Subject: RE: Silver Convenience Center We support them moving forward tonight. Is the sign in the existing right -of -way? If it is not, we really cannot have them do a consent -to- encroach. Ideally they would construct a new sign outside of the future r /w; but I am not certain how firm our position would be to request it. A commitment to move it in the future as the City's right -of -way needs are further established would also be great and is the second best option. If need be, leaving the sign in its current location is acceptable. It is not a large expense to pay as damages when we purchase the right -of -way sometime in the future. But it is certainly worth trying the other two approaches first. We would need to consider the sight lines of the RAB. If it does not obstruct the sight lines and is not in the way of other improvements, I expect the Board to approve a CTE; but it will be their call. I assume they would also, at that time, need a variance to have a sign in the r /w? I have reviewed the drawings submitted for the March 17, 2010 Technical Advisory Committee and present the following comments: URBAN FORESTRY REVIEW COMMENTS 1) The marked 'existing shrubs' along the north border of the property are not shrubs. This notation of shrubs will need to be changed to 'existing trees'. 2) These trees along the north border are pine trees; with that, many of them are in decline; I would like to see the two that are east of the dumpster removed, because of poor tree health and safety concerns. In its place, a viable substitution would be two Japanese Lilac Trees to be placed along the curbing in this NE corner. 3) I do not see any planting details for this landscape plan. I have attached the City of Carmel's standard plant material planting details for your use. Planting details will need to be a part of the plan. 4) I would suggest that the existing ash tree along Guilford Rd that is under the power lines be removed. This tree is simply not the 'right tree in the right place'. In its place, I would recommend two to three Japanese Lilac Trees to be placed along Guilford. These are formal, flowering trees that are consistently used in areas with power lines overhead and would match the two planted at the NE corner. Maybe shift the Shell logo on the canopy from the east elevation of the canopy to the south elevation of the canopy, and place it on the left side of that south elevation.( it would still need BZA variance approval to be on the canopy.) Other gas canopies in the area do not have signage or logos on them, though, but this could be the tradeoff for having a sandstone color canopy. Also, there should be NO internally illuminated bar around the canopy top, just recessed lighting within the canopy to shine light down to the area under the canopy where the cars and pumps are. For the ground sign, can there be a brick wrap around the sign panel and maybe have a cornice at the top? Canopy Option 2 is nice. And, Option 1 is ok, but still very bright. Also, I'm dubious about the "internally illuminated red bar I like option 2 better. But they still can't have the shell logo on the canopies (without BZA variances). How about some kind of cornice molding or something more decorative at the top of the canopy? The ground sign is 7'5" tall?! Since there was never a permit issued for this sign originally I think something must be done to take it down to the 6' tall requirement (or BZA variance approve is needed, which we will not support). For the canopy that was proposed at carmel dr. range line rd. The installation of any permanent, privately owned and /or maintained improvement (signs, decorative street signs, walls, streetlights, etc.) within dedicated right of way or dedicated easements requires the execution of a Consent to Encroach Agreement between the Owner and the City of Carmel: Such, agreements are executed by the Board of Public Works and Safety. The City Engineer may approve irrigation system agreements. 22. Secondary Plat approval if applicable. All performance guarantees must be posted prior to submission of secondary plats for Board of Public Works and Safety approval. 23. Dedication of right -of -way if not platted. This is based upon the City of Carmel 20 -Year Thoroughfare Plan requirements. Dedication documents are available upon request. Please be advised that all Right of Way Dedications must be accompanied by a Sales Disclosure Agreement completed by the owner for the property being dedicated to the City. The dedication document cannot be recorded without a completed Sales Disclosure. The form is available upon request. 24. Any open pavement cuts of either Old Meridian Street or Grand Boulevard, other than those required for the curb and median cuts will require Board approval. BONDING REQUIREMENTS 25. Please contact Mr. Dave Barnes to review performance. guarantee requirements. 26. The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for 100% of the cost of labor and materials to construct the individual improvements, to be provided by the design engineer. Please provide detailed Engineer's Estimates for each improvement including quantities, unit costs, pipe sizes and materials, etc. 27. Upon completion and release of individual Performance Guarantees, a three -year Maintenance Guarantee will be required (see Street Sign comments above). The Maintenance Guarantee amount is based upon 15% of the Performance amount for Streets and Curbs and 10% of the Performance amount for all other improvements. 28. Performance Guarantees may be Performance or Subdivision Bonds or Irrevocable Letters of Credit. 29. Please reference the available enclosures for more detailed explanation of our procedures. RIGHT OF WAY PERMIT AND BONDING 30. Any work in the dedicated right -of -way will require an approved Right of Wav Permit and a License Permit Bond. 31. The bond amount is determined by our Right -of -Way Manager. However, if the work is included in the scope of work of a required and posted Performance Guarantee, the Performance Guarantee may be used to satisfy the bond requirements of the Right Way Permit. 32. Please contact our Right -of -Way Manager, Fred Glaser, to arrange right of way permitting and bonding. AVAILABILITY AND CONNECTION FEES 33. We defer to Carmel Utilities regarding this issue. 34. Ilan entryway or overall site irrigation system is planned for this development, additional Water Connection Fees will be assessed based upon the size and usage of the system and upon the recommendations of the. Director of Carmel Utilities. 35. These fees are required to be paid prior to final approval of construction plans by Engineering and prior to issuance of building permits by Building Codes Services.
