Cheesman, AIA As a follow up to our telephone conversation of April 24, 2001, enclosed are two copies of architectural drawing A -5, Exterior Elevations. We have identified the drawings as Exhibit A and Exhibit B. Exhibit "A" is the elevations as originally submitted showing the more appropriate cornice proportions, and Exhibit "B" represents the modified (enlarged) cornice proportions. As we stated in our April 17, 2001 letter to Jon Dobosiewicz, we originally drew and studied the building elevations with the larger cornice proportions and with the smaller dimensions as indicated on our final documents, and after careful evaluation and comparison elected to use the smaller more proportionally appropriate cornice dimensions. This was not a frivolous decision and a reduction in cost was not considered. Regarding the cornice projection and the associated recess of the lower portion of the cornice assembly, again this was studied and evaluated with the following considerations: 1. The original rendered elevations submitted indicate that the lower cornice band recessed approximately 18 inches to 24 inches. From a constructability standpoint this was not practical. The exterior wall thickness was established for structural reasons at 14 inches thick making an 18 -inch to 24 inch reveal (recess) impractical. 2. From a proportional and pragmatic point of view we studied the recess as apart of the overall cornice "assembly" and determined that due to the height of the walls it is structurally desirable to maintain as much of the wall thickness as possible. Thus reasonable precluding the use of a deeper recess. Further, we did consider a somewhat deeper reveal, however, we believed that a deeper recess would prove to be to much of an attraction for roosting birds and opted to minimize the "roosting ledge" (recess) to the 4 and Ih inch depth as indicated on our final documents. Jon expressed concerns that the changes in the cornice proportions could be viewed as providing a "Timex when a Rolex was originally presented As you know. This was not our intention. Our decisions in this case, to adjust the cornice proportions, were dictated by what in our professional opinion, is the most appropriate, esthetically pleasing and proportionally correct solution to the design challenges of a building of this scale and size. I have contacted Dave Smith and have asked him to prepare new elevations of what they are proposing. I have advised him that to the extent that the elevations are not substantially the same as what we presented to the Plan Commission and Council, you are requesting that the new elevations will have to be submitted to the Special Studies Committee. If the plans are significantly different, (a Material Alteration) an amended ADLS filing may be in order. Please realize that Lowe's will be directing this process and not our client, Kite Development. Therefore the timing will be up to Lowe's. I really feel that this matter should be handled administratively. It is not a Material Alteration to the plans and in fact really goes to good construction and design practices. Your expertise and input in resolving this matter is certainly more appropriate than having a lay person committee try to deal with a minor design element that needs to be modified based upon final building design. The retail use of the building was the paramount issue in the adoption of the PUD since the ground was within the U.S. 31 overlay zone. I don't recall any discussion concerning the particulars of the cornice design. I would respectfully ask that this matter not be overblown. Upon receipt of the new elevations I will deliver them to you and then we can set up a meeting to resolve this matter or agree upon the process to do so. Thanks for your help and cooperation. Results of our assessment follow, as well as direction with respect to ensuing activities. In principle the concept you offer looks feasible. The Indiana Department of Transportation (INDOT) is willing to entertain your plan to occupy and develop commercially what is now planned as interior interchange land in the southeast quadrant of US 31 /SR 431 and 146 Street. Your proposal may have merit, and could yield tangible benefits both to you and the Department. The main commercial drive (access point) you have identified is acceptable. Recognize that its suitability is contingent upon redesign of the east side of the interchange to effect a 3- legged T intersection between the US 31 northbound off -ramp and the SR 431 northbound connector (ostensibly a ramp) to 146 Street. The freeway ramp proper would effectively end at the stop controlled T intersection, with limited access right -of -way extending farther north along the crossroad connector to your main drive's intersection. The adjustment is necessary to 1) eliminate what would otherwise be an unacceptable weaving movement downstream of the off ramp's free flowing junction with the connector, and 2) create sufficient spacing between what will be another two at -grade intersections to the north along the north -south connector /on- ramp. Although in general your plan appears promising, a few elements are troubling. This agency is charged with protecting rights -of- access to the extent that traffic operation —now and in the future —is fully protected from potentially destructive conditions. The minor, southmost drive you request, that set aside for right- turn -in and -out only to and from the planned northbound on -ramp, presents an unacceptable risk to Writer's Direct Line 317- 232 -5535 1 Printed on Recycled Paper An Equal Opportunity Employer http:// www. indot .state.in.us /aum/dot.index.html the integrity of the interchange; therefore, we request that it be removed from your traffic circulation scheme. A F Engineering prepared the document titled "Traffic Impact Analysis." It contains traffic capacity analysis for what would be a signalized intersection on the interchange's east ramp terminal with 146` Street. The study may be overly optimistic with respect to northbound vehicles' ability to turn right on red. Our analysis shows negligible opportunity for such a movement, as insufficient gaps exist in the east -west traffic stream. Principally for this reason, without expansion of the intersection approaches, beyond what is suggested by the "Traffic Impact Analysis," the intersection will fail prematurely. INDOT has placed in its construction program several jobs devoted to the new interchange at US 31/SR 431 146 Street. These are active projects, though in early stages of development. I told Chris that I know an urban planner who works in Carmel who probably feels the same way as he does. Thus, I am writing you to find out if you have any information or knowledge of this issue. The public hearing on the petition was opened at last night's Plan Commission meeting and will continue at the January 18, 2000, Plan Commission meeting. I suspect that a lot of the ground we covered last night will have to be re- covered for the benefit of any new Commission members. In the interim, the Commission has forwarded this to the January 4, 1999, Special Study Committee meeting for further review. The public is welcome to attend committee meetings, but, as they are not Public Hearings, those in attendance are not permitted to speak (beyond making a brief presentation of the project, the petitioner isn't even allowed to speak unless asked a direct question by the committee). The role of the Plan Commission in this process is advisory they make a recommendation to the City Council as to whether or not the rezone should be approved. As rezones are legislative, only the Council can approve or deny them. I know that the petitioner has already had a couple of meetings with the residents of Danbury Estates (where Chris, I assume, lives) to work out some details. He should attend any future meetings they have, speak at the public hearings, and write a letter explaining his concerns to the Plan Commission. A geotechnical investigation will be performed. Soil limitations will be overcome through lime modification, excavation and backfill with suitable material, or by incorporating geotextile fabrics. 3. In response to your comments: 1. It is proposed to have the roadway south of 146 Street to the main entrance to be developed to be a local road under Carmel's jurisdiction. The remainder of the roadways for the project would become part of INDOT's ramp system. 2. The limits of the project would extend to the east right -of -way of Keystone Avenue. If the rezoning application is approved, the developer will find a commitment or request to annex the area of the project outside the current corporate limits of the City of Carmel. 3. The developer will commit at this time to construct the roadway on the east side of the property to the main entrance with the development. In order to commit to build the remaining portion of the road infrastructure, there will need to be detailed agreements worked out involving Hamilton County, INDOT, Carmel, and the developer: The portion of the road south of 146 Street to the main entrance is intended to be dedicated. 4. We acknowledge the fact that water and sewer availability as well as curb cut locations will need to be approved by the Board of Works. Once the rezoning application is approved, detailed plans will be prepared for review. We also understand the approval of the project by the Plan Commission is a pre- requisite to obtaining Board of Works' approval. 5. Thank you for preparing a preliminary calculation of availability and tap fees for water and sewer. This will be extremely valuable when preparing a pro forma for this project. The developer will continue to work with Carmel and Hamilton County regarding the funding and construction of the ramp system and access roads once the rezoning is complete.., The developer will strive to develop a win -win scenario for all parties involved. 3. The developer will prepare the requested commitments for right -of -way once the extent of all commitments have been discussed; The City of Carmel may ask the developer to make additional commitments, and we would like to prepare a single document listing all commitments the developer makes for the project. Many of the commitments requested by Carmel will not be known until after the public hearing and special studies committee meeting. We would request delaying the preparation of this legal document until all the issues are known. 4. We acknowledge the potential for wetlands on this project. If the rezoning application is approved, a wetlands assessment will be performed. If the assessment identifies any wetlands, a delineation will be performed. Once the extent of any wetlands are determined, an analysis will be done to determine the effect on the land plan.
