FINDINGS OF FACT DEVELOPMENT STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and
general welfare of the community because:
The special use allowing the Church was approved on July 22, 2002 and extended until July
22, 2010 and this variance is only to allow the Church an additional 2 years by which to
return to the BZA for approval of the new site and building and to continuously commence
construction.
2. The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because:
The special use allowing the Church was approved on July 22 2002 and extended until July
22, 2010 and this variance is only to allow the Church an additional 2 years by which to
return to the BZA for approval of the new site and building and to continuously commence
construction.
3. The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because:
The State of Indiana is in the process of taking by eminent domain the Church's existing site
and the Church needs additional time to determine the details of its new site plan and
building to be located upon the subject real estate.
DECISION
IT IS THEREFORE the decision of the Carmel /Clay Board of Zoning Appeals that Development Standards
Variance Docket No. 10060010 V is granted, subject to any conditions stated in the minutes of this Board, which are
incorporated herein by reference and made a part hereof.
