WHEREAS, pursuant to Indiana Code 36 3 11, the City of Carrnel/Clay Township
Plan Commission ("Commission received a petition (the "Petition") to vacate Lot 13 ha R.A.
Franke's Subdivision in Hamilton County, Indiana, as per plat thereof, recorded in Dud Book
128 page 197 in the Office of the recorder of Hamilton County, Indiana (the "Real Estate *um
John T. Kirk and Edith L. Kirk, husband and wife (jointly, the "Kirks");
WHEREAS, the Kirks are the owners of the Real Estate;
WHEREAS, the Petition included the following information as required by IC 36- 7 -3- =1:
1. The reasons and circumstances prompting the request for vacation;
2. A specific description of the property proposed to be vacated; and
3. The name and address of each owner of land.
WHEREAS, after proper notice to all sooners of lots in R.A. Prankc's Subdivision rend
other adjoining property owners and proper publication, the Commission considered the Petition
at its public hearing on June 15,1999, which public hearing was continued to August 17,1995;
WHEREAS, at its regularly scheduled meeting of August 17,1999, the Commission
approved the request for vacation contained in the Petition;
WHEREAS, the Commission has made and adopted written findings setting forth its
reasons for approving the request for vacation contained in the Petition; and
WHEREAS, pursuant to IC 36- 7 -3 -11, the Commission desires that its decision
approving the Vacation of Lot 13 in R.A. Franke's Subdivision from R.A. Franke's Subdivision.
be duly noted and placed of record with the Office of the Recorder of Harniltan County, Indiana.
NOW, THEREFORE, the undersigned, as the official designated in the Subdivision
Control Ordinance, Ordinance No. Z -160, as amended, of the City of Cannel and Clay
Township, Hamilton County, Indiana, hereby acknowt dgcs and decrees that on August 17,
1999, the City of Carmel/Clay Township Plan Commission vacated Lot 13 from the plat of R.A.
Franke's Subdivision, which plat was recorded in Deed Book 128 page 197 in the Office of thit

Re: Providence at Old Meridian: Proposed Ordinance No. Z -338
There was discussion at last Monday's meeting of Carmel Common Council with regard to
permitted uses within the "Primary Area" under the above referenced Ordinance. Specifically, a
question was raised as to whether a "big box" retail user would be permitted within the "Primary
Area The Petitioner's response to that question was that its understanding of the proposed
Ordinance was that a big box retail user would not be permitted in the Primary Area (or, for that
matter, anywhere within the District). This letter shall serve to confirm the Petitioner's
understanding and agreement that no big box retail user shall be permitted within the Primary
District.

ORDINANCE NO.
AN ORDINANCE ESTABLISHING THE PROVIDENCE AT OLD MERIDIAN
PLANNED UNIT DEVELOPMENT DISTRICT
WHEREAS, Section 31.6.4 of the Carmel/Clay Zoning Ordinance Z -289, as amended (the
"Carmel Clay Zoning Ordinance provides for the establishment of a PUD District in accordance
with the requirements of IC 36 -7 -4 -1500 et. seq. PUD statute; and
WHEREAS, the Carmc/Clay Carmel Clay Plan Commission (the "Commission has given
a favorable recommendation to the ordinance set forth herein (the "Ordinance which establishes
the Providence at Old Meridian Planned Unit Development District (the "District
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel,
Indiana, that, pursuant to IC 36 -7 -4 -1500 et seq., it adopts this Ordinance as an amendment to the
Carmel Clay Zoning Ordinance.
Having given reasonable regard to the Comprehensive Plan and the other matters specified
in Section 31.6.4(4) of the Carmel Clay Zoning Ordinance, and specifically to Section 1.1.6, the
intent of the Council in adopting this Ordinance is to insure that the increased flexibility and design
specificity regulations over land development authorized herein is carried out under administrative
standards and procedures.
Section 2. Applicability of Ordinance.
2.1 The Official Zoning Map, a part of the Cannel Clay Zoning Ordinance, is hereby
changed to designate the land described in Exhibit A as a planned unit development district.
2.2 Development in the District shall be governed entirely by the provisions of this
Ordinance, the Carmel Clay Zoning Ordinance and the Sign Ordinance specifically referenced within
this Ordinance and as in effect on the date hereof shall also apply. In the event of a conflict between
this Ordinance and the Carmel Clay Zoning Ordinance or the Sign Ordinance, the provisions of this
Ordinance shall apply.
2.3 This Ordinance, having met the requirements of IC 36 -7 -4 -701 et seq., constitutes the
subdivision control ordinance of the District.
Section 3. Definitions.
Unless otherwise stated, the following words shall, for the purpose of this Ordinance, have
the meaning herein indicated. Any word used in this Ordinance which is not defined herein and
which is defined in Section 3.0 of the Zoning Ordinance, or Section 01 -2 of the Sign Ordinance
shall, for the purpose of this Ordinance, have the meaning defined therein, unless the context
otherwise requires.
Accessory Building. A building subordinate to another structure or use located in the same
development. An Accessory Building may also include a detached garage; maintenance building;
compactor; public utilities; communication, electric distribution and secondary power lines; gas,
water and sewer lines; their supports and poles, guy wires, small transformers, wire or cable and
other incidental equipment and public telephone booths.
Accessory Use. A use subordinate to the main use, located in the same area or in the same
building as the main use, and incidental to the main use, or otherwise utilized for a use described in
the definition of "Accessory Building
Adult Day Care Center. An individual, agency or organization providing supervision or care
on a regular basis for adults in a place other than their usual place of abode.
Apartment. A dwelling intended primarily for rental.
Apartment Block. All or any of the designated Blocks A, B and C as depicted on the Area
Classification Exhibit attached to this Ordinance as Exhibit B, all of which are located in and
together comprise the Secondary Area.
Apartment House. (See Dwelling).
Architectural Review Board. The board established by a Declaration for the purpose of
reviewing the design of all structures proposed to be constructed in that part of the District regulated
by such Declaration.
Attached Dwelling. (See Dwelling. Attached).
Awning Sign. A sign that is pointed, stamped, perforated, stitched or otherwise applied on
the surface of an awning.
Billboard. Off premise advertising for business not conducted on site.
Buffer. An area within a property or site, generally adjacent to and parallel with the property
line, either consisting of existing natural vegetation or created by the use of trees, shrubs, berms,
multi -use path, and/or fences, and designed to limit views and sounds from the Development to
adjacent properties and vice versa.

Build -to Line. An alignment which dictates the maximum front yard setback from a Street
or public right -of -way, to be followed by buildings or structures fronting thereon. The build -to line
does not apply to building projections or recesses.
Build -up Line. An alignment which dictates an average height to the cornice line or to the
roof edge line on a Street or space.
Building Height. The vertical distance from the highest finished grade relative to the Street
frontage to the cornice line or to the roof edge line. The vertical distance from the cornice line or
ro ed e to the parapet or roof ridge (including gables), and the height of towers, steeples, cupolas
and other architectural roof embellishments are not included in calculating building height.
Building Scale. The relationship between the mass of a building and its surroundings,
including the width of Street, Open Space and mass of surrounding buildings.
Caliper. The diameter of a tree trunk measured in inches, 12 inches above ground level for
trees up to 4 inches in diameter and measured 24 inches above ground level for trees over 4 inches
in diameter.
Changeable Copy. Non constant copy that can be manually or electronically changed.
Child Day Care Center. An individual, agency or organization providing supervision or care
on a regular basis for children who are not related by blood or marriage to, and who are not the legal
wards or foster children of, the supervising adult.
Clubhouse. The building at the eastern terminus of Providence Boulevard containing both
business and resident services as well as being a meeting place where the people of the community
may carry on cultural, recreational, or social activities.
Civic Uses. A project. undertaking or use of real estate which has as its primary purpose
either the furtherance of the common good or eneral welfare of the ublic or the su. ort of a
governmental objective, i.e. a polling or voting facility.
Column. A vertical pillar or shaft, usually structural.
Commercial Structure. A building containing one or more spaces utilized for a purpose
permitted by Section 5.1.4.
Common Parking Lot. A Parking Lot maintained by the Owners Association and intended
for use by the occupants of or visitors to a commercial structure or an Apartment house.
Commercial Uses. Those uses described in Section 5.1.4.

Congregate Housing. Dependent or independent living facilities for the elderly or the
disabled. May also include Adult Day Care Center.
Conservation Area. A particular portion of the District restricted from future development.
Context. The character of the buildings, Streetscape, neighborhood, or environment which
surround a given building or site.
Cornice. The top part of an entablature, usually molded and projecting.
Cupola. A small roof tower usually rising from the roof ridge.
Curb Radius. For a mountable curb, the curved edge of the Street at intersections, measured
at the front of the curb. For a chairback -type curb, measured at the back of the curb.
Day Care Center. Day care provided on less than a 24 hour basis for either children or adults,
according to and limited by the definitions for Child Day Care Center and Adult Day Care Center.
Declaration. A Declaration of Covenants and Restrictions for one or more phases of the
Development recorded in the Office of the Recorder of Hamilton County, Indiana, as the same may
be amended from time to time.

We offer the following comments for projects, within our jurisdiction, that are on the June 15` Plan
Commission agenda:
1h. 10801 NORTH MERIDIAN OFFICE BUILDING
In our previously submitted review letter, of primary importance are the following issues. (1) We will
need cooperation in working with the City on right -of -way needed and improvements planned for the
Pennsylvania Street Project, which will be providing access for this proposed site. (2) All curb cuts
and/or median cut(s) will require BPWS approval. The Engineering Department will need justification
for the number of curb cuts requested. No curb cuts will be granted for "future" development without
knowledge of the planned use. (3) In addition to the Hamilton County Surveyor's Office, the City of
Carmel will review /approve drainage for the site and will require copies of and verification of all permits
and approval given by the County.
3h. BUCKINGHAM COMPANIES
There is a small triangular portion at the southwestern comer of this development that has not been
annexed into the City. Annexation is required. We have only offered general comments todate. We
reserve additional comments until such time that detailed construction plans and drainage calculations
are submitted for review. John Duffy should be contacted to address any unresolved utility issues
4h. PLAT VACATION BUCKINGHAM COMPANIES
We have not received information regarding this issue, so it would be inappropriate to comment.
7h. ASHBURY PARK
Engineering has initiated discussions with the developer regarding modifications that would allow for a
southem access off 131 Street. The developer's engineer is currently evaluating this proposal. There
is some concem that if no other access than onto 136 Street or through Spring Farms is provided, it
may create additional "cut through" traffic through an established neighborhood. While it has always
been a planned connection, a separate access to the south would help divert traffic wanting to head
south more directly to 131 Street. This development has not been annexed. We reserve additional
comments until detailed construction plans have been submitted.
OLD BUSINESS
1i. REALTY INVESTMENTS -96 AND U.S. 31
We reserve comments on this development until we have received construction plans for review. This
development is within the Corporate limits of the City of Carmel. 96 Street is City of Carrnel
jurisdiction. Springmill Road is a centerline annexation and therefore is Hamilton County jurisdiction.
2i. HAZEL DELL SUMMIT
1 know of no issues we have regarding the approval of the Primary Plat. Regarding the variance to
eliminate perimeter sidewalks along Cherry Tree, the City Engineer states that the variance should be
conditioned to the vacation of the motorized use of Cherry Tree being approved. Also, along sections
of Cherry Tree that are not to be affected by the vacation, the sidewalk should still be in.
5i. EMERALD CREST AT HAZEL DELL SUMMIT, SECTION 1 (DAVIS HOMES)
Specific instructions regarding any construction along Hazel Dell Parkway, induding entrances to
subdivisions will be provided by the Engineering Department. This will involve the certain phasing of
the construction of the utilities, acceVdecel lanes and multi -use path relocation to limit the length of time
which the path's use will be interrupted. Otherwise, the developer has addressed all Engineering
issues brought forward in our review letters.
6i. DELAWARE COMMONS AT HAZEL DELL SUMMIT (OAK VIEW ASSOCIATES)

Dear Mr. Cremeans:
Please be advised that representatives of Buckingham Companies have
conferred with me as a representative of the Carmel Clay School District
regarding their plans for the mixed -use development identified above. We
issued a letter dated March 30, 1999, stating that the School Corporation is
supportive of the development and believes it will be a complimentary use to the
Old Meridian Corridor. Furthermore, through discussions with Buckingham
Companies, we have determined that a mutual desire exists for the
preservation of the ten (10) acre Odom Woods parcel, which connects our two
parcels, as a woodland area.
Please be advised that Carmel Clay Schools has a long -term interest in
maintaining the ten (10) acre Odom Woods site as a natural wooded area. The
school district and Buckingham Companies are currently pursuing formal
discussions, subject to school board approval, which would formalize and
document the long -term preservation of this acreage as a natural woodlands and
outdoor learning laboratory. We feel that the long -term preservation of this
acreage would benefit the school corporation, the Providence at Old Meridian
Planned Unit Development, and the community at large.

rezoning to a PUD District and vacation:

notices are being properly delivered.
Buckingham Multi -Use Development
Drainage Report
The existing site consists primarily of brush and woods -grass combination. It is downstream to
approximately 23 acres of watershed of which approximately 14 acres is located on the west side
of Old Meridian (Meijer Store) and associated runoff arrives onsite via a box culvert crossing
under Old Meridian. The remaining portion of the watershed's runoff arrives onsite via overland
flow. In both cases runoff is directed toward existing swales running from the northern portions of
the site toward the south central where they converge and exit to the south. A portion of the
eastern side of the site appears to pond water, which eventually overflows into an existing swale
mentioned previously. Additionally, the site lies within "Zone C" as delineated by FEMA FIRM
Panel 7 of 14 for the City of Carmel, Indiana. (Zone C represents areas of minimal flooding.) No
references were located to existing legal drains onsite.
The proposed site has been preliminarily designed such that the release of the 100 -Year Post
Developed Storm Event runoff is less than the 10 -Year Pre Developed Storm Event Runoff.
Stormwater collection pipes have been preliminarily designed for capacity of a 10 -Year Storm
Event utilizing the rational method. The runoff from the Meijer store is directed around the
proposed site and discharged at the same location as in the existing conditions. The remaining
offsite runoff and onsite runoff is collected via a stormwater inlet and pipe system and discharged
into one of two proposed retention ponds. From these ponds the runoff is released at an
allowable rate less than the 10 -Year Pre Developed conditions. No adverse impact is expected
to occur on any receiving stream or downstream property from the proposed site.
Erosion Control Plan
Erosion and sedimentation control measures will be implemented in accordance with standard
practice and per Hamilton County Soil and Water Conservation District guidelines for urban
development. These measures will include inlet protection: sandbag protection for impervious
areas; strawbale protection for grassy or landscaped areas; rip -rap protection for outfall
structures. Geotextile fabric will be utilized in grassy or landscaped areas where severe slopes
may cause erosion. Silt fences will be placed on all slopes falling away from the site. All areas
that are disturbed and left idle for more than seven days will be temporally seeded. Permanent
seeding will be utilized in those areas determined to be complete of construction and designated
for seeding. All erosion and sedimentation measures will be maintained based on Conservation
District guidelines or as needed which ever provides a more conservative maintenance schedule.
