Beikes 38 Lansdowne Lane Carmel, IN 46032 RE: PROPERTY MAINTENANCE VIOLATION Dear Mrs. Beikes, This letter is being provided to inform you that it has recently been brought to the City's attention that the structure at 38 Lansdowne., a property listed under your ownership, is in violation of Carmel City Code §6-220 the Property Maintenance Code, and §6-99 the General Animal Care. The following are the sections of code in violation: (1) §6-222 (b) 1 Sanitation. All exterior property and premises shall be maintained in a clean, safe and sanitary condition. The owner or occupant shall keep that part of the exterior property, which such occupant occupies or controls in a clean and sanitary condition. (2) §6-222 (c) 1 General. The exterior of a structure shall be maintained in good repair, structurally sound and sanitary so as not to pose a threat to the public health, safety or �i welfare. (3) §6-222 (c) 2 Protective treatment. All exterior surfaces, including but not limited to, doors, door and window frames, cornices, porches, trim, balconies, decks and fences shall be maintained in good condition. Exterior wood surfaces, other than decay resistant woods, shall be protected from the elements and decay by painting or other protective covering or treatment. Peeling, flaking and chipped paint shall be eliminated and surfaces repainted. All siding and masonry joints as well as those between the building envelope and the perimeter of windows, doors, and skylights shall be maintained weather resistant and water tight. All metal surfaces subject to rust or corrosion shall be coated to inhibit such rust and corrosion. Oxidation stains shall be removed. All exterior surfaces shall be of uniform Roofs and drainage. The roof and flashing shall be sound, tight and not have defects that admit rain. Roof drainage shall be adequate to prevent dampness or deterioration in the walls or interior portion of the structure. Roof drains, gutters and down spouts shall be maintained in good repair and free from obstructions. Roof Drain discharges shall be discharged as a Legal Connection or a Legal Discharge. Inappropriate or temporary roofing coverings including but not limited to tarps shall be deemed inadequate protection and not uniform and as such shall be prohibited for a period exceeding seven (7) consecutive days. (4) §6-222 (g) 6 Free from Dampness. In every building and all portions of the building including, but not limited to, basements and crawl spaces shall be maintained to prevent conditions conducive to mold formation, decay or deterioration of the structure. §6-222 (c) 5 Exterior walls. All exterior walls shall be free from holes, breaks, and loose or rotting materials; and maintained weatherproof and properly surface -coated where required to prevent deterioration. General Animal Care. (5) §6-99 Q) Is prevented from running at large on property other than private property owned or lawfully occupied by its Owner by means of a leash, chain or other appropriate physical restraint. (6) §6-99 (m) Does not defecate on the property of another unless the person responsible for the animal immediately thereafter removes or has removed from such property as much of the feces as is reasonably possible. Not only am I tired of cleaning up their dog's feces from my property, I have caught them digging. When attempting to 'shoo' them away, one in particular is combative, growls and barks. Several times when my daughters have attempted to leave the house, this dog has been on our property and has barked, growled and bared it's teeth at them, preventing them from getting to their cars. Although I have not spoken to my neighbor directly, there have been numerous times they have watched me attempt to 'shoo' their dog from my property and have done nothing in an attempt to confine their pets while outside. Under the Carmel Ordinances, can a formal complaint be made and these people cited for failing to confine their animals? With nice weather approaching, I am not looking forward to dealing with this again on a daily basis. In addition, it appears they have attempted to make repairs to the outside of their home that have remained uncompleted since the end of last summer. An unsightly blue tarp was hung on the south side of the house for months.
