To preliminarily address to your comments: In the buffers to the residential areas we changed the shrubs to evergreen trees to provide a taller, denser, and more complete screen. Also, the type -D buffer was added to the Michigan Road frontage in addition to the 30' greenbelt. (If this "doubling up" of screening along Michigan Road is not needed, please advise.) It is our intent to maintain all of the existing perimeter /fence row plant material to the extent possible. We are planning fencing along the residential areas, but not the commercial. Comments 1. L1.O identifying each individual plant at that scale is difficult, but will be as final plans are produced. We identify the required number of types of trees /plants and account for them in the plant list. 2. L1.1 Sorry, that is a copy typo. 3. L1.2 "No -mow" isn't required, is it? Please see below: "The Petitioner shall not now stub the driveway connection to the south, as shown on the approved DP; instead, the Petitioner shall stub the driveway connection to the south, in a location in the area noted on an exhibit filed with the Department of Community Services, at such time as Weston Pointe is required to connect to the north to the subject development." The exhibit referred to in the above quotation is attached to this e-mail. This change takes Weston Pointe out of the condition, defines the area where the drive could go and will forego its construction today. Molitor; Conn, Angelina V Subject: US 421 Overlay Kroger Charlie and Jon: I am responding (finally) to your question regarding the US 421 Overlay Zone ordinance, and specifically the provision 23C.02, Commission Approval. You asked if the overlay zone development standards extend past the overlay boundary of four hundred (400) feet on parcels which straddle the overlay boundary. The ordinance clearly defines the boundary as extending four hundred feet on either side of US 421. The ordinance requires development plan (DP) approval and ADLS approval for an entire site if the real estate is located both inside and outside of the four hundred foot overlay boundary. The ordinance does not specifically mandate that the overlay zone development standards apply to portions of a project located outside of the four hundred feet. Such a uniform requirement of applying 421 development standards outside of the corridor would essentially be a rezone of all real estate along US 421, which was not part of the City's action when establishing the overlay in 1988, or with subsequent updates over the years. It has been the policy of DOCS over the years to utilize the overlay standards when reviewing every project. When possible, we also attempt to leverage their use on real estate outside the overlay boundary in the form of commitments or conditions (and even voluntary compliance) when variances or waivers are requested. It should be anticipated that the DOCS will ask the Plan Commission to consider requiring the overlay standards be uniformly applied to the Kroger project as a condition for approving the amended commitment. The culvert under Michigan Road has plenty of capacity and I have already talked with Lance Lantz of Zionsville and there are no downstream issues. I have also tracked down the drainage report of the pond at the Advent Church and they assumed a larger off -site flow then currently does or will be draining to their pond. If they residents complaining are in Woodhaven, they have drainage problems as it is a old subdivision and does not have the current standards for storm drainage, but we do have regulated drain in Woodhaven and maintain it as complains are filed. Woodhaven also does not drain to the culvert under Michigan Road, as our regulated drain takes it directly to Long Branch on the Hamilton County side. Besides anecdotal observation from Brian and other neighbors, I have no idea what that means. I suggested to Brian S that the HC County surveyor be informed so they can double down on that. Do we have a sign off yet from the INDOT Crawfordsville District or from the surveyor? Most of the group agreed that they did not like the orientation of the building on the site and would like to see it reconfigured. They agreed that if the site had to remain the same that the path that goes down the middle of the parking lot should be better oriented towards bike /ped users and that it should be made of asphalt at a minimum of 8 feet wide. Currently it's 6 feet wide. After further review I noticed that it looks like there is a random bike rack in the middle of the path. I'm not sure what that is all about but it appears to be a mistake. Let me know if you have any questions. Please provide us with any comments and please note: Procedural Matters: When we last met, our primary focus was procedural and the interplay between the attached commitment and the prior commitment. In this regard, please note: 1 As discussed, absent approval by the PC, the existing commitment prohibits permitted B -3 uses not enumerated in the prior commitment. 2 As part of our request for DP /ADLS, we will ask the PC to approve the uses specified in the attached commitment and to condition any approval upon the attached commitment. 3 If the PC approval is so conditioned, then the attached commitment effectively replaces the prior commitment (i) by limiting the uses to those enumerated, (ii) by not including the provision, found in the prior commitment, allowing the PC to approve other B -3 uses other than by amending the commitment after a noticed public hearing and (iii) by providing that the attached commitment can be amended only by rezone or by the PC after a noticed, public hearing. In this way, I think the attached commitment resolves procedural issues. Substantive Matters: Regarding the substantive issues, please note: 1 The additional uses, not enumerated in my last email, were included in order to be transparent and, in part, because we do not know what retail uses may actually occupy the other buildings.
