Comes now Village of WestClay, Rezone and Secondary Plats for Sections 9004 and 9007. My
name is Keith Lash with Brenwick Development. Here with me today is; Dave Sexton, Kevin
Krulik and David Warshauer for three petitions. The first is a Rezone to amend the PUD
Ordinance. The applicant also seeks to Rezone 30 acres from S -1 /Residence Estate to PUD
Planned Unit Development. The site is located at 131 Street and Towne Road both sections
built by Pulte. The plan is to develop 9004 this fall and 9007 in early spring.
The Rezone, first petition is a text amendment to the ordinance. Located at the northwest corner
of 131 Street and Towne Road the 30 -acre parcel will be added to the Village of WestClay, PUD
as a peripheral retail area.
Second text modification is west of Towne Road. The text amendments will allow modification
uses to permit senior housing. There are some primary areas from single family to senior housing
with secondary modifications to senior housing. The commercial piece Planned Use has three
different components. Single- family to west, Village lots similar in architecture to slightly
modified architecture, to a later period type, with the price point remaining the same. Second
component is the common area buffer yards on Towne Road, 131 Street to the west and north.
This big green area southeast corner of the 30 -acres developed in a similar manner to the parks in
the Village. The architecture is Art Deco with a Broad Ripple element.
Duncan:
We are finishing our comments. Issue with the improvements to Towne
Road 131 Street and 126 Street. We would like a meeting about those
improvements. We are still developing standards for the PUD.
Hill:
I faxed a letter to Brandon Burke.
Dobosiewicz:
You definitely want to come to some agreement with the Engineer's office
prior to the Plan Commission meeting. The original commitments for the
Village of WestClay and a second set with the modifications and whatever
happens with this one utilizing the same level of committment back in '99.
Maybe make it a joint effort between Brenwick and the City for Towne
Road and 131 Street.
Hill
Horbeck pond, how does that fight in?
Lash:
These modifications have not change the original plans. It still holds today.
Krulik:
It was submitted with Section 50.03.

Groves:
This is Ron Booher's area. Our concerns are we need a minimum fifteen
feet (15') underground easement, footprints are large. Single phase 10 x10.
Shupperd:
We have gas all around, no problem getting you hooked up.
Akers:
Will these come back?
Dobosiewicz:
Yes.

No comments. Do you need names for streets?
Lash:
A handful.

Hoyes:
We have the J.W. Brindle tile that will need reconstruction. 9004 and 07.
with minor comments. I would like to look at reconstruction on Dr. Perez'
property.
Hoyt:
Sent letter to Brandon Burke on 9004 -07. Our office, in conjunction with
the Department of Community Development, is requesting in newly platted
subdivisions, fire hydrant makers be installed in the street pavement
perpendicular to the fire hydrant. This will allow the Fire Department to
more easily spot fire hydrants during an emergency. I did not get plans for
the Rezone, so I need those. Will this take care of Mr. Graham?
Lash:
No.
Brewer:
I usually discuss the Primary Plats with the Park's.
Lash:
We will have David Klaubaugh submit the detail for this.
Dobosiewicz:
G. Hoyt made an interesting comment about the property to the north. We
would like Brenwick to show how the property to the north can be
incorporated into this project. Show the property owner that we will work
with them. Sketch together something that works for that property and you
might be able to offer comments in writing we can discuss them. The west
side of Towne Road that is not platted commercial will come back as
individual platted sections filed under a DP. The city will meet with the
Developer about Town Road and 131S Street to approach the Plan
Commission with a unified vision for what improvements are necessary.
This may include storm water issues. This will not be the last opportunity
to comment they will be back to TAC.
Feltner:
If the amended PUD ordinance or rezoning has any direct effect on
existing sewer lines or future service, plans need to be re- submitted.
Sanitary sewer construction plans need to be submitted for review by the
District's Engineers. A District project application may also need to be re-
submitted.. Please submit two sets of plans to the District for review. An
IDEM construction permit may need to be submitted or revised. If so, all
IDEM submittal information should be provided following the District's
plan review. Village of WestClay, Sec 9007 Plans have been reviewed and
approved by the District's Engineers. Plans are ready to be submitted to
IDEM for state approval. Requested developers to submit IDEM package

Subdivision.

We have gas across the street and will get it to you.

We want to change the Subdivision name to Hayden Run Meadows.
Akers:
Submit it and I will check into it.
Hoyes:
We have had a delay in making comments held off for the watershed study
we will get it finished within 60 days.
Schaeffer:
What is causing it?
Hoyes:
Hayden Run, the open ditch west of Shelborne Road and 116 through
Long Branch.
Schaeffer:
Can we get with Stoeppelwerth and make it work?
Hoyes:
We have done that. We need to verify Hayden Run will be built as
designed.
Schaeffer:
Will you get the as- builts for the storm sewer topography, and pond
details?
Hoyes: Yes. We will have studies in by August 2004 with preliminary and final
complete in 60 days.
Hoyt: Amenity?
Schaeffer: No.
Hoyt: Our office, in conjunction with the Department of Community

Brewer:
A couple of changes. Three species of Ash need to substitute. Twenty -five
trees split between two types. No new plantings of Ash. You also have a
Linden species you need to change because of the Japanese beetles. I can
send you a replacement suggestion. Would like to see the utility easements
shown on the Landscape plan.
Dobosiewicz:
Our request is when you amend the landscape plan you put it on the
Secondary Plans. We need a construction grade set on landscaping and
continue to update your landscape plan. We sent a letter June 16. I would
like to verify that the south location of the street and the intersections align
up appropriately. We will have right -of -way and easement for the path
retire some commitment for that area. Single lot to the west, four -acre tract
like a cross section across that asphalt path. The right -of -way is in place,
there is fencing and evergreens there so approach that property owner with
sensitivity. Call and meet with them.
Schaeffer:
Path and road added as the improvement?
Dobosiewicz:
Yes. Have you been contacted about stubbing regarding sewer and water?
Murry:
It is on the plans and we did create a connection for them.
Dobosiewicz:
Get us a letter about the subdivision name change as soon as it is approved
by Bill Akers.
Akers:
I would like to see it named something else. Not another Hayden Run but
something else.
Schaeffer:
Hayden Run Sections four and five?
Dobosiewicz:
We have complaints on landscaping at The Lakes at Hayden Run. We will
do a review for consistency with the required planting. We will come back
to the developers and make you plant them. You need to update your plans
even if you are not allowed to make certain plantings in the areas originally
planned.
Schaeffer:
We were told not to plant Willows around the pond and so we did not.
Brewer:
That does not negate your obligation. You still need to plant those or
something else in its place. Provide me some documentation that you are
doing that.
Dobosiewicz:
We will be coming after the developer for those plantings, know that we
will want those plantings somewhere with the plans reflecting that.
Schaeffer:
What is the resolution?
Dobosiewicz:
We need a plan that shows landscaping approved by the Surveyor's office.
We will have you add more trees to 131S Street. We will enforce what you
send us so come up with a landscape plan that works for everyone.
Feltner:
Revised sanitary sewer construction plans need to be submitted for review
by the District's Engineers. A District project application must also be
submitted. Please submit two sets of plans to the District for review by

Comes now LongRidge Estates, Primary Plat. The applicant seeks to plat a residential subdivision
of approximately 180 lots on 127.57± acres. The site is located southeast of West Road and 141
Street. The site is zoned S -1 /Residence Estate. The builder will be Pulte. This will be built in
phases as well as the pond. We are looking at going off -site for some Lacrosse fields for the
Carmel Dad's Club, which is not part of this discussion today. We have made surrounding
property owner commitments for a certain curb cut on West Road and tree preservation. We will
also have interior sidewalks with a multi -use trail in and through the subdivision connecting with
the sports park.
Hill:
Is Claybourne Farms to the south?
Dobosiewicz:
Yes.
Hill:
Have you coordinated the pond with Claybourne?
Pittman:
Not yet and we want to coordinate with them on the fields as well.
Hill:
The entrance on Shelborne lines up with the opposing entrances?
Pittman:
Yes.
Hill:
We faxed comments yesterday to D. Olmstead. We will have more
comments later.
Groves:
This is Ron Booher's area. He will need a New Service Request form. He
will also need, Auto -cad. What is the Timeline?
Pittman:
This fall.
Shupperd:
We will bring gas up from Stanford. Will the first section be the one you
start?
Pittman:
Yes, most likely.
Akers:
I need street names twelve to fifteen (12 —15) submitted to me. The two
circular drives to the east, which will have one name. The one with section
two and four where it is cut off at 173 -4 that will get two names.
Gajownik:
What is the correct name of the subdivision?
Pittman:
LongRidge no space but a capital R.
Hoyes:
You said there was some coordination with Claybourne? Currently they are
showing drainage off on you guys. We need to get that figured out. Where
will the big pond drain? William's Creek?

Olmstead:
Yes, the existing outlets under that driveway to the south edge of the
property into the creek.
Hoyes:
Claybourne is showing inlet to the pipe and you say it is the outlet. We still
have issues that need to be addressed. If we can make Claybourne do their
pipe for their pond all they way down to the creek, then when the pond is
dug bigger in the future the outlet will be there. You will need to contact
some downstream property owners.
Pittman:
Who?
Hoyes:
Claybourne will contact everyone on William's Creek and you contact
those from the outlet at West Road and 141S Street. It is not a named
creek but is a natural waterway.
Hoyt:
Our office needs a set of plans showing fire hydrant locations throughout
the project. In conjunction with the Department of Community
Development, we are requesting in newly platted subdivisions, fire hydrant
makers installed in the street pavement perpendicular to the fire hydrant.
This will allow the Fire Department to more easily spot fire hydrants during
an emergency. Also, www.knoxbox.com, to order your Knox -box for the
amenity building.
Brewer:
Talked with John Lapp yesterday and gave him my comments. Buffering of
the Lacrosse fields you are required to buffer the residential side of the
sports field.
Dobosiewicz:
You would buffer those as a Special Use around the ball fields just like
Stanford Park, with significant screening around the parking lot and the
adjacent owners.
Brewer:
You have enough to get started. Your diversity is good statistically but I
do not like the long rows of the same species. Limit your rows to 20 -30
street trees. Need graphic tree protection details on the plans.
Pittman:
Similar to Weston Point?
Brewer:
Yes, applying for the waiver on open space requirements I need that waiver
request. In the tree preservation area you cannot have a swale in it. You
need to move the drainage away from the woods. Get with G. Hoyes and
get an agreement for that drainage easement and then show it.
Dobosiewicz:
I will give you the marked up copy of the Open Space Conservation Map
of where we want to see the pathway connections made. We want to see a
connection agreement made with the property to the south. The Parks
Department would like to partner with you and or the Dad's Club to make
this a public park. We want to see Claybourne's pathway connect up with
LongRidge Estates. Road improvements along West Road and 141S Street,
Paul Rioux had proposed a commitment that ran with Western Hills. We
need a new agreement for improvements and should be similar if not
identical with what the proposed improvements where. D. Olmstead can
you tell me how many additional lots on the waiver?
Pittman:
Fifteen, (15).
Dobosiewicz:
When you provide for the Plan Commission you should provide a separate
proposal for the Dad's Club and the Primary Plat. Show a layout and spell

out the waiver request. Need entry details and monumentation. We have
been relaxed in our review of landscaping and we need updated
construction grade plans submitted each time there is a change or update.
Akers: Lot 51 is an existing residence?
Pittman: We are buying that property so it would not affect them.
Feltner: Sanitary sewer construction plans need to be submitted for review by the
District's Engineers. A District project application must also be submitted.
An off -site sewer extension may be needed to service this development.
Please submit two sets of plans to the District for review by the District's
Engineers. District project application needs to be completed and sent to
the District. An IDEM construction permit will be needed. All IDEM

South: A 10 -12 acre pond exists east of lot 141. Has flood routing and /or a breach
routing been considered in case the dam were to fail? A storm sewer
discharges at the rear of lot 172. What water quality practices are being
considered before this water is released from the site? What design goals
have you considered for storm water quality? It is difficult to manage only
part of a pond. What considerations for joint pond maintenance have you
considered for pond #1? There are several waterways on the western 80
acres that I believe were installed with USDA cost sharing funds. Please
contact John Bush in Boone County to inquire about the possible
contracts. From a past soils investigation, you should expect to find wet
sand and gravel subsoil on this site.

Duncan: The left turn lanes I would like to look at this again to align for future
signaling.
Olmstead: We were encouraged months ago to align the left turn lanes.
Robinson: When do you want to get together?
Duncan: This afternoon? Will you widen the south pavement and the d /cell tapers?
Robinson: Yes.

Groves: This is Ron Booher's area. Ron will need Auto -cad, new site plans and,
New Service Request form called in. Do you know the time frame?
Lintner: Late fall.
Shupperd: We are already at 116 Street so we will come out from there.
Akers: Moore Drive did not get approved so if you can send me an alternant. I will
get this approved.
Hoyes: We have conflicts with the regulated drains and landscaping. One in
particular is at the back of a lot with a twenty -five feet buffer granted in the
primary platting stage. Per the commitments Brian Robinson had to put in a
pipe and now there is conflict with that buffer. We will get you a letter.
Dobosiewicz: I think we can cut a swale within those twenty -five feet. They wanted a
guarantee that there would not be anything constructed in the twenty -five
feet. It does not need to be twenty -five feet landscape easement and
drainage easement. My suggestion for the twenty -five feet is to call it
common area.
Robinson:
We did.
Lintner:
We can pull that drainage easement into the common area?
Dobosiewicz:
Yes, I do not have to see a fifteen feet drainage easement on the backside
of this lot.
Hoyes:
I have landscape issues with the front entry. We have some pipes in there.
Dobosiewicz:
Make sure it is getting on the plans.
Hoyt:
Sent you a letter on the 14 th Need a set of plans for hydrants. Will this
have an amenity building?
Robinson:
No.
Hoyt:
Our office, in conjunction with the Department of Community

Sent B. Robinson a fax. We realize 116 is under Carmel's jurisdiction but
we do have issues with the entrance being offset. Our concern is the
conflicts you create on 116 far out -way any conflicts you will have with
the left turn lane. We would suggest that you align the entrances and that
the left turn lane be built on 116 Street for consistency.
Dobosiewicz:
Gary Duncan are you following what Steve Broermann is saying? The issue
is the wide medians creating a challenge. The Department would like to see
dedicated lefts.
Broermann:
The pavement is there already they just need to shift it.
Dobosiewicz:
They would need to modify the entrance how much?
Broermann:
Several feet to the east.
Lintner:
You want centerline and centerline lined up?
Dobosiewicz:
I am saying currently it does not work and it needs to work and you need
left turn lanes on 116 Street.
Lintner:
We would like to run north along the right -of -way for the sanitary
easement is there a way to get to the sewer?

Broermann: The County Engineer said you have a manhole on the south side and need
to make that work.
Lintner: We need to go under 116
Dobosiewicz: You are saying push it, not cut it?
Broermann: Yes.
Dobosiewicz: You have a storm across there?
Lintner: Yes, waiting to be signed. But that is storm not sanitary.
Dobosiewicz: Can you put it behind the property owner's house?
Lintner: No.
Broermann:
We will get with you on this.
Brewer:
Work with your landscape architect to put your drainage easements on the
construction plans and show him where he cannot design things. Species
conflicts with Ash choose an alternate. I have a list of alternates to use.
Robinson:
I will have D. Klaubaugh contact you.
Dobosiewicz:
We sent a letter July 12. One of our issues is the modification of lot size
that affects the ROSO requirements. Do you have outside easements
acquired from the Blackwells?
Lintner:
We are currently working on that.
Dobosiewicz:
I see that their driveway is to be relocated is that being done by you? I
would prefer that Mr. Blackwell was amenable to the dedication of the
right -of -way and the standard road improvement in front of his home
across his frontage that you assume the frontage cost and that you extend
the road and path across his frontage. Work with the subdivision on the
traffic controlled speed tables through the neighborhood. I suggest you
contact the Neighborhood Association about this.
Hoyt:
The Fire Department hates those.
Dobosiewicz:
Then we need to sit down and go over this. I want to make sure Mr.
Blackwell is taken care of before the Primary Plat is signed. You need to
make sure we have a final landscape plan in the file.
Feltner:
Plans have been received and are currently being reviewed by the District's
Engineers. Revisions may be required after the review. IDEM permit will
be required.

Comes now The Lakes at Towne Road, Primary Plat. The applicant seeks to plat a residential
subdivision of approximately 54 lots on 40.39± acres. The site is located southwest of Towne
Road and 136 Street the site is zoned S -I /Residence Estate. ROSO development connecting
136 Street and Towne Road. That will complete the connection with Towne and Shelborne
Roads. We are planning a series of trails running through it. Storm will run from Lakes at Hayden
Run. We know about the studies on drainage and about the moratorium on the drainage until the
study is done.
Duncan:
Are you widening Towne Road along the property line?
Olmstead:
Yes.
Duncan:
They will need two twelve feet (2/12') lanes with curb, gutter, and stone
shoulder?
Dobosiewicz:
Yes. You need to check into the property owner for dedicated right -of-
way. What about a median right there at your entrance?
Olmstead:
One comment was we are encroaching on Lakeside Park. We are limited
on what we can do as far as keeping the alignment.
Dobosiewicz:
Towne Road wants to look like Hazel Dell Parkway.
Duncan:
We want a left turn lane.
Dobosiewicz:
Will this intersection be designed the same way as Lakeside Park?
Duncan:
Give some consideration to aligning the stub coming south.
Omstead:
We do not care where it ends.
Dobosiewicz:
Send us a letter that states that.
Hill:
How do the commitments add up with (inaudible)?
Groves:

I need eight (8) street names. Will these streets connect with Lakes at
