Docket No. 10040006 ADLS Amend: Woodland Shoppes Nippers Grill Tap Patio The applicant seeks approval for an outdoor patio. The site is located at 1772 E. 116 St. and is zoned B- 8 /Business. Filed by Amy Ward, manager. The applicant seeks approval for a fenced in outdoor concrete patio to be constructed just north of and adjacent to their building, located at the northeast corner of the Woodland Shoppes development, which was built in the late 1970s. Just east of Woodland Shoppes retail center is Governor Square apartments. Arborvitae shrubs will be planted along the east side of the patio to help buffer the views and sounds from the patio dining area. Patio hours will be restricted. While outdoor music will be played, live music is not planned. It is not foreseen that noise will be an issue, but if it is, noise levels would be regulated and enforced by the City Code. Please refer to the petitioner's informational packet for more detail. Outstanding Staff comments /concerns for the Petitioner: 1. The Forestry Dept. has been in contact with the petitioner, but a final landscape plan for the patio perimeter still needs to be submitted. 2. The petitioner should provide the Engineering Department's approval status. 3. While a 3 -4 -ft tall fence is proposed, DOCS suggests erecting a 6 -ft tall fence along the east side of the patio, to help with screening. (However, the proposed arborvitae shrubs will grow tall/thick to create a green wall, so it may be redundant to have both.) 4. Since this is not a public hearing item, the Planning Dept did contact the apartment manager of Governor Square and asked that she let the residents (who live adjacent to Woodland Shoppes) know about this proposal and meeting date. To this date, there have been no inquiries received by DOCS. 5. The petitioner should further discuss the fence location within the sidewalk area, and if it permits accessibility to the building or within the development, from the disabled parking area. Minimum width clearance for wheelchairs is 30 inches for straight on approach, and 60 inches for 180 degree turns, per the Dept of Justice's ADA Standards for Accessible Design. After all questions and concerns are addressed, the Dept of Community Services (DOCS) recommends that the Committee approves this item with the condition of final landscape plan approval by the Forestry Dept.
