What I think we are dealing with was a parcel that had two deed descriptions as if it was intended originally to be sold as two lots. However, it was recorded as one parcel with two descriptions when it was built, so the county just recognizes it as one parcel and for their taxing purposes really doesn't care what the description says. The transfer and mapping staff said that since we are not working with a previously platted lot we can just bring them a parent parcel drawing with a new deed description that describes what we are splitting off from the parent deed and they will accept that to create a new parcel number. Are you ok with us going forward with this direction? I believe this action would be supported by the "subdivision" definition in the ordinance. On a side note, we are still trying to determine what to do about the storm sewer line. We have gotten some bids to move the line and the numbers are a little scary for two lots. So, we are considering keeping the existing house and doing a remodel which would involve tearing down the existing garage and breezeway and building new garage behind the house. If we go in this direction we would then just build a single new house on the north lot. Keeping the existing house would result in us recording the new deed description in a way that allows for a minimum of 5' side yard setback for the existing house while still keeping the north lot above the minimum of 50' in width. And if they are indeed 2 parcels of land, then you can probably re- describe the property lines (amend the metes and bounds legal description) to have the middle parcel line shifted over a bit. And that is all through the assessor's or auditors' office, and the recorder's office. What about the regulated drain? The construction entrance will be included on the construction plans. 21. The installation of any permanent, privately owned and/or maintained improvement (signs, decorative street signs, walls, streetlights, etc.) within dedicated right of way or dedicated easements requires the execution of a Consent to Encroach Agreement between the Owner and the City of Carmel Such agreements are executed by the Board of Public Works and Safety. The City Engineer may approve irrigation ,system agreements. 22. Secondary Plat approval 'if applicable. All performance guarantees must be posted prior to submission of secondary plats for Board of Public Works and Safety approval. 23. Dedication of right -of -way it not platted. This is based upon the City of Cannel 20 -Year Thoroughfare Plan requirements. Dedication documents are available upon request. Please be advised that all Right -of -Way Dedications must be accompanied by a Sales Disclosure Agreement completed by the owner for the property being dedicated to the City. The dedication document cannot be recorded without a completed Sales Disclosure. The form is available upon request. 24. Any open pavement cuts of I Avenue NW, other than those required for a curb cut, will require Board approval. BONDING REQUIREMENTS 25. Please contact Mr. Dave Barnes to review performance guarantee requirements. Please contact Mr. John Duffy to review water and sanitary sewer bonding requirements. 26. The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for 100% of the cost.of labor and materials to construct the individual improvements, to be provided by the design engineer. Please provide detailed Engineer's Estimates for each improvement including quantities, unit costs, pipe sizes, and materials, etc. 27. Upon completion and release of individual Performance Guarantees, a three -year Maintenance Guarantee will be required (see Street Sign comments above). The Maintenance Guarantee amount is based upon 15% of the Performance amount for Streets and Curbs and .10% of the Performance amount for all other improvements. 28. Performance Guarantees may be Performance or Subdivision Bonds or Irrevocable Letters of Credit. 24. Please reference the available enclosures for more detailed explanation of our procedures. RIGHT OF WAY PERMIT AND BONDING 30. Any work in the dedicated right -of -way will require an approved Right -of -Way Permit and a License Permit Bond. 31. The bond amount is determined by our Right -of -Way Manager. However, if the work is included in the scope of work of a required and posted Performance Guarantee, the Performance Guarantee may be used to satisfy the bond requirements of the Right of-Way Permit. 32. Please contact our Right -of -Way Manager, Fred Glaser, to arrange right -of -way permitting and bonding. AVAILABILITY AND CONNECTION FEES 33. We defer to Cannel Utilities regarding this issue. 34. If an entryway or overall site irrigation system is planned for this development, additional Water Connection Fees will be assessed based upon the size and usage of the system and upon the recommendations of the Director of Carmel Utilities. 35. These fees are required to be paid prior to final approval of construction plans by Engineering and prior to issuance of building permits by Building Codes Services. The proposed project falls in the incorporated area and MS4 jurisdiction of the City of Cannel. 2. The proposed project DOES fall in a Cannel Wellhead Protection Zone. 3. The proposed project falls in the Morrow Follett Regulated Drain Watershed. 4. The proposed project has the Morrow Follett Regulated Drain running right through the proposed preliminary plat. The Morrow Follett Drain, R.J. Follett Arm was constructed in 1928 and is a 42" concrete pipe that lies about 2 feet off of the north- west corner of the existing house. 5. The Regulated Drain Easement for the Mon Follett R.J. Follett Arm is 75 feet each side of the center line of the tile, per I.C. 36- 9- 27- 33(a). I.C. 36- 9- 27 -33(d) prohibits permanent structures within the easement without written consent from the drainage board. While the existing house, built about 1940, is consider grandfathered as an encroachment, any new structure(s) within the easement will require approval of the Hamilton County Drainage Board prior to construction. 6. A copy of the proposed plat is attached along with the application and an area map. There is an existing home on the lot that will be torn down and the lot subsequently split into two equal sized lots that will fully comply with the zoning ordinance without the need of waivers or variances. All utility connection points appear to be at either the front or rear of the lot so we anticipate directly connecting to the existing infrastructure at the time a new home is built on each lot.
