Great idea for the permit, Gary. When Tod was filling out the ADLS amend form, it highlighted how much we need
something like that, because there was so little on the form that actually applied. We could consider mobile vending as
ADLS Amends, maybe, which are at public hearings but which don't require notice. Full Commission seems like it might
be a bit much, unless it were one hearing in front of the full PC and then done.

I am not certain that we really need to do anything for the Dog Father. 1 think that he can fly under the radar for now
seeing that we do not have any firm regulation on his operation. I cannot think of anything that is required from
Engineering.
For the ordinance...my thought is that we need to establish a permitting process.
A permit for a mobile vendor would allow us to regulate the use of the City's right -of -way for this business purpose and
should include language indemnifying the City for any accident, injury, death, damage, etc., caused by or resulting from
the operation; require that the operation comply with all applicable federal, state and local laws pertaining to food
service; require state licensure (if required for the operation); insurance requirements for the permittee; hours of
operation; require locating the operation in a manner that does not obstruct the use by the public; require cleaning of
the right -of -way at the end of each day of operation or each time the operation is relocated throughout the day, etc.
Do we want to allow a public hearing to approve the locations? Allow the adjacent property owners to voice their
concern on the location of the operation in the right -of -way?

We may be able to expand this to include outdoor seating /dining areas...

By the way, the Dog Father (Tod) should be coming to you this morning, to talk about permits to encroach. He has a hot
dog cart that he parks in different locations, mainly Old Town, including sometimes on sidewalks. Right now we don't
have any really good unified way to deal with mobile vendors, but we're working on revising the ordinance to allow
them. Any suggestions /preferences from DOE for mobile vendors in general?
