This property is currently zoned residentially (R1), which does not permit for business operations to be run from the property. The only standards that permit for a business to be run from a residential property are the Home Occupation standards of §25.18of the Carmel Zoning Ordinance (see Enclosed). The nature of the home occupation standards is to allow a home business to operate with NO visible evidence or impact upon the property's residential character. Activities such as the display of signage and the storage of materials violates these regulations. Inspections were recently performed of the property and on those occasions, documentation of many stacks of fire wood being improperly stored outdoors was noted. Additionally, there is a fire wood sale advertising sign attached to the fence. All of these are violations of the Ordinance and must be corrected by the removal of the materials and the sign from the property no later than April 10, 2009. I acknowledge receipt of your letter on Saturday, March 14, 2009. I have called you several times (left Voice Mails: Mar 17th 9AK Mar 18'" 9AM and again 3:30 PM), and again Mar 19'" 8:15AM), but with no response from you. I note that your letter has two parts: one part that completely forbids a business in city/residential zoning ... and another part that does allow/defines how to have a business in city/residential zoning. Having lived at 9825 Shelbome Road for decades on the extreme periphery of the county and now apparently on your city, it was a shock to finally hear from either local entity. I was very upset to read about your findings, your demands for immediate compliance and your subsequent implied threats. I couldn't sleep Saturday and Sunday nights from the wont' your letter caused. 2. I wanted to call you yesterday first thing but instead I had to spend 18 hours in surgery and treatment - receiving my last available high dose prostate cancer treatment at Community East Hospital. 3. Immediate Compliance is acceptable. We quit selling firewood when gas prices jumped and a dead market continues with the recession. I have removed the sign you referenced. I am taking in no more wood. What firewood we had left from outside sources we gave away to my church or sold months ago. 4. Your investigator should have spoken with me, the home owner, because but you may find the following information helpful: a. I have not been open much the last 18 months due to my health. The gate was most likely closed when you or yours made your inspections. I have not sold any firewood since before the previous period of high gasoline prices and now including the current financial recession. I had already canceled all wood resource deliveries many months ago when my health failed. We are virtually out of business! b. NOTE. The wood you see now on the north and west side of my property, the recently split and temporary stacks of firewood - including the rounds scheduled to be split and stacked by my son, are from my having contracted a tree service to take down three, very old -large trees on my property that had become dangerous due to years of accumulating storm and lightning damage. Receipt copy for the project is attached c. The downed wood described in (b.) above is all my personal property: the rounds of wood and split firewood I intend to keep it and burn it what with the real possibility of continued recession/depression and the signicant energy cost increases we will surely face under the new federal administration. d Over the next few weeks, my son will split the rounds and restack it all back behind my home on the south and east fence line out of sight for the most part He will also dig a big victory garden on the north side for us now that the trees are down giving us good sunlight access. I fully understand how you can regulate within your zoning responsibilities and I have complied with your demands But, with all due respect, I am unaware of any controlling legal authority that would let you regulate my `personal property" to the extent that you can make me dispose of personal firewood supplies to be used in my fireplace and outdoor grill... nor keep me from occasionally taking in more wood rounds to replenish my pen, oval stacks If I am wrong about that, please either nail me a copy of the controlling legal authority/.statutes or inancdiand r entail tilt' information to: menoch(a sbcplobal. net Questions: 1. I acknowledge receipt of your summons to court for alleged signage violation received this date. 2. I am more than surprised because of our agreement, i.e.: a. By June 1/09: Clean up big rounds on road side yard, remove stacks in driveway ( I gave away some 22 ricks ), and b. By Sept 1/09 have remaining wood raised 18"...we still have time. I agreed to your offer because it hopefully works within my goals. My goal is to go out of business ASAP! Because a.) Contracted Removal of all wood from my property is cost prohibitive, and b.) I can't figure how to lift any remaining wood 18"( raising wood that high is very dangerous), and c.) My public information request resulted in no information returned, therefore, my objective is to finish converting the few rounds I have left and sell the few remaining ricks out over the next six months and be done with it ... signage and all. Our current yeement ends Sept 1/1009. I would now ask for 6 more months ... to April 15 /2010... I will then be out of wood naturally. Problem solved. Please don't take me to court. I am just trying to get rid of the wood as best I can. My recent advanced prostate cancer radiation/cherno treatment bills are pushing $150,000. 1 expect more treatment and bills to come.
