RE: CITY CODE VIOLATION -TRASH AND DEBRIS / JUNK VEHICLES/
HIGH WEEDS AND GRASS
Dear Sir / Madam:
This letter is being provided to Worm you that an inquiry was made to the Department of
Community Services regarding possible City Code Violations at 11565 College Ave., in the City of
Carmel, a property listed under your ownership. An inspection revealed that the concern appears to
be valid and that the property is in violation of the Carmel City Code, §6-77(k), which construes
the following conditions to be public health nuisances:
(k) Any accumulation of junk, rubbish, scrap metal, automotive parts, building materials,
machinery, dead trees, or parts thereof, upon any premises in a residential area.
This would include the shelf, aquariums, wood, and other items of trash/debris located on the
property. Also, vehicles in the driveway were in violation of Carmel City Code § 6-106(b) and § 6-
114, which states:
6-106 (b): A Junk Car shall mean any motor vehicle which does not bear a currently valid
license plate, and is not kept in a garage or building.
6-114: Because of the danger to the health from vermin, the danger of personal injury to
children attracted by such vehicles, danger of fire by the storage of gasoline and oil
thereon, any abandoned, unlicensed, inoperable, disassembled, wrecked or junked
motor vehicle on any street or public property for more than five days or upon any
private property for more than 15 days, except as hereinafter provided, is declared to
be a nuisance and unlawful.
All junk vehicles must be licensed with a current plate, garaged, or removed from the property.
Carmel City Code § 6-88 and Indiana Code § 36-1-3-6 (b)(1) also specifies that all properties must
be maintained to the following standards:

(c) Requirement to cut. All owners of real property ("property") located within the City
shall cut and remove weeds and other rank vegetation growing thereon that exceeds
an average height of six inches, and shall keep their property clear of debris.
Please ensure that the grass/weeds are cut/maintained, all trash and debris removed, and all junk
vehicles plated, garaged, or removed from the property by May 23, 2010.
Failure to resolve the violation(s) by the specified deadline will result in further Enforcement action
by the City of Carmel, to include City abatement (to which property owner is billed), removal of the
vehicle(s), and / or the issuance of daily citations as long as the violations persist (which also
requires a mandatory appearance in Carmel City Court).
