JULY 21, 1999
Members present were: Mark Monroe, DOCS; Stanley Puckett, Carmel Fire Dept.; Craig
Parks, Carmel Engineer's Office; Paul Amone, City Utilities; John South, Hamilton
County Soil Water Conservation District; and Steve Cash, Hamilton County
Surveyor's Office.
Altum Gardens (SU)
Petitioner seeks approval (Special Use) to provide an enclosed sales area and office for a
landscape contracting business known as Altum Gardens. The site is located at 11335
North Meridian Road (US 421). The site is zoned B- 3 /Businesss and is located within
the US 421 Overlay Zone.

In attendance: Adam DeHart of Keeler -Webb Assoc. Overview: Petitioner is proposing
to install office, shop area, vehicle and equipment storage in enclosed area. Previous
Special Use and Variance filed in 1996. Proposed will be an amendment to the previous
Special Use. Original design called for additional tree beds, now installed, hoop houses,
and a bulk material storage area and a shop, maintenance storage building for equipment.
Southeast corner of property has been reconfigured. Gravel proposed in area previously
asphalt. All concrete and drive areas are hard surface or asphalt -no gravel. Mounding
will be continued as originally approved, lighting will be minimal for security. Petitioner
will return to TAC in August for further review for August BZA meeting.
Sprint Spectrum Tower (SE/V)
Petitioner seeks approval (Special Exception and Development Standards Variance) to
construct a Wireless Telecommunications Tower in an S -1 residential district and to
permit the accommodation of two wireless telecommunication service provider as
opposed to the four required by the Ordinance. The site is located south of 141" Street
between Towne Road and Ditch Road. The site is zoned S -I /Residence.

In attendance: Matt Masters, Jerry Fisher, and Eric Parker of Sprint PCS; Jim
Buddenbaum, attorney, representing Sprint. Overview: Site will be flagpole design, with
Flag (American inside pole will be antenna of same height and wrap around. Site is
located on a 300 acre parcel in approx. middle of parcel known as Sweet Charity Horse
Facility. No new access drives are to be constructed.
Note from previous BZA meeting -In describing the area, frontage requirements at the
road must be labeled. Two elements must be met: frontage requirement and lot
requirement. If more than one principal use on a residentially zoned lot, it is to be
classified as accessory or principal. Accessory is accessory to use doesn't qualify.
Petitioner may need to describe at least 100 feet of frontage, one lot I acre. If possible,

would be better for Irsay is parcel went to 5 acres than 1 acre -May qualify as a
subdivision.
Comments:
County Soil Water, John South says there are two county drains that cross
property and may carry easements petitioner NOT to locate on easement. Pole to
be 120 feet tall, 24 inches in diameter -pole available for co- location.
Landlord would not allow triangular antenna to be attached.
West Carmel Center (SU- 49- 99N- 50 -99)

The petitioner seeks approval to plat 16 lots on 16.08 acres known as High Grove Section
1. The site is located on the east side of Hoover Road between 116 and 126 Street.

minor in nature. Petitioner has issue with road radius required by County Highway Dept.
Variance needed? If so, would be from County Highway. County Highway Dept. letter
requires stub street to the south -City of Carmel NOT requiring? Terry Jones' response:
When this item came in at the Primary Plat, it was stubbed -it's a matter of whether or not
the County will accept this being stubbed. No variance formally issued. To incorporate a
street at this point would require a re -plat by the petitioner.
Comments:
Highway Dept., per letter has issue with road radius Variance? County
initiated new Ordinance to reduce radii. Stub street to connect to south.
Scheduled for August Subdivision Committee for review. Underdrains at end of
Welch Drive questioned.
Soil Water Conservation, John South says leak in pond last two years-
dropping two feet below outflow pipe. Needs to be a functioning pond -at this
time, does not appear to be leaking -Keep Track.
Carmel/Clay Schools, letter asking for turn radius to be modified to
accommodate an 84 passenger bus.
Clay Township Regional Waste, letter states in process of resolving issues.
Petitioner is responding to Clay Waste, and Samuel Drive.
Carmel Fire, Stan Puckett sent comment letter.
DOCS, Terry says petitioner to work out highway issues. Stub Street is an issue.
Petitioner hopes for August Committee.

Parks at Springmill Section 9 (SP) [scheduled as 2:00 PM Agenda iteml
Petitioner seeks approval (Secondary Plat) to replat 3 lots on 4.301 acres known as the
Parks at Springmill Section 9. The site is located north of 131 Street and southeast of
Meridian Corners Boulevard. The site is zoned S -1 /Residence.

3 lots part of Springmill project. Jackson Lau, Lau Associates doing work on Church.
Previously 1 lot. County surveyor sent letter. Building itself confined within lot line. 20
ft. setback. No easements involved. Terry states only reason for three different lots
rather than incorporating into one to allow phasing of the property; the availability fees
for sewer line to be phased because of availability fees for sewer line. Terry says any
additions that would cross the property lines would require variances or vacation of lot
lines.
Comments:
County Soil Water, John South says 3 separate buildings not very practical for
use. Petitioner would have to get rid of lot lines in future.
Carmel Fire Dept., Stan Puckett, requests knocksbox petitioner agrees.
The Retreat (SU)
Petitioner seeks approval (Special Use) to construct a multifamily residential
development on 70 acres known as the Retreat. The site is located northwest of the
intersection of Westfield Boulevard and East 96 Street. The site is zoned S-
2 /Residence.

Overview: Jim Nelson, attorney. Also in attendance, Harry Todd and Ed Elliott of
Gibraltar Properties; Tracy McCormick and Kerry Buckley of American Consulting
En�ineers, and Steve Fehribach, A &F Engineers. Rezone for 71 acres north and west of
96 and Westfield Boulevard; 360 leased units -First reading at Council last Monday.
After approval by Council, Special Use from BZA required. Plan submitted same as with
rezone application except minor change -high point along north property; buildings
moved south to accommodate rolling terrain.
Comments:
County Soil Water, John South has not yet reviewed detailed plans. Petitioner
will contact John South directly with review notes. Wetlands question raised
regarding Creek running through property petitioner will submit copy of
wetlands delineation to John South. Delineation and mitigation plan. Storm
water being dischargedinto main pond and discharging to outlet pipe over 465.
Some discharge into Creek.
Carmel Fire Dept., Stan Puckett sent comment letter. Request knocksbox on
clubhouse. Requests meeting with petitioner regarding fire hydrant locations.
DOCS, Terry Jones states specific use includes recreational facility. Jim Nelson
will clarify in Special Use application for use inclusive of rec. facility or separate

special use facility. Jim Nelson states that private rec. facility was intended to be
part of overall special use. Will amend Exhibit B to include rec. facility.
Parks Dept. has questions or concern regarding width of paths -would like 10
feet, but can live with 8. Public access? One trail connects Monon with
neighborhood park and is available for public use. Petitioner to talk with Parks
Dept. Will be public park with public parking. Annex? Petitioner made
application for curb cut approval from County. Decision as to whether or not it
will be a neighborhood park under jurisdiction of Park Dept. not yet been made.
Trail head south of I465 will be dedicated to Parks Dept. Petitioner says park and
trail system leading to Monon will be available for public use. The hope is the
rest of it will be viewed as private. Petitioner says no to right -of -way because it
conflicts with special study adopted by Plan Commission and City Council.
Remains in question by County. Petitioner willing to submit letter of non
opposition to annexation. Annexation would require "piggy- backing" of several
annexations.
Inlow Channel and Pond Improvements (SU- 41 -99)
Petitioner seeks approval (Special Use) to construct a retention pond and relocate a
stream channel. The site is located at the southeast corner of the intersection of Ditch
Road and West 116 Street. The site is zoned S -I /Residence.

Overview: Scott Bordenet, USI Consultants. Also present: Richard Smikle, attorney
representing Mrs. Inlow. Petitioner is proposing to relocate and make improvements to
the channel of Clay Creek and provide a small retention pond. Petitioner will also be
installing three wooden foot bridges across Creek.
Comments:
County Soil Water, John South sent comment letter. Petitioner currently
pursuing permits from DNR, IDEM and Army Corps. Petitioner not required to
obtain Rule 5. Petitioner realigning channel. Petitioner increasing slope of
channel, John South recommends continuing slope from pond to beginning so as
no to increase slope dramatically. Scott Bordenet to make changes. Sediment
trap -pond will be maintained by owner. Will be necessary to dredge pond at
some future date -owner to be aware. Alternative would be separate channel and
creek -tie off creek. John South recommends seeding; petitioner will landscape.
John South recommends tall fescue along bank for erosion. Petitioner says
downstream neighbors concerned with pond.

Parkwood Crossing Building 7 (63 -99 DP /ADLS)
Petitioner seeks approval (Development Plan and Architectural Design, Landscape,
Lighting an Signage) to construct an 86.435 square foot office building on 4.36 acres
known as Parkwood Crossing Building 7. The site is located north of East 96 Street and
east of U.S. Highway 31. The site is zoned B -6 /Business.

Davis, Kevin Foster, Bob Dosker of CSO Architects. Overview: Brent Davis. Building
is 3 story, 86,435 square feet, similar to Indiana Insurance -white pre -cast with accents of
gray. East/West facades curtain wall, green glass; north/south elevations more pre -cast,
with punch windows, same style and frame. Looks, color, comparable height similar to
Indiana Insurance Bldg. Entry is from west -entry canopy of kalwall (translucent
skylight material). Main field of parking is west and rear, most visitor parking to the
north with entry from east side of building. Petitioner has tried to save most of existing
trees. Petitioner has provided 269 parking spaces, 288 required; filing for variance to
landbank 42/44 spaces to the east of bldg. Screen on building top for HVAC. Bisecting
wall accommodates signage and screens mechanical equipment. Signage is within
required limits, size of logo oversized petitioner requesting variance. Three entries
proposed -two off primary ring road that loops the site, close to 465; one off road to
Parkwood I building. Dumpster to be completely enclosed and screened with landscape.
Comments:
City Engineering, Craig Parks says Dick Hill sent comment letter -no issues.
Streets and sewers are private.
County Soil Water, John South sent comment letter erosion control plan OK.
Comments addressed.
Carmel Fire Dept., Stan Puckett sent letter; comments addressed re hydrant 1
location. Knocksbox requested.
DOCS, Terry Jones says Development Plan- -last building -last square footage
available? Yes. Height Restrictions? Building below 5 and 6 stories. Trash
enclosure: Same material as building. Maximum size of sign per ordinance is
7X10 feet for entire sign. Sign logo restricted to 25% of sign area. If total square
footage is 70 square feet, allowable area for logo is 25% of that 70 square feet.
Setback variance provides for south side variance; anything more than 5 acre lots
qualifies as a subdivision.
County Surveyor's Office, Steve Cash sent comment letter.
Carmel Bus Maintenance Facility (SU)
Petitioner seeks approval (Special Use) to construct a Facilities and Transportation
building and additional parking known as the Camel Bus Transportation Building and
additional parking known as the Carmel Bus Maintenance Facility. The site is located at
5201 East 131 Street. The site iz zoned S -1 /Residence.

In attendance: Eric Penland, Miranda Simmons, and Anna Marie Burrell of Schenkel-
Shultz; and Ron Farrand of Carmel Clay Schools. Overview: Replacement building for
existing located northwest of existing. Current building to be torn down along with
temporary building. New building is approximately 12,000 square feet. Petitioner is also
proposing I I parking stalls around new facility plus 120 stalls for bus drivers. Petitioner
is connecting existing sanitary sewer -storm water stored on site.

Comments:
City Engineer, Crais Parks sent comment letter. Requests drainage calcs.
Petitioner says curbing will be installed in parking lots -will send updated version.
Concern regarding swale to north side that might affect old farm house to the
north.
County Water Soil Conservation, John South did not receive plans. Less than
5 acres, Rule 5 does not apply. Erosion control measures appropriate.
City Utilities, Paul Arnone says domestic water line sized as 3 inches -needs to
be either increased to 4 inch or reduce to 2 inches service- -valve also. Backflow
device required.
Carmel Fire Dept., Stan Puckett sent comment letter. Building to be
sprinklered request siamese hookup. Request petitioner relocate fire hydrant;
install knocksbox.
DOCS, Terry Jones, Lighting? Petitioner using existing wall packs -lot is lit-
will utilize same lighting. Request lighting plan not to exceed one foot candle.
Signage? no current plans. Handicap parking signage. Any new paved surface
will be curbed. Petitioner will send up -dated plans. Mechanical equipment
ground mounted at rear of building. Mechanical to be screened -no more than 90
decibles at property line. Petitioner may want to re- locate mechanical due to
noise and close proximity of homes -may be a concern. Landscaping is acceptable
screening.
Plum Creek (SP)
Petitioner seeks approval (Secondary Plat) to construct 28 lots on 10.014 acres known as
Plum Creek Section 4. The site is located north of 126th Street and east of Hazel Dell
Parkway. The site is zoned S -1 /Residence.
Filed by J. Cort Crosby of The Schneider Corporation.
Cort Crosby, overview; Chris Werth of Plum Creek also in attendance. Section 4 consists
of 28 lots, entrance to section 2A from 126 Street. No change from primary plat. Two
more small sections to be built totaling 80/90 lots. Frontage Place Ordinance
incorporated into plan.
Comments:
City Engineer, Craig Parks requests sidewalks be installed. Frontage road:
Request 26 feet back -to -back; for safety vehicles, fire, snowplowing, etc.,
requests one entrance at Frontage road. Request entrance at Section A closed off
and two cul -de -sac or hammerheads and full sized entrance to frontage road.
Petitioner says may not have room because of landscaping, etc. -will work with
engineer, Kate, Dept., (Terry Jones or Mike Hollibaugh) etc. to work out.
County Soil Water, John South will send comment letter.
City Utilities, Paul Arnone petitioner running service lines off 126 Street,
Utilities will require addition of curb stops to service lines. Note: Water pressure
is high at this location should be made a commitment and transferred as homes
are built petitioner will consider.

Carmel Fire Dept., Stan Puckett has problem with Frontage Road -is really
narrow, narrow turning radius at frontage road and entrance; hammerheads are
also a nightmare for Fire Dept. because RV's are parked there, cars, etc. Parking
should not be allowed on road because of access.
DOCS, Terry Jones says if frontage road is a problem, it is a matter for legal
dept. to make the changes necessary. Plan Commission and City Council would
recommend change into something more applicable to meet the needs. Suggest
petitioner contact City Attorney regarding no parking ordinance. Development
has no street lights -there are lights at entry way. Petitioner may want to consider
lights at intersections where they intersect with main thoroughfares. Petitioner
may want to meet with City Engineer and /or Street Dept. to determine best
location.
Chapman's Claim at Prairie View (SP)
Petitioner seeks approval (Secondary Plat) to replat 46 lots on 24.647 acres known as
Chapman's Claim at Prairie View. The site is located north of E. 131 Street and west of
River Avenue. The site is zoned S -1 /Residence.
Filed by Keith Lash of the Schneider Corporation.
Overview: Jose Kreutz. Petitioner moving lot line to accommodate side loaded garages.
No change in streets or grades. Open space has increased minimally. Biggest engineering
change is in lot lines. Some laterals changed. No recorded easements being changed.

Comments:
City Engineer, Craig Parks requests petitioner show clearly on plans what is and
is not being done. Request petitioner have no private drives.

Firestone Building Addition
Boyd R. Zoccola of Hokanson Companies, Inc. and Mark VanAllen, The Partenheimer
Group, Inc. in attendance. Overview: Proposed building located north of 116 Street at
the corner of College Avenue and Congressional. Building will be a duplicate of existing
as far as colors, materials, window tints, etc. Project does not need Plan Commission
approval, only TAC review.
Mark VanAllen, The Partenheimer Group, states existing sign being re- located -NOT
illuminated; site lighting not being re- located or added onto. Initial site and drainage
work done in 1988. Proposed building was included in the initial footprint of the
development. Original storm water management system designed to handle proposed
capacity; proposal does not affect gross runoff. Petitioner is putting grass around the

building and will have green space between the building and the parking lot. Parking
spaces being added and parking lot being re- striped. One additional exit at rear being
added. Change in grade from 2 1/2 to 3 feet between finished floor elevation and the
parking field; some ramping on site per ADA. Addition will not affect sanitary sewer.
Current roof has 5 foot parapet to screen roof -top mechanical equipment.
Existing signage on the wall of the building will be re- located to the end of the building,
same side.
