments in advance of the February 17th
Technical Advisory Committee meeting.
1) Please provide a drainage plan and drainage calculations.
These have been provided to the Department of Engineering, County Surveyor's Office and
Crossroad Engineers as of January 28
2) Please provide an erosion control plan /SWPPP.
We have duly noted and Stoeppelwerth Associates is in communication with the
Engineering Department regarding the desired detail in terms of this project in relation to
the overall Legacy PUD.
3) Remember to include the Findings of Fact sheet in your final info packets.
We have duly noted and will include accordingly.
4) On the Notice of Public Hearing page, please make sure the meeting time is 6 PM and
not 6:30 pm.
The public notice has been revised accordingly.
5) Provide the filled out and notarized affidavit of notice of public. hearing page of the
application.

8) Provide a copy of the site plan overlaid on an aerial photo of the site.
Per our e -mail exchange on 02.04.10, this was included with our application; however, the
exhibit will also be included in the materials we submit for the Plan Commission.
9) Show /label the trash receptacle location, and provide screening details. Make sure that
the dumpster enclosure is taller than the dumpster. Will bio- hazard material be stored
separately?
Due to the residential design of this project, there will not be dumpsters; rather, only
residential trashcans will be used, which will be stored within the garage. Because medical
treatment is not being administered, there will be no storage (e.g., Sharps containers) of bio-
hazard materials.
10) Bring material/color samples to the Plan Commission meeting.
We have duly noted.
11) Please provide bike parking near the entrance, per chapter 27.06 of the ordinance.
Please provide the bike rack details /design.
Bicycle traffic is not expected for this project due to the demographics of the residents;
however, the development plan will be modified to incorporate central bicycle parking areas
to complement and encourage connectivity with the overall Legacy PUD. The bike rack
details and design will be incorporated on the development plan as well.
12) Please add the parking requirements to the site plan, 0.3 spaces per memory support
unit plus 1 per employee of the largest shift.
We have duly noted and the requirement will be added to the development plans.
13) Please label the ADA accessible parking spaces.
Due to the residential nature of this project and because residents will not be driving, AFL
does not anticipate a need for handicap parking; however, parking will be provided within
each building's driveway and garages. The other proposed parking is parallel on- street, thus
these spaces could not be used for ADA accessible spaces.
14) Please provide more detail on the courtyards, such as paver material, plantings, etc.
Please note the courtyards are interior private courtyards which will neither be visible or
accessible from the perimeter of the building; however, an illustrative design of the

courtyard, which will be subject to change and may vary with each building, will be
incorporated onto the landscape plan submitted for the Plan Commission.
15) Please provide the lot coverage percentage, which also takes into account pavement and
building footprints.
We have duly noted and the lot coverage calculations will be added to the development plan.
16) Show /label the mechanical equipment on the site plan and provide the screening details.
Due to the residential nature of the project, there is no external mechanical equipment
serving the buildings, other than a typical exterior residential A/C unit. The landscape plan
labels the location of the A/C unit and provides screening accordingly (please note lilac
bushes surround the A/C units).
17) Though not required, please provide a checklist of LEED /sustainable practices you will
utilize on this project. See attached list as a guide.
Attached please find a summary of those elements proposed to be incorporated by AFL into
the Legacy Cottages. This exhibit will be included with the materials submitted for the Plan
Commission.
18) Please provide the dimension /details of the window signage at the door entries.
As briefly discussed in our pre filing meeting, the front doors to each building will include a
stained glass window and AFL intends to incorporate its logo into the window. An exhibit
depicting the design is still being prepared at this time, but we will provide it to you as
requested prior to submitting our materials for the Plan Commission.
19) Please refer to Exhibit 9 (and perhaps exhibit 12) of the Legacy PUD, for guidance on
wall planes and roofline design.

transportation. I have reviewed the project submitted for the February 17, 2010 Technical Advisory Committee
meeting and the comments from the alternative transportation review have been satisfactorily addressed
We request that all responses to our comments be provided in writing. Failure to provide written responses may
result in delay of the review process.
It is critical that this office be made aware of all modification made on the plans being re- submitted, particularly if
any such changes are considered "new" or fall outside of our previous reviews. Please provide revised plans
indicating all revisions. Please notify us of any changes and specifically state any changes, including changes
resulting from Plan Commission, Special Studies or other committee meetings.

At a minimum, the structure data shall include the following information:

4. Per Section 501.03. Structure 262 will require a 2 foist sump.
5. Provide grades and details of the on street parking along the south side of Street A
to confirm there will be positive drainage to the proposed storm structures.
6. Please revise the symbol that denotes both the double wall Rancor Hi -Q SSD

pavement and above proposed storm structures 264 and 263, and if so, confirm
there is adequate depth per the detail provided in the plan sheet.
