Swearing -In of members postponed until the February meeting. Current members' terms continue in

The minutes of the December 16, 2008 meeting were approved as submitted
Legal Counsel Report, John Molitor— Executive Session of the Executive Committee will
immediately following the conclusion of Plan Commission meeting. All Plan Commission members
welcome to attend.
Department Report, Angie Conn: Key Bank, Docket No. 08110007 OA and 08110008 Z, Kite PUD
Rezone have been tabled to the February 17, 2009 meeting.
Mike Hollibaugh, regarding approval of Carmel Drive/Range Line Road Extension Overlay: Design
Charrette through Ball State scheduled for Wednesday, February 25 —continuing for one week—bringing
in team of designers, engineers and architects —will be a new set of development regulations. Will further

Also, State Environmental Impact Statement has been finalized and submitted to Federal Agencies for

The applicant seeks site plan and design approval for a sports performance /training /physical
therapy center and medical offices and also seek zoning waiver approval:
Docket No. 08070023 ZA ZO S27.01: required parking spaces
The site is located at 13400 N Meridian St. and is zoned B-6/Business within the US 31
Overlay and OM /MM Old Meridian District, Mixed Medical. Filed by Pat Shea for
BremnerDuke Healthcare Real Estate.

Explore tree inventory /preservation plan at committee level
Number of employees should be a factor in computation of parking spaces
Perpendicular parking could be angle parking if /when stub street at south end of property connects to
the Browning property

The applicant seeks primary plat approval for 2 lots on 10 acres. The applicant also seeks the

The site is located at 12650 Clay Center Rd. and is zoned S -I /Residence. Filed by Michael
DeBoy of DeBoy Land Development Services for Christian Browning.

Overview:
Tract consists of 10 acres including the current right -of -way
Previously a single family residence on the eastern portion of the site
Easterly lot is 7.5 acres; and includes road frontage /access along Clay Center Road
Westerly lot is a 2.5 acre tract and would access off the cul -de -sac to the south out of Claridge
Farm
Subdivision Waiver necessary for westerly lot that does not have road frontage
Ingress /egress easement off Chyverton Circle granted by Claridge Farm to Christian Browning on
the westerly lot
Petitioner will re- locate the entrance toward the east corner of the property—the high pointa
little safer

Dry detention area at southwest corner with plantings for stormwater quality in conjunction with
vegetative trenches and other water quality purposes
Petitioner is dedicating right -of -way along Clay Center Road

Petitioner is working with Carmel Engineering to work out drainage issues

Claridge Farm received compensation from petitioner for Grant of Access Easement
Plan Commission expressed No concerns regarding Commission Member Brad Grabow
Request larger renderings for ease of reading

Confirmed —lot owners have all rights and privileges without formal /legal HOA membership
Walking path to be installed along Clay Center Road?

Favorable recommendation received from Special Studies Committee
Public Art Mural Sign deemed public art
Committee suggested and owner /developer agreed to hold public art contest for display and return to
Committee for final approval before art is displayed
Outstanding issue: documentation of storm water runoff
Petitioner agrees that any approval would be subject to final approval of Engineering Dept.
Storm water retention is bio- retention facility constructed as part of overall development by Browning
Landscape approval is part of Committee condition for approval
No EIFS is part of Committee condition for approval

Stucco material used more in southern climate; EIFS typically used in local climate
Insulation value of Stucco maximum of 1; EFIS6 to 20 depending upon application
EIFS more flexible, cracks less, moves better with the building
Stucco is more brittle, tends to crack, has more repair and upkeep in colder climate

Other products available such as cementitious, other man -made products that would look the same—
stone—tends to be expensive petitioner should look for other items

The applicant seeks site plan and design approval for a continuing care retirement community.
The site is located at approximately 13850 River Rd. and is zoned PUD /Planned Unit
Development. Filed by Tim Ochs of Ice Miller, LLP for BHI Retirement Communities, Inc.

BHI specializes in developing Continuing Care Retirement Communities
Existing facility at 96 Zionsville Road
Current Proposal relates to 35 of 500 acres at Legacy PUD
Project is located south of 146 Street a portion touches River Road and the southern-most portion
of The Legacy PUD
Initially filed in September
Reviewed at Subdivision twice
Received favorable recommendation at Committee
Dormers added at relief sections as recommended by Committee
Screening of dumpster area now includes masonry pillars
Dumpster completely screened from view
Breakdown of Units: 225 Independent Living Units; 18 Assisted Living Units; 18 Memory /Alzheimer
Support Units; 36 Skilled Nursing Units; 60 Cottages
Scott Brewer has recommended approval of landscape plan
Committee Report, Carol Schleif:
Parking Discussed at length
Windows in the Garage to be added
Skylights and Sun -tubes to be added in cottages
Greenspace could be utilized for parking at a future date
Garden plan prepared for Memory Garden
Also in attendance: Greg Aqua—Retirement Living Services, Consultant on Legacy Project, Connecticut;
Scott Hall, EGA Architects, Massachusetts —both specialists in these types of development.
Conclusion regarding parking: This project compares favorably with those across the Country as well as
other projects that have come before Carmel recently. The parking at The Legacy far exceeds parking that
occurs at Sunrise and Stratford. The petitioner believes there is more than adequate parking for this facility.
Petitioner has maximized the greenspace to facilitate walking for the residents. The facility has underground
parking as well.
Department Report, Angie Conn:
The Dept and the City are comfortable with Plan Commission approving this project and that is the
recommendation at this time.
Motion: Jay Dorman "to approve the BHI Development, Docket No. 08090018 DP /ADLS, Legacy PUD,
Prairie Landing CCRC," seconded by Carol Schleif, Approved 9 in favor, one recused (Dutcher) none
opposed. Motion Carried.
