Also Present: Ramona Hancock, Secretary, Carmel Plan Commission The Special Studies Committee considered the following items: 1. Docket No. 09030012 ADLS Amend: Midwest Eye Institute (Springmill Medical Office Building Phase II) The applicant seeks approval for a new directional ground sign. The site is located at 200 W. 103 St. It is zoned B -3 /Business. Filed by Charles Hunt of United Sign and Awning. TABLED to July 7, 2009 2. Docket No. 09050011 ADLS Amend: Carmax Signage The applicant seeks design approval for 5 amended wall signs. The site is located at 9750 N. Gray Rd. and is zoned B -3 /Business. Filed by Shawn Smith of Site Enhancement Services on behalf of Carmax. Present for petitioner: Shawn Smith of Site Enhancement Services, 6001 Nimtz Parkway, South Bend, Indiana. Docket No. 09040017 ADLS Amend: Lowe's Garden Center Expansion The applicant seeks design approval for a garden center expansion. The site is located at 14598 Lowes Way and is zoned PUD /Planned Unit Development. Filed by Peter Velde of Kightlinger Gray, LLP for Lowe's Home Centers, Inc. Present for Petitioner: Peter Velde, Attorney, Kightlinger Gray LLP, 151 North Delaware Street, Indianapolis. Also present: Sean Cloud, Lowe's District Manager; Brenda Tharp, Carmel Store Manager; Todd Biesek; Sherry Lucky, Property Manager, Lowe's Corporate Headquarters. Absent This Evening: Clay Clement, Regional Vice President for Lowe's. Per Mr. Velde, Mr. Clement sends a message of regrets and apology for the feeling the City of Carmel has regarding Lowe's and any misconceptions. Peter Velde: Since May 14, 2009, Lowe's has been in strict compliance with the outdoor display and there have been no additional Ordinance violations. Mr. Velde is submitting a signed agreement to the City Attorney regarding all prior violations as well as a check to the Carmel City Court to pay fine and costs for 9 violations assessed. Overview /Update: Current plan shows landscaping on the east wall of the building Brick inserts match the north and back side of the building Trees added to break up the expanse of the wall Concrete on top and bottom of insert as well as the concrete cap are identical to existing Petitioner believes the Department's concerns have been satisfied Garden Expansion blends with existing facility and is aesthetically pleasing Petitioner requests Committee approval at this time in order to proceed with the project Department Report, Christine Holmes: Dept has worked with petitioner for several months—building elevations are culmination of discussions Revision matches proposal The cap along the wall addition matches the cap on building and will be continuation of existing facade and will screen the dock S: /P1anCommission /Minutes /SpecStudyCmtteeMin /PC SS CmtteeMin 2009 /SS- 2009 -jun 02 2 ONE CIVIC SQUARE CARMEL, INDIANA 46032 317/571 -2417 Petitioner to appear before BZA for parking variance Petitioner is providing more landscaping than originally proposed Stormwater treatment area practices along front of wall will not affect parking anymore than the variance and Engineering has approved; petitioner will add additional green space All outstanding issues with all Departments resolved Recommend Positive consideration Committee approval only required for this project Committee Comments: No Additional Signage? (No) Nothing will be stacked higher than height of wall? (Petitioner affirmed re- stated commitment) Concern is that petitioner has not lived up to past agreement— credibility issue—petitioner has completely ignored past commitments and promises Current proposal looks as if it will fix problems experienced in the past Caution to Lowe's regarding future fines if violations occur Additional Comments, Peter Velde: With all due apologies for past performance, if the 18,000 square foot expansion does not correct space issues, Lowe's will build another store. The Committee has the petitioner's attention; otherwise Lowe's would not be going through the process at this time. The apology truly is what it is Lowe's understands, and on behalf of the client, we are sorry; this is not the way Lowe's wants to operate their business. The petitioner understands the frustration of the City. Motion: Woody Rider "to approve Docket No. 09040017 ADLS Amend, Lowe's Garden Center Expansion, contingent upon BZA approval at the June 22n meeting," seconded by Sue Westermeier, approved 3 -0 Motion Carried. 4. Docket No. 09050021 ADLS Amend: Chateau Design Center (Carmel Office Court) The applicant seeks approval for a modified building facade, landscaping, and signage. The site is located at 300 E Carmel Dr. and is zoned B -8 /Business. Filed by Robert Moore of Chateau Designs, LLC. Present for Petitioner: Bob Moore and wife Bren Moore, owners of Chateau Designs; Stephanie Luckie. Landscape Architect.
