Docket No. 09070002 OA: Patch VII Ordinance Amendment The applicant seeks to Amend Chapter 8: Standards of Required Improvements of the Subdivision Control Ordinance, Chapter 19: B- 8/Business District, Chapter 20G: Old Meridian District, Chapter 23B: U.S. Highway 31 Corridor Overlay Zone; Chapter 23C: U.S. Highway 421 Michigan Road Corridor Overlay Zone, Chapter 23D: Old Town District Overlay Zone, Chapter 23E: Home Place District Overlay Zone, Chapter 23F: Carmel Drive Range Line Road Overlay Zone, Chapter 23H: Monon Greenway Overlay Zone, and Chapter 25: Additional Use Regulations of the Zoning Ordinance in order to consolidate and modify exterior lighting regulations /requirements. Filed by the Department of Community Services, on behalf of the Carmel Plan Commission. With the growing interest in energy efficiency, the Department is recommending that LED (Light Emitting Diode) or similar low- energy lights be used in all exterior applications. The City is anticipating installing LED bulbs in its streetlights, which will result in significant energy and cost savings over time. Additionally, lighting requirements are currently in ten different chapters consolidating all these requirements into one section will make reference easier for City staff and the public. The proposed standards are as strict as existing standards. Please find enclosed an ordinance amendment draft. Filename: 2009 -0709; 09070002 OA; PC Memo Page 1 ONE CIVIC SQUARE CARMEL, INDIANA 46032 317/571 -2417 1 Sponsor: Councilor 9???? 2 3 ORDINANCE Z- 5## -09 4 AN ORDINANCE OF THE COMMON COUNCIL OF THE 5 CITY OF CARMEL, INDIANA 6 7 An Ordinance Amending Exterior Lighting Regulations of the Carmel Zoning and Subdivision Control 8 Ordinances 9 10 WHEREAS, pursuant to the Advisory Planning Law of the State of Indiana (contained in IC 36 -7 -4), 11 each unit of local government that wishes to adopt land use and zoning ordinances must first approve by 12 resolution a comprehensive plan for the geographic area over which it has jurisdiction; and 13 WHEREAS, the Carmel Clay Comprehensive Plan "C3 Plan 2009" Docket No. 08070020 CP was 14 given a favorable recommendation by the Carmel Advisory Plan Commission on November 18, 2008, and duly 15 approved by Resolution No. CC- 05- 04 -09 -02 of the Common Council on May 4, 2009, and is therefore the 16 official Comprehensive Plan of the City of Carmel and Clay Township; and 17 WHEREAS, the City wishes to maintain an orderly, consistent and streamlined Zoning Ordinance; and 18 WHEREAS, pursuant to Indiana Code 36 -7 -4 -602 the Common Council is authorized to amend the text 19 of the zoning ordinance; and 20 WHEREAS, pursuant to Indiana Code 36 -7 -4 -701 the Common Council is authorized to amend the text 21 of the Subdivision Control Ordinance; and 22 WHEREAS, pursuant to Indiana Code 36 -7 -4 -610 and City of Carmel Ordinance No. D- 1600 -02, the 23 Carmel Zoning and Subdivision Control Ordinances are incorporated by reference into the Carmel City Code;. 24 NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, 25 that, pursuant to IC 36 -7 -4 -600 and IC 36 -7 -4 -700 et seq. and after Docket No. 09070002 OA having received a 26 favorable recommendation from the Carmel Advisory Plan Commission on Tuesday, 2009, it hereby 27 adopts this Ordinance to amend the Carmel Zoning Ordinance (Ordinance No. Z -289, as amended) and the 28 Carmel Subdivision Control Ordinance (Ordinance No. Z -160), as amended, to read as follows: 29 Section I: 30 SCO Chapter 8: Standards of Required Improvements 31 a. Amend Section 8.10.03 to read: 32 33 8.10.03 The subdivider shall be responsible for presenting a street lighting plan that may include 34 street lighting with easements or separate residential dusk -to -dawn lights or other plan 35 acceptable to the Plan Commission. All site lighting shall utilize low level LED's (Light 36 Emitting Diodes) or other energy conserving bulbs approved by the Commission. 37 ZO Chapter 19: B- 8/Business District 38 b. Amend Section 19.07Lighting to read: 39 40 19.07 Lighting. 41 All site lighting within the development shall be subject to the provisions of Section 25.09 of this 42 Zoning Ordinance. 43 44 ZO Chapter 20G: OM/Old Meridian District: Ordinance Z- 530 -09 1 7/10/2009 1 c. Amend Section 23H.12 Lighting as follows: 27 28 23H.12Lighting. 29 All site lighting shall be subject to the provisions of Section 25.09 of this Zoning Ordinance. 30 31 ZO Chapter 25: Additional Use Regulations 32 o. Add Section 25.09 Exterior Lighting to read: 33 34 25.09. Exterior Lighting 35 A. A Site Lighting Plan shall be submitted along with any DP or ADLS plan or amendment. 36 B. The Site Lighting Plan shall include the location, type, standards, layout, spread 37 intensity of all site lighting, including: 38 1. parking lot and service /storage area lighting; 39 2. accent and landscape lighting; 40 3. security lighting; 41 4. lighting of pedestrian and bicycle ways and streets; 42 5. sign lighting. Ordinance Z -530 -09 3 7/10/2009 1 C. All Site Lighting shall be coordinated throughout the project and be of uniform design, 2 color and materials. 3 D. All Site Lighting shall utilize low level LED's (Light Emitting Diodes) or other energy 4 conserving bulbs approved by the Commission. 5 E. Pole mounted and wall mounted lighting must be hooded, shielded, and aimed 6 downward. The hood or shield shall mask the direct horizontal surface of the light 7 source. The light shall be aimed to insure that the illumination is only pointing 8 downward onto the ground surface. 9 F. Ground level and accent lighting must be fully recessed, and/or hooded or shielded. 0 G. Exterior lighting shall be architecturally integrated with the building style, material and 1 color. Rooftop lighting shall be prohibited. 2 H. Exterior lighting of the building or site shall be designed so that light is not directed off 3 the site and the light source is shielded from direct offsite viewing. 4 I. Lights within gas station canopies shall utilize either: 5 1. light elements that are fully flush or recessed with the canopy, or 6 2. light elements that reflect light up and do not spill onto adjacent properties. 7 J. The maximum height of light standards shall not exceed the building height proposed, or 8 twenty -five (25) feet, whichever is less. However, when light standards abut or fall 9 within ninety (90) feet of a residential use, their height shall not exceed fifteen (15) feet. o K. The average illumination for site lighting shall be a maximum of three (3) footcandles. 1 L. All Site Lighting shall be designed to not exceed 0.3 footcandle at the property line in 2 business or manufacturing districts, and 0.1 footcandle at the property line of adjoining 3 residential uses. All site lighting shall be fully downcast. 4 M. Street lighting shall be provided as part of projects, on both sides of the street when 5 applicable. Street lights shall be spaced no less than one hundred (100) feet apart, and of 6 a design per the adopted City style. 7 N. Sports field lighting shall be exempt from the requirements of this Ordinance. 8 O. Pedestrian passages to parking lots (walkways) must be lit to a minimum of three (3) 9 footcandles. o P. The City reserves the right to further restrict outdoor lighting, including but not limited to 1 searchlights for special events, quartz lighting, laser lights, pole height, and level of 2 illumination, when it is deemed by the Director to be in the best public interest in keeping 3 with the stated purpose of this ordinance. 4 Q. Lighting installed prior to the effective date of this Ordinance shall comply with the 5 following. 6 1. Amortization. On or before (ten years past approval date of this Ordinance), all 7 outdoor lighting shall comply with this Ordinance. 8 2. New Uses or Structures, or Change of Use. Whenever there is a new use of a 9 property (zoning or variance change) or the use of the property is changed, all 0 outdoor lighting on the site shall brought into compliance with this Ordinance Ordinance Z- 530 -09 4 7/10/2009 1 within one year of the commencement of the new or changed use. 2 3. Additions or Alterations. 3 a Major Additions. If a Substantial Improvement occurs on a property, 4 lighting for the entire property shall comply with the requirements of this 5 Ordinance. 6 b Minor Modifications, Additions, or New Lighting for Non Residential and 7 Multiple Dwellings. For nonresidential and multiple dwellings, all 8 additions, modifications, or replacement of less than 50% of exterior 9 lighting existing as of the effective date of this Ordinance shall require the 10 submission of a complete inventory and site plan detailing all existing and 11 any proposed new exterior lighting. 12 R. Zoning Waiver. The Commission may, after a public hearing, grant a Zoning Waiver of the 13 dimensional and quantitative standards of this Section, by not greater than thirty -five percent 14 (35 Any approval to permit such a waiver shall be subject to the following criteria: 15 1. The proposal shall enhance the overall Development Plan and the adjoining 16 streetscapes and neighborhoods. 17 2. The proposal shall not produce a Site Plan or street/circulation system that would 18 be impractical or detract from the appearance of the Development Plan, and shall 19 not adversely affect emergency vehicle access. 20 3. The proposal shall exhibit extraordinary site design characteristics, including, but 21 not limited to: Increased landscape treatment, tree preservation, provisions for 22 bicycle and pedestrian traffic. 23 In granting a waiver, the Commission may impose such conditions that will, in its judgment, 24 secure the purposes of this Chapter. This Section does not affect the right of the applicant 25 under Indiana law to petition the Board for a variance from development standards provided 26 under IC 36 -7 -4 -918.5 and this Zoning Ordinance. 27 Section II: All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby 28 repealed. 29 Section III: This Ordinance shall be in full force and effect from and after its passage and signing by the 30 Mayor. 31 32 PASSED by the Common Council of the City of Carmel, Indiana this day of 2009, 33 by a vote of ayes and nays. 34 35 COMMON COUNCIL FOR THE CITY OF CARMEL 36 37 38 39 Presiding Officer Joseph C.
