AN ORDINANCE AMENDING ORDINANCE D -398
ESTABLISHING A FRINGE BENEFJT PROGRAM
FOR THE CITY OF CARMEL
WHEREAS, the Common Council of the City of Carmel, Ind.fana
has established a fringe benefit program for its employees as
Ordinance D -398, as amended; and
WHEREA it is in the best interests of said employees that
Ordinance D -398 be further amended;
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
City of Carmel, Indiana, that Ordinance D -398 is amended as
follows:
(r) SICK LEAVE CONTRIBUTION Any full time, permanent City
employee, or group of such employees, may, subject to the
provisions herein, donate any amount of remaining authorized sick
leave time to any other full time, permanent City employee,
subject to the following restrictions:
(1) No contribution maybe accepted by an employee
until after a hearing is held before the Caimel Board of Public
works. and Safety for the purpose of determining which employees
are entitled to donate sick leave time, the amount of time each
petitioning City employee shall be entitled to donate, the
circumstances or purpose for donating the sick leave time, and
the eligibility of the City employee to receive the sick leave
contribution;
(2) The Clerk- Treasurer shall, at the time of the
hearing, certify the amount of sick leave time each donating
employee has available for his or her donation;
(3) The Clerk- Treasurer further shall certify that the
donating employees and the recipient employee is /are eligible
full time, permanent employees of the City of Carmel;
(4) After approval by the Carmel Board of Public Works
and Safety, the Clerk Treasurer shall make note in each donating
employee's employment record of the sick time donated, and the
amount of sick leave being donated to the recipient employee.
(5) Orice sick leave time is donated by an employee to
another employee, said donated time will be considered used by
the donor employee. In no event shall a donating City employee
be entitled to compensation by the City of Carmel for donating
sick leave time to another employee.
BE IT FURTHER ORDAINED by the Common Council of the City of
Carmel, Indiana, that this amendment to Ordinance n 398 shall
expire

TO: Carmel City Council

RE; Proposed ordinance amending D -398, Fringe Benefit Ord.
Attached you will find a proposed ordinance which has been
placed on the Council agenda for Monday, Dec. 18th. This ordinance
would temporarily re- activate Ord. D -603, which you passed on
June 5, 1989. Ordinance D -603 allowed those employees with
certifiable sick days the opportunity to donate unused sick
time to a fellow employee.
We currently have a situation with an employee, Joan McVey,
who has been on a leave of absence since Oct. 9, 1989; following
back surgery. Joan began full time with the City on Feb. 2, 1988.
There have been more than enough days contributed to pay
Joan for one pay period (10 days), beginning Dec. 18 to Dec. 29,
payable on Dec. 29, 1989. Following certification by the Clerk-
Treasurers office for the names listed, I would appreciate your
consideration in this matter.
Joan has been a very dedicated employee. It is unfortunate
that she has had to give so much time for recovery. She is
planning to return to work on Jan. 2, 1990. Joan works for the
Board of Public Works department as custodian.
