During the review process by the Council's Land Use and Annexation Committee, it came to our
attention that the Department of Community Services did not make proper notice to the owners of real
estate proposed to be rezoned to C -1, City Center district.
Since the time we became aware the mistake, an attempt was made to get permission from the owners
to proceed with the rezone of their real estate, by waiving the requirement for public notice. We have
been able to obtain permission to move forward from all but the owner of the Arby's real estate.
Because of the initial public notice error, and the Department's inability to receive authorization from
the owner of Arby's to proceed, I hereby withdraw ordinance Z- 541 -10 from consideration by the City
Council and ask that this memo be included with the public record for said ordinance.
It is the intent of the Department of Community Services to resubmit this rezone request in the near
future, as allowed per the rules of procedure.

Thanks for the notice. However, once an item has been properly introduced into business you cannot
withdraw it. You have no standing to do so. You can contact the sponsor and ask them to withdraw
and state the reasons for doing so. Without objection will allow the withdrawal. Not to be too much
of a stickler but the rules have to be observed consistently.

Dear Rick,
Please find the attached memo withdrawing Ordinance 1- 541 -10, due to a mistake made with the public notice of
owner's affected, and my inability to gain waivers of notice from all affected property owners.
I apologize for the late timing of this memo and for making the mistake in the first place. I would also like to say thank
you to the Council and particularly the Land Use Committee for their time and assistance by asking the right questions
which brought the notice error to our attention.
A paper copy of this memo will be placed in each Councilor's mailbox prior to this evening's meeting.

The CRC would like to rezone Arby's, Party Time and Langston properties to C -1 for the March 16 PC meeting. We're
obviously past the 25 day notice period, but will easily be within the 10 -day period, so we'll need for the docket to say
"on behalf of the PC"
