Over the years I have had to make MANY late night calls to Nippers asking them to close their rear kitchen door, because of excessively loud music making it impossible to sleep. Being acutely aware of their disdain for the residential community, this patio area would only degrade the quality of life at Governors' Square. Since I have been the manager here for the last 2 years, we have never received any kind of written or oral complaint from the apartment complex management. 2. There is a fence and thick tree line and a drainage ditch (that always has water in it) that is between us and the apartment complex. From the "patio" to the fence line it is approximately 115ft. 3. The hours we have chosen (Sunday Thursday open until 10:00 pm and Friday and Saturday open until Midnight). I think these are appropriate hours for all walks of life. This patio is not meant to be a "party patio" it is just to be able to enjoy the nice weather and have a nice cold drink and listen to a little music. I hope this helps. Residents have reported drunken people who have wandered directly behind their patios and have vomited, urinated and left beer bottles in the bushes. As for the fence, it will either be wood, or vinyl riot sure of color of type of wood. The patio is just a plain concrete grey, nothing exciting. Mulch is going around the fence for landscaping probably the dark color. The outdoor furniture at this point is just going to be wood picnic tables, the umbrellas are being donated by our vendors. It is a good start to submit to us, and we can issue more review comments. Regarding patio noise, there is a noise ordinance in Carmel that could be enforced if the noise levels ever get too high from the patio, and I do not think there is anything in the city code about hours of operation for a patio, but I can check.... Also, I think it would just be a courtesy to the apartment residents if you let them know what is proposed... What about patio pavers or pea gravel? We would probably still want to review the plans and fence design and have you email all of the TAC members to make sure there is no conflict with utility lines drainage, etc. but we could probably review /approve the ADLS Amendment application administratively, in— house. ...We would still need to discuss landscaping, how late the patio is open, noise, lighting, etc., since the Governor Square apartments are just to the east of you.
