This item will appear on your April 19` agenda. Forwarded with a favorable recommendation: Ordinance Z- 541 -10 (Docket No. 10020015 Z): C Rezone, Arby's/Party Time/Langston Properties Petition to rezone 6 properties from B- 3/Business and I -1 /Industrial district, within the Carmel Dr/Range Line Rd Overlay, to the C -1 /City Center District. The properties are located at the northwest corner of Range Line Rd. and Carmel Dr. Filed by the Department of Community Services, on behalf of the Carmel Plan Commission. Please find enclosed the Plan Commission- certified ordinance to rezone parcels to the C -1 /City Center District. The City of Carmel is petitioning to rezone several parcels located at the NW corner of Carmel Drive and Range Line Road to the C -l /City Center District, as established in Chapter 20E of the Carmel Zoning Ordinance. The subject properties are currently zoned B- 3/Business and I -1 /Industrial within the Carmel Drive/Rae Line Road Overlay Zone. More specifically, the properties' addresses are: 1. 1132 S. Range Line Road (Langston Offices includes 4 parcels of land) 2. 1212 S. Range Line Road (Party Time Rental)' 3. 1224 S. Range Line Road (Arby's) D ry In requesting this rezoning, the City is considering the following: w Land Use. Allows residential and business to co -exist in a mixed use environment. '?he I -1 /Industrial district does not allow residential uses. Approval Process. So that review efforts are not duplicated between the Plan Commission and Carmel Redevelopment Commission, the C -1 /City Center District establishes the Carmel Redevelopment Commission as the lead review and approval body. The Carmel Plan Commission's recommendation on the petition of the applicant is "FAVORABLE." At its regularly scheduled meeting on March 16, 2010, the Carmel Plan Commission voted eight (8) In Favor, zero (0) opposed, zero (0) abstaining, to forward to the Common Council the proposed Ordinance Z- 541-10 with a FAVORABLE recommendation. Please be advised that by virtue of the Plan Commission's Favorable Recommendation, pursuant to IC 36 -7- 4- 608(0(4), the Council has ninety (90) days to act on this petition before it becomes effective as Certified by the Commission. That the Official Zoning Map accompanying and made part of the Zoning Ordinance is 29 hereby changed to designate the real property from the B- 3/Business and I- 1/Industrial District 30 Classifications within the Carmel Drive/Range Line Road Overlay Zone to the C -1 /City Center District. 31 32 Section 2. All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance are 33 hereby repealed. 34 35 Section 3.
