As a follow up to our telephone conversation of April 24, 2001, enclosed are two copies of
architectural drawing A -5, Exterior Elevations. We have identified the drawings as Exhibit A
and Exhibit B. Exhibit "A" is the elevations as originally submitted showing the more
appropriate cornice proportions, and Exhibit "B" represents the modified (enlarged) cornice
proportions.
As we stated in our April 17, 2001 letter to Jon Dobosiewicz, we originally drew and studied
the building elevations with the larger cornice proportions and with the smaller dimensions as
indicated on our final documents, and after careful evaluation and comparison elected to use
the smaller more proportionally appropriate cornice dimensions. This was not a frivolous
decision and a reduction in cost was not considered.
Regarding the cornice projection and the associated recess of the lower portion of the cornice
assembly, again this was studied and evaluated with the following considerations:
1. The original rendered elevations submitted indicate that the lower cornice band
recessed approximately 18 inches to 24 inches. From a constructability standpoint this
was not practical. The exterior wall thickness was established for structural reasons at
14 inches thick making an 18 -inch to 24 inch reveal (recess) impractical.
2. From a proportional and pragmatic point of view we studied the recess as apart of the
overall cornice "assembly" and determined that due to the height of the walls it is
structurally desirable to maintain as much of the wall thickness as possible. Thus
reasonable precluding the use of a deeper recess. Further, we did consider a somewhat
deeper reveal, however, we believed that a deeper recess would prove to be to much
of an attraction for roosting birds and opted to minimize the "roosting ledge" (recess)
to the 4 and Ih inch depth as indicated on our final documents.
Jon expressed concerns that the changes in the cornice proportions could be viewed as
providing a "Timex when a Rolex was originally presented As you know. This was not our
intention. Our decisions in this case, to adjust the cornice proportions, were dictated by what
in our professional opinion, is the most appropriate, esthetically pleasing and proportionally
correct solution to the design challenges of a building of this scale and size.

Subject: Lowe's Building Design
Jon
Mark relayed to me your message concerning the possible review of the revised building design by the Special Studies
Committee. I have contacted Dave Smith and have asked him to prepare new elevations of what they are proposing. I
have advised him that to the extent that the elevations are not substantially the same as what we presented to the Plan
Commission and Council, you are requesting that the new elevations will have to be submitted to the Special Studies
Committee. If the plans are significantly different, (a Material Alteration) an amended ADLS filing may be in order.
Please realize that Lowe's will be directing this process and not our client, Kite Development. Therefore the timing will be
up to Lowe's.
I really feel that this matter should be handled administratively. It is not a Material Alteration to the plans and in fact really
goes to good construction and design practices. Your expertise and input in resolving this matter is certainly more
appropriate than having a lay person committee try to deal with a minor design element that needs to be modified based
upon final building design. The retail use of the building was the paramount issue in the adoption of the PUD since the
ground was within the U.S. 31 overlay zone. I don't recall any discussion concerning the particulars of the cornice design.
I would respectfully ask that this matter not be overblown.
Upon receipt of the new elevations I will deliver them to you and then we can set up a meeting to resolve this matter or
agree upon the process to do so.
Thanks for your help and cooperation.

My staff and I have completed evaluation of the proposal presented in October 1998
on your behalf by Steve Fehribach of A F Engineering. Results of our assessment
follow, as well as direction with respect to ensuing activities. In principle the concept
you offer looks feasible.
The Indiana Department of Transportation (INDOT) is willing to entertain your plan to
occupy and develop commercially what is now planned as interior interchange land in
the southeast quadrant of US 31 /SR 431 and 146 Street. Your proposal may have
merit, and could yield tangible benefits both to you and the Department.
The main commercial drive (access point) you have identified is acceptable.
Recognize that its suitability is contingent upon redesign of the east side of the
interchange to effect a 3- legged T intersection between the US 31 northbound off -ramp
and the SR 431 northbound connector (ostensibly a ramp) to 146 Street. The freeway
ramp proper would effectively end at the stop controlled T intersection, with limited
access right -of -way extending farther north along the crossroad connector to your main
drive's intersection. The adjustment is necessary to 1) eliminate what would otherwise
be an unacceptable weaving movement downstream of the off ramp's free flowing
junction with the connector, and 2) create sufficient spacing between what will be
another two at -grade intersections to the north along the north -south connector /on-
ramp.
Although in general your plan appears promising, a few elements are troubling. This
agency is charged with protecting rights -of- access to the extent that traffic
operation —now and in the future —is fully protected from potentially destructive
conditions. The minor, southmost drive you request, that set aside for right- turn -in and
-out only to and from the planned northbound on -ramp, presents an unacceptable risk to
Writer's Direct Line
317- 232 -5535
1
Printed on Recycled Paper An Equal Opportunity Employer http:// www. indot .state.in.us /aum/dot.index.html
the integrity of the interchange; therefore, we request that it be removed from your
traffic circulation scheme.
A F Engineering prepared the document titled "Traffic Impact Analysis." It
contains traffic capacity analysis for what would be a signalized intersection on the
interchange's east ramp terminal with 146` Street. The study may be overly optimistic
with respect to northbound vehicles' ability to turn right on red. Our analysis shows
negligible opportunity for such a movement, as insufficient gaps exist in the east -west
traffic stream. Principally for this reason, without expansion of the intersection
approaches, beyond what is suggested by the "Traffic Impact Analysis," the
intersection will fail prematurely.
INDOT has placed in its construction program several jobs devoted to the new
interchange at US 31/SR 431 146 Street. These are active projects, though in early
stages of development. For future reference, those most directly linked to the matter at
hand carry the following identifying description codes:
1) 9680280, protective land acquisition at US 31/SR 431 146t Street, ongoing;
2) 9804350, off -ramp (connector) construction from northbound SR 431 to
146t Street, year 2003 construction;
3) 980435A, bridge construction at northbound SR 431 off -ramp (connector)
over Cool Creek, year 2003 construction;
4) 9804370, on -ramp construction from 146' Street to northbound US 31, year
2003 construction;
5) 9804390, northbound US 31 mainline reconstruction at 146 Street, year
2006 construction;
6) 9804410, southbound SR 431 mainline reconstruction at 146 Street, year
2006 construction;
7) 9804420, off -ramp construction from northbound US 31 to 146 Street (or
to connector from northbound SR 431 to 146t Street), year 2006
construction;
8) 980442A, bridge construction at northbound US 31 off -ramp over SR 431,
year 2006 construction;
9) 9804430, northbound SR 431 mainline reconstruction at 146 Street, year
2008 construction;
10) 9804490, southbound US 31 mainline reconstruction at 146t Street, year
2008 construction.
We should discuss future action. The bid on your part to modify the Department's
current proposal and /or accelerate programmed construction dates must be
accompanied by 1) more extensive preliminary engineering analysis to the extent that
one can verify the feasibility, impacts, and costs of your proposal, 2) conventional
environmental assessment, and 3) survey and design functions. Funding of these tasks
would be your responsibility, with oversight and ultimate approval by this agency. As
well we would ask that you share in other project development costs, including land
acquisition and construction. INDOT and Kite Development would need to enter into a
formal agreement.

A friend of mine at work, Chris Ellington, lives in Carmel and he and his
neighbors have a problem. There is a Lowes that is going to be put in his
backyard on the eastside of 31 146th. They have gone to the council
meetings and desparately are trying to fight it. I told Chris that I know
an urban planner who works in Carmel who probably feels the same way as he
does. Thus, I am writing you to find out if you have any information or
knowledge of this issue. In addition, would you have any advice or tactics
that Chris could use to help keep Lowes out of his backyard. Let me know
what you know when you get the chance.

Subject: Re: Lowes
Scott,
The docket number for the project in question is 105 -99 Z, and it is
referred to as the "Kite Rezone" by virtue of the fact that the property is
owned by Kite Realty, which is requesting a rezone of the 37± acre property
from R1/R4/B2 to a Planned Unit Development (PUD). The public hearing on
the petition was opened at last night's Plan Commission meeting and will
continue at the January 18, 2000, Plan Commission meeting. I suspect that a
lot of the ground we covered last night will have to be re- covered for the
benefit of any new Commission members.
In the interim, the Commission has forwarded this to the January 4, 1999,
Special Study Committee meeting for further review. The public is welcome
to attend committee meetings, but, as they are not Public Hearings, those in
attendance are not permitted to speak (beyond making a brief presentation of
the project, the petitioner isn't even allowed to speak unless asked a
direct question by the committee).
The role of the Plan Commission in this process is advisory they make a
recommendation to the City Council as to whether or not the rezone should be
approved. As rezones are legislative, only the Council can approve or deny
them.
I know that the petitioner has already had a couple of meetings with the
residents of Danbury Estates (where Chris, I assume, lives) to work out some
details. He should attend any future meetings they have, speak at the
public hearings, and write a letter explaining his concerns to the Plan
Commission. The letter should be addressed:
Carmel /Clay Plan Commission
c/o Ramona Hancock
Plan Commission Secretary
One Civic Square
Carmel, IN 46032
and it needs to arrive before January 6th in order to be included in the
Plan Commission packets for the January 18th meeting.
Chris should be aware that, regardless of the Lowe's project specifically,
the road improvements shown on their development plans will proceed they
are part of an INDOT project for SR 431 /US 31, and are exclusive of the Kite
proposal.
If there is anything else I can tell you, just let me know. The file on
this project is a matter of public record, and he's welcome to come to our
office at any time to take a look at it. Our number here is 571 -2417 if he
has any questions.

1. Suggest use of altemate species of shade trees to intermix with red maple within perimeter
plantings.
2. Please provide detail of foundation plantings.
3. U.S. 31 Overlay Zone requires a total of 86 trees within the parking lots, there are currently
only 54. (Trees surrounding the ponds are not acceptable as a part of the parking lot planting.)
4. Suggest altemate species of trees to be used surrounding the ponds. River birch and bald
cypress are recommended altematives.
5. Suggest a larger growing shade tree to be used in parking lot islands such as a white ash,
green ash, and /or 'Celebration' maple.

1. The Wetlands Inventory maps do indicate the potential for wetlands on the site.
When the rezone application is approved, a wetlands assessment will be performed.
If wetlands are encountered, a delineation will be performed to determine the actual
size. If these areas will be disturbed by construction activities, a mitigation plan will
be prepared and submitted to DNR or to the Army Corps of Engineers as
appropriate based on the size of the disturbed area.
2. A geotechnical investigation will be performed. Soil limitations will be overcome
through lime modification, excavation and backfill with suitable material, or by
incorporating geotextile fabrics.
3. The drainage report indicates that the storage capacity of the ponds is adequate for
the development. The ultimate outlet point for the stormwater discharge will be Cool
Creek. The outlet will have some energy dissipation device to minimize the erosion
to the channel.

SOUTHEAST CORNER 146 AND KEYSTONE
Dear Mr. Hill:
We are in receipt of your comment letter dated November 16, 1999 regarding the rezone
application for the property located in the southeast quadrant of the intersection of 146 Street
and Keystone Avenue. In response to your comments:
1. It is proposed to have the roadway south of 146 Street to the main entrance to be
developed to be a local road under Carmel's jurisdiction. The remainder of the
roadways for the project would become part of INDOT's ramp system.
2. The limits of the project would extend to the east right -of -way of Keystone Avenue. If
the rezoning application is approved, the developer will find a commitment or request
to annex the area of the project outside the current corporate limits of the City of
Carmel.
3. The developer will commit at this time to construct the roadway on the east side of
the property to the main entrance with the development. In order to commit to build
the remaining portion of the road infrastructure, there will need to be detailed
agreements worked out involving Hamilton County, INDOT, Carmel, and the
developer: The portion of the road south of 146 Street to the main entrance is
intended to be dedicated.
4. We acknowledge the fact that water and sewer availability as well as curb cut
locations will need to be approved by the Board of Works. Once the rezoning
application is approved, detailed plans will be prepared for review. We also
understand the approval of the project by the Plan Commission is a pre- requisite to
obtaining Board of Works' approval.
5. Thank you for preparing a preliminary calculation of availability and tap fees for water
and sewer. This will be extremely valuable when preparing a pro forma for this
project.

6. The existing traffic signal at the intersection of 146 and Greyhound Pass will be
modified to include signals that face south. At this time, there are no other signals
anticipated for this project. Eventually, a signal will be needed when the US 31
northbound off ramp is constructed.
7. In the future we will provide more of the, adjacent detail or development with our
drawing submissions. The drawings submitted were for rezoning purposes, and
detailed construction drawings with the additional information will be prepared once
the rezoning application is approved.
8. We have not received any comments from the utility department but acknowledge
that they will be providing a separate review of the project.
9. We appreciate your thoughtfulness in providing the requirements for obtaining
building permits. They will be useful once the project proceeds past the zoning
phase.
If you have any questions or need further clarification to any of our responses, please feel free

We have received your comment letter regarding the rezone application for the project to be
located at the southeast quadrant of the intersection of 146 Street and US 31 in Carmel. We
offer the following responses to your comments:
1. When the application for the rezoning of the property was submitted, the work on the
intersection of 146 Street and Greyhound Pass was still ongoing. If the rezoning of
the property is successful, a full topographic survey of the project area will be
prepared, and we will make sure that the traffic lanes for our project match up with
those north of 146 Street.
2. The developer will continue to work with Carmel and Hamilton County regarding the
funding and construction of the ramp system and access roads once the rezoning is
complete.., The developer will strive to develop a win -win scenario for all parties
involved.
3. The developer will prepare the requested commitments for right -of -way once the
extent of all commitments have been discussed; The City of Carmel may ask the
developer to make additional commitments, and we would like to prepare a single
document listing all commitments the developer makes for the project. Many of the
commitments requested by Carmel will not be known until after the public hearing
and special studies committee meeting. We would request delaying the preparation
of this legal document until all the issues are known.
4. We acknowledge the potential for wetlands on this project. If the rezoning application
is approved, a wetlands assessment will be performed. If the assessment identifies
any wetlands, a delineation will be performed. Once the extent of any wetlands are
determined, an analysis will be done to determine the effect on the land plan. If any
wetlands are disturbed, a plan will be filed with the Hamilton County Soil and Water
Conservation office as well as DNR or the Army Corps of Engineers as the situation
dictates:

DEPARTMENT OF ENGINEERING

ONE CIVIC SQUARE CARMEL, INDIANA 46032 317/571-2441
We apologize for not reviewing this project sooner and getting our comments to you in a more timely
fashion. We offer the following comments:
1. All infrastructure improvements are City of Cannel with the exception of the 146` Street right -of -way,
which is, 1 believe, Hamilton County jurisdiction.
2. Is all of this development contained within the area annexed as Danbury Estates? The frontage road on
the East Side of Keystone was exempted from the original annexation and remains outside corporate
limits. If all the property to be served by Carmel Utilities in not within corporate limits, our ordinance
requires a commitment to annex. Please reference the attached annexation exhibit for Danbury Estates.
3. is the street indicated adjacent to the east perimeter of this development to be constructed with the
development? If so, is it to be dedicated?
4. Board of Public Works and Safety approval requirements:
Sanitary Sewer and Water Availability
Commercial Curb Cut
Plan Commission and/or BZA approvals are required prior to Board of Works submissions.
5. Utility Fees There would be two fees involved with this project, namely Water and Sanitary Sewer
Connection and Availability (acreage). This appears to be all retail space totaling 203,000 square feet.
A preliminary fee calculation for this project would be as follows:
203,000 sq. ft. 1.0 EDU /1,000 sq. ft. retail 203.0 EDUs.
Connection Water 203.0 EDUs $1,310.00/EDU $265,930.00
Sanitary Sewer 203.0 EDUs 795.00/EDU $161,385.00
Total Connection 203.0 $2,105.00 $427,315.00
Availability Water 25.0 Acres $1,010.00 /Acre 25,250.00
Sanitary Sewer 2.0 Acres $1,365.00 /Acre 34,125.00
Total Availability 25.0 $2,375.00 59,375.00
Grand Total 8486,690.00
These calculations are examples only. Actual fees would depend upon final construction plan
approvals. We would eventually require a legal description, which indicates the total acreage of
this development. The assumption is made that the acreage for the development in not included in
any of the Danbury Estates, Section 1 acreage for which availability has been paid.
6. Are there traffic signals associated with the project?
7. It would be most helpful if, on future drawing submissions, more of the adjacent detail and/or
development would be indicated.
8. Carmel Utilities will provide a separate review of the project.

9. I am enclosing copies of Engineering Department requirements and a handout from our Department of
Community Services Permit Department regarding requirements for obtaining a building permit.
Please share this information with all personnel involved in this project.
We will have no further comments on the project until detailed construction drawings are submitted and the
City Engineer has had an opportunity to review the project with Hamilton County, INDOT, etc.
