ORDER OF THE CARMEL PLAN COMMISSION
DETERMINING THAT AN AMENDED RESOLUTION
AND ECONOMIC DEVELOPMENT PLAN APPROVED
AND ADOPTED BY THE HAMILTON COUNTY
REDEVELOPMENT COMMISSION CONFORM TO THE
COMPREHENSIVE PLAN AND APPROVING THAT RESOLUTION
AND THE ECONOMIC DEVELOPMENT PLAN
(96th Street /421 Economic Development Area)
WHEREAS, the Hamilton County Redevelopment Commission
"Commission on the 25th day of February, 2000, adopted a Declaratory
Resolution declaring that the for the 96th Street /421 Economic
Development Area "Area was an economic development area and
subject to economic development activities pursuant to IC 36 -7 -14 and
IC 36 -7 -25, and all acts supplemental and amendatory thereto "Act
and,
WHEREAS, the Commission, on the 22 day of April, 2010,
preliminarily approved an Amendment to the Economic Development
Plan "Plan for the Area which Area is located within the planning and
zoning jurisdiction of the Carmel Plan Commission "the Plan
Commission and,
WHEREAS, IC 36- 7 -14 -16 requires a Declaratory Resolution which
amends an economic plan to be approved by the Plan Commission.
NOW, THEREFORE, BE IT ORDERED by the Carmel Plan
Commission, as follows:
1. The Amendment to the Plan for the Area conforms to the
Comprehensive Plan approved by the Carmel Plan
Commission for development for Clay Township and the City
and for the real estate within the Area.
2. The Amendment to the Plan is in all respects approved,
ratified and confirmed.
3. The Secretary of the Plan Commission is hereby directed to
file a copy of the Declaratory Resolution approving the
Amendment to the Plan with the permanent minutes of this
meeting.

DECLARATORY RESOLUTION AMENDING THE
REDEVELOPMENT PLAN FOR THE 96T STREET -U.S. 421
ECONOMIC DEVELOPMENT AREA
WHEREAS, the Hamilton County Redevelopment Commission "the
Commission the 25th day of February, 2000, adopted Resolution 2000-
1, "the Declaratory Resolution which Resolution established the 96th
Street/ 421 Economic Development Area, "the Area and approved a
Factual Report and Economic Development Plan for the Area, "the
Plan and,
WHEREAS, the Declaratory Resolution was confirmed by the
Commission on the 5th day of October, 2000, after the approval of the
Plan by the Carmel Plan Commission and the Hamilton County Board of
Commissioners; and,
WHEREAS, the Declaratory Resolution approved the Plan which
contained specific recommendations for construction of local public
improvements to enhance economic development in the Area; and,
WHEREAS, the Declaratory Resolution established an allocation
area in accordance with Indiana Code 36- 7 -14 -39 "Allocation Area for
the purpose of capturing property taxes generated from the incremental
increases in assessed value of real property "Tax Increment located in
the Allocation Area; and,
WHEREAS, the Board of Commissioners approved the creation of
the Area and the Allocation Area; and,
WHEREAS, the City of Carmel and Hamilton County have
recommended an Amendment to the Plan to authorize the Commission to
construction additional local public improvements to include expansion
and improvement of any thoroughfare roads in western Clay Township,
which roads will serve and benefit the Area by providing better access to
and from the Area, which improvements shall include, but not be limited
to, the following:
a. The construction of round -a -bouts at 106th and Shelborne
Road; Shelborne Road and 131st Street; Shelborne Road and
126th Street; Shelborne Road and 121st Street; and 96th
Street and Towne Road.
b. Reconstruction of Towne Road from 146th Street to 131st
Street.
c. Reconstruction of Shelborne Road from 131st Street to 116th
Street.
d. Reconstruction of 126th Street between Shelborne Road and
Towne Road.
e. Reconstruction of 146th Street from Spring Mill Road, west to
the Boone County line.
f. The above costs shall include costs of right of way, design,
construction, and construction inspection.
g. However, nothing herein will permit the widening of any of
the above roads or thoroughfares, south of 116th Street,
other than intersection improvements, prior to January 1,
2012.
WHEREAS, any thoroughfare improvements and the improvements
listed in (a) through (g) above are herein collectively defined as "the
Projects
NOW, THEREFORE, BE IT RESOLVED BY THE HAMILTON
COUNTY REDEVELOPMENT COMMISSION THAT:
1. The Plan as stated in the Declaratory Resolution and the
Plan shall include payment of all or part of the costs of the
Projects.
2. The Commission finds that the above Amendment to the
Plan is reasonable and appropriate when considered in
relation to the original Plan for the Area as described in the
Declaratory Resolution.
3. The above Amendment to the Plan conforms to the
Comprehensive Plan for the City of Carmel.
4. The Amendment to the Plan does not enlarge the boundaries
of the Area.
5. There is public utility and benefit to amend the Plan for
the Area to include the above local public improvements.
6. The estimated costs of the Projects to initially be fully or
partially funded by the Commission are shown on Exhibit A.
7. The Commission shall finance the Projects by either the
issuance of Bonds, Bond Anticipation Notes, or by entering
into leases with the Hamilton County Redevelopment
Authority "the Authority for the issuance of the Authority's
Lease Rental Bonds which obligations shall
be paid by Tax Increment collected from the Allocation Area
and other funds available to the Commission.
8. The Amendments described in Section 1 above conform with
the economic development purposes set forth in Indiana
Code 36 -7 -14.
9. The Secretary is directed to forward a copy of this
Resolution to the Carmel Plan Commission for consideration
pursuant to Indiana Code 36- 7- 14 -16.
10. In all other respects, the Declaratory Resolution and the Plan
are hereby ratified and confirmed.
11. This Resolution is effective upon passage.
