AN ORDINANCE AMENDING ORDINANCE D -398 ESTABLISHING A FRINGE
BENEFIT PROGRAM FRO THE CITY OF CARMEL.
WHEREAS, The Common Council of the City of Carmel, Indiana
has established a fringe benefit program for its employees as
Ordinance D -398, as amended; and
WHEREAS, it is in the best interest of said employees that
Ordinance D-398 be further amended; and
WHEREAS, the City employees are desirous of amending the
fringe benefit program;
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
City of Carmel, Indiana that Ordinance D -398 is amended as
follows:
(p) SICK LEAVE CONTRIBUTION Any full time permanent City
employee, or group of said employees, may subject to the
provisions herein, donate any amount of remaining authorized sick
leave time to any other full-time permanent City employee. No
contribution may be made until after a hearing is held before the
'Carmel Board of Public Works and Safety for the purpose of
determining which employees are entitled to donate sick leave
time, the amount of time each petitioning City employee shall be
entitled to donate, the circumstances or purpose for donating the
sick leave time and the eligibility of the City employee to
receive the sick leave time donation. The Clerk Treasurer shall,
at the time of the hearing certify the amount of sick leave time
each donating employee has available for his or her donation.
Further, the Clerk- Treasurer shall certify that the donating
employees and the recipient employee are eligible full time
permanent employees of the City of Carmel. After approval by.the
Carmel Board of Public Works and Safety, the Clerk Treasurer
shall make note in each donating employees employment record of
the sick time donated and the amount of sick leave being donated
to the recipient employee. Once sick leave time is donated by an
employee to another employee, said donated time will be
considered used by the donor.. employee. In no event, shall a
donating City employee be entitled to compensation by the City of
Carmel for donating sick leave time to another employee.
(q) SAVING CLAUSE In the event any Court of competent
jurisdiction shall determine any provision of this Ordinance
null, void, or unenforceable, said determination shall not effect
the. enforceability of the remainder of this ordinance.
