The Minutes of the March 17, 2009 meeting were approved as submitted F. Legal Counsel Report, John Molitor: The Executive Committee met in Executive Session at 5:30 PM this evening. Discussion centered on possible litigation to enforce covenants in the Johnson Acres neighborhood regarding the construction of a garage. Motion: Carol Schleif "to authorize Legal Counsel to initiate litigation to enforce covenants and restrictions in the Johnson Acres neighborhood in consultation with the City Attorney," seconded by Woody Rider, approved 7 -0 Motion Carried. IF. Brian Wright, of TPUDC: Carmel SmartCode Charrette update Introduction of Brian Wright by Director Michael Hollibaugh. Brian is with Town Planning Urban Design Collaborative firm hired by the Department to assist the City in development of a downtown master plan and smart code regulatory tool. Brian's presentation to the Plan Commission this evening is an up -date on the results of the Charrette and work done by Brian Wright. S :/P1anCommission/Minutes/PC /2009 /apr21 1 ONE CIVIC SQUARE CARMEL, INDIANA 46032 317/571 -2417 Brian Wright, TPUDC Overview of Charrette Ideas Webpage Address: www.carmelsmartcode.com Charrette Process —open, public meetings Community Break -Out Sessions with citizens Digitized version of comments and key opportunity sites as seen by citizens Analyzed Region by touring area Looked at History of Region Scale Comparisons made Planning Principles used were based on concept that everything has its place and there is no one answer for everything The region was studied from the most rural to the most urban Broken down into six area /character zones 1) Rural, untouched, preserved 2) Agricultural, homesteads, farms, etc. 3) More Residential and Suburban 4) Most Suburban in Character Civic Structures Understanding the Thoroughfare Network Understanding the desires from Citizens regarding Alternative Transportation such as light rail or small scale trolley How to conceptualize and break the City into Neighborhoods Future, approved development Difficult to determine a starting point— priority zones Must be a living document Tried to link together civic sites and structures within the city Results of Charrette being studied in detail by blocks and areas Looked at existing vision and opportunities for infill of various types along Range Line Road to make it more walkable Technology Village being explored Looking at transforming parking into defined areas Exploring meaningful civic space in the Arts District at original crossroads—perhaps named Bethlehem Square—perhaps "Art in the Park" Bank at the corner of Main Range Line could possibly re- locate Commission Comments /Questions: Plans for Parking— Underground? Parking has always been an issue Plan is Conceptual with no solution as yet Proposed "Art Park" area would have to be agreed to by the landowner Type of Treatment along the Monon in light of depicted development? 2F. Public Hearings 1H. Docket No. 09020015 OA: Aramore PUD Amendment The applicant seeks approval to amend Aramore PUD Ordinance Z- 495 -06. The site is located at 9801 Westfield Blvd. and is zoned PUD /Planned Unit Development. Filed by Pittman Partners. Present for Petitioner: Nick Churchill, Reserve Way, Carmel, Pittman Partners Overview: PUD initially approved in 2006 Site consists of 27 acres Approval allows for 131 town homes and 70 court homes Amendment would add single family homes into mix Amendment request dictated by market changes Public Remonstrance: None Public Hearing Closed Department Report, Angie Conn: No Comments or Concerns with Text Amendment Recommend Suspension of Rules and forward to City Council OR Send to May 05 Subdivision Committee for further review Petitioner to explain annexation of adjacent parcels—intent Nick Churchill: Adjacent parcels are not currently under contract If adjacent parcels would like to come under PUD in future, petitioner requests that proposed Amendment Ordinance would apply to adjacent parcels s well Maple Drive would extend to a point on 99 Street and run adjacent to these parcels Maple Drive parcels would hopefully be held to same standards as Aramore and as Amended Amendment would add architectural standards for the single family homes Development would appear as part of the neighborhood John Molitor, Counsel—Comments: Proposal for adjacent parcels would be treated as a Rezone Can be taken out or left in with the proviso that the parcels would be subject to the PUD Ordinance only if they are rezoned to become a part of the PUD District Nick Churchill: Petitioner has not noticed a Rezone No consent from adjacent property owners to rezone Would consent to remove those parcels from the proposal— remove Exhibit J at this time S /P1anCommission/Minutes/PC /2009 /apr21 3 ONE CIVIC SQUARE CARMEL, INDIANA 46032 317/571 -2417 Docket No. 09020015 OA, Aramore PUD Amendment was referred to Subdivision Committee for further review on Tuesday, May 5, 2009 at 6:00 in the Caucus Rooms of City Hall. Note: Public comments may be taken at the Committee level. 2H. Docket No. 09030015 OA: Patch Ordinance VII The applicant seeks to amend Chapter 5: Procedure for Subdivisions; Chapter 6: Standards of Design of the Subdivision Control Ordinance; Chapter 2: Compliance with the Regulations; Chapter 3: Definitions; Chapter 10: R -4 1Residence District; Chapter 20D: M -3 1Manufacturing Park District; Chapter 20F: C -2 101d Town District; Chapter 23B: US Highway 31 Corridor Overlay Zone; Chapter 24: Development Plan and Architectural Design, Exterior Lighting, Landscaping Signage; Chapter 25: Additional Use Regulations; Chapter 25.07: Sign Ordinance; Chapter 26: Additional Height, Yard, Lot Area and Buffering Regulations; Chapter 27: Additional Parking Loading Regulations; and Chapter 28: Nonconforming Uses and Exemptions of the Zoning Ordinance in order to modify the subdivision and development standards. Docket No. 08120012 ADLS: Carmel Executive Suites The applicant seeks design approval for a 3 -story office building. The site is located at 11708 N College Ave and is zoned B -2 /Business. Filed by Scott Yeager of Yeager Properties, Inc. Present for Petitioner: Scott Yeager, Yeager Properties. Request Design Approval for 3 -story office building known as Executive Suites at 1708 North College Avenue. Overview /Changes: Committee concerns were building color Colors seen as too busy —not cohesive by Committee Petitioner eliminated yellow color Special Studies Committee Report, Rick Ripma: Muted colors were agreed upon Limestone (color) will make up water table EIFS will be used (approx 6 Basic design OK except for colors Colors now agreed upon are ivory and cream Committee voted a 3 -1 negative to the Plan Commission Department Report, Angie Conn: Staff liked design of building No outstanding concerns with landscape plan Engineering Dept needs final set construction plans Dept recommends Commission vote on this item this evening Commission Member Comments: Design changes are a big improvement Motion: Woody Rider "to approve Docket No. 08120012 ADLS, Carmel Executive Suites," seconded by Carol Schleif, approved 8 -0 Motion Carried. New Business NOTE: The Department reported that Aramore has requested the Subdivision Committee be granted authority for final approval of the PUD Amendment S:/P1anCommission/Minutes/PC /2009 /apr21 5 ONE CIVIC SQUARE CARMEL, INDIANA 46032 317/571 -2417 John Molitor, legal counsel, again noted that in order for the two separate lots to be included as a part of the Aramore PUD petition, a Rezone would be required. Motion: Woody Rider "to grant Subdivision Committee authority for final approval of Aramore PUD. If a quorum is not achieved at Committee, the Aramore PUD Amendment would automatically return to the full Plan Commission," seconded by Dan Dutcher, approved 8 -0 Motion Carried. K.
