Below is the email from IDEM indicating that a permit is not required if you are staying out of the ordinary high
water mark of the stream channel. The areas that she is referencing as potential fill are areas of rip rap, which
may already exist.

Brian,
Any placement of fill materials below the Ordinary High Water Mark of the unnamed tributary to Cool Creek will
require IDEM and US Army Corps of Engineers authorization (as per Scott Matthews' email below). The drawing
submitted to IDEM and the Corps indicates that activities may occur that trigger IDEM and Corps authorizations.
You know the drill if there's fill below the OHWM, we'll be involved.

What are the original IDEM and USACE permit numbers associated with this project? Is Williams Creek doing the
mitigation monitoring for Kite?

A Section 404 permit will not be required for work performed above the
Ordinary High Water (OHW) Mark. If the scope of work changes to where
The structure is below the OHW, then a Section 404 permit will be required.
Additionally, I noticed several places on the drawing where there are RCP
outlets and RIPRAP. Any placement of Riprap below the OHW will also require a
Section 404 permit.
Please let me know if you need additional clarification.

The attached figure illustrates a proposed crossing over an existing
mitigation stream. The crossing will consist of a three sided structure in
order to remain out of the ordinary high water mark. Can you please
confirm that no Section 401 or 404 permitting is required since no fill is
proposed within the stream channel?
