FINDINGS OF FACT DEVELOPMENT STANDARDS VARIANCE (Ballot Sheet)
1 The approval of this variance will not be injurious to the public health, safety, morals and
and general welfare of the community because the subject property is currently being operated
as a model home.
2 The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because the subject property has already been operated
as a model home for the last 36 months.
3 The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property because Applicant would incur substantial cost and time to
convert or construct a new model home on another lot when Applicant only has 5 Tots left and one
market ready home left in the subdivision to sell.

STATEMENT OF VARIANCE
Petitioner seeks a waiver of the 36 -month time limit of'a model home permit
under Chapter 25.16.02 of the Carmel Zoning Ordinance to allow Petitioner to continue
to operate the home located at 2530 Milano Drive, Westfield, IN 46074 as a model home
until such time as Petitioner no longer owns any lots or homes in The Lakes at Towne
Road subdivision.
