The applicant seeks the following development standards variance approval:
Docket No. 10040001V 25.16.02 Extension of model home opening
The sites are located at 2530 Milano Drive and adjacent, on less than one acre, and are zoned
S 1 /Single family

a a' General Info: The petitioner is requesting approval for
extending the pe��nitted timeline for open model homes until
such time as all homes in the subdivision are sold.
A Analysis: Model homes are intended to display various options
r 5 and floor plans while construction and selling of the
I f ;4" 1 subdivision gets underway. In this instance, construction on
ii: 1 ,I Lakes Towne Road began in 2004, and is ongoing. Model dam .,p homes are limited to a period of 18 months, which is typically
ii enough time to allow for substantial completion and sales of
„M 4 I i A homes in the subdivision. It may be extended up to 36 months
i at the Director's discretion. In this instance, because of the
Io slow economy, the subdivision is still being built out and sold.

l' f t after hours to minimize light pollution, impact on occupied
residences is likely to be minimal.
Findings of Fact: Model Home Permit Extension
1. The approval of this variance will not be injurious to the public health, safety, morals, and
general welfare of the community because: model homes look like occupied houses, and
function in a similar fashion.
2. The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because: model homes look like occupied houses,
and function in a similar fashion.
3. The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because: the model homes would need to be
converted to residential homes, which would reduce the amount of information available to the
developer to provide to potential homebuyers.
Recommendation:
The Dept. of Community Services recommends positive consideration of Docket No. 10040001 V
after all concerns have been addressed.
