Docket No. 07070023 OA: Qualifying Subdivision Exemptions Amendment The applicant seeks to Amend the Zoning Ordinance, Chapter 5: S -1 /Residence District, Chapter 6: S -2 /Residence District, Chapter 7: R -1 /Residence District, Chapter 8: R- 2 /Residence District, Chapter 9.• R -3 /Residence District and Chapter 10: R -4 /Residence District, in order to delete exemptions from the lot area and lot standards in qualifying subdivisions. Filed by the Carmel Department of Community Services. Last month the Carmel City Council passed a resolution directing the Carmel Plan Commission to prepare and evaluate a proposal to amend the Zoning Ordinance. Their request is that the Plan Commission considers eliminating the provisions which exempt lots in Qualifying Subdivisions (ROSO) from the minimum lot area and setback standards. This specifically applies to S -1 through R -4 Residence Districts. Pursuant to the Resolution, the Department has prepared an ordinance amendment for review and Public Hearing. CC- 06-18- 07.03 i l s N 's F THE CO t l T 1 Ty OF CARM E AMENDING CERTioN PROVISIONS OF THE ZONING ORDXN' C WHEREAS, Chapter 10 of the Carmel City Code (the "Zoning Ordinance regulates Zoning and Subdivisions for the City of Cannel (the City); and WHEREAS, Article 2 of the Zoning Ordinance (the "Subdivision Control Ordinance) specifics the requirements for subdivisions "Qualifying Subdivisions"); and WHEREAS, Chapter 7 of the Subdivision Control Ordinance establishes certain requirements for the inclusion of open space within Qualifying Subdivisions ("Open Space Standards and WHEREAS, the Zoning Ordinance contains exemptions (the "Exemptions from the Open Space Standards for lots within Qualifying Subdivisions as set forth in the Subdivision Control Ordinance; and WHERE AS, Indiana Code 36- 7- 4.6O2(b) authorizes the Common Council of the City of Carmel (the "Conunan Council") to initiate the process of amending the Zoning Ordinance; and WHEREAS. the Common Council has determined that certain of the Exemptions to specific regulations are no longer in the bast interest of the City and of the public health, safety. and welfare. NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Carmel. Indiana, recommends to the Carmel Advisory Plan Commission (the "Plan Commission as follows: Section 1: Tiie foregoing Recitals are incorporated herein by this reference. Section 2: The following portions of the Zoning Ordinance shotiid be deleted in their entirety Chapter 5: S•1 Residence 5.04.04; Chapter 6: S -2 Residence 6.04.04; Chapter 7: R -1 Residence- 7.04.04; Chapter 8: R -2 Residence- 8.04.04; Chapter 9: R -3 Residence 9.04.04; and Chapter 10: R-4 Residence 10.04.04. In other words, an average of 1.18 acres per dwelling. Current Requirements for Qualifying Subdivisions (see also SCO* 7.00.01) In return for Open Space and to allow for design flexibility and lot clustering, lots were exempted from minimum area, yard, width and coverage standards. However, the minimum distance between dwellings is 6 feet.
