In my letter dated October 28, 2009, 1 explained that our department had recently received some concerns regarding 13681 Cheswick Blvd. in the City of Carmel, a property listed under your ownership. This property was inspected on October 24, 2008 and found to be in violation of the side yard setback provisions as regulated by the Carmel/Clay Zoning Ordinance §25.01.01 (C) 8 a. The ordinance states a minimum setback for a private swimming pool is 10 feet from the side and rear lot line. This includes the pool patio, as well. The pool on your property at 13681 Cheswick Blvd. encroaches the entire length of that 10 foot setback and appears to cross the property line as well. To date, you have removed a section of the fencing, however, the landscaping and concrete patio addition remain in violation. Also, to date, there has been no final inspection completed or C/O issued on this pool either. No C/O will be issued until this matter has been brought into compliance. Furthermore, continued violation will result in additional enforcement action which could include an appearance in Carmel City Court. Please remove the concrete which was poured illegally, the mechanical equipment fencing, and return the pool to the condition submitted for permit approval, which honored the 10 foot setbacks. Also, once you have brought the sideyard setbacks into compliance, please contact our office to receive your final inspection and C/O. Please bring this site into compliance no later than June 26, 2009. Continued violation will result in additional enforcement action which could include an appearance in Carmel City Court. Fox Pools of Indianapolis did not pour the concrete on the north side of the pool and did not contract the fence around the filter pad. Per our meeting of today's date, the photos I left depict approximately a 12" encroachment on one corner of the deck and only a %" board on the fence. We did pour a 3' deck as part of the pool installation, however, I have no idea who contracted the fence and extra pour; and the homeowner was advised of the 10' easement setback.
