Applicant: This letter is in response to your secondary plat application for the Carlson Corner Secondary Plat. The following issues must be resolved: The following must be indicated on the plat: 1. Docket Number 05010041 SP. 2. Please add the source of title of ownership. 3. Please provide a copy of restrictions or covenants (if applicable). 4. Please add monumentation for lot corners. 5. The half right of way for Towne Road is 70 feet. Please revise accordingly. 6. The half right of way for 141 Street is 40 feet. Please revise accordingly. 7. The plat shows a 20 foot "W.E.” Please identify "W.E." in the legend. 8. There appears to be an extra line through Lot #1. Please remove or identify. 9. The line weight of the area inside the right of way should be lighter than that of the subdivision bounds. Please revise. 10. This property is within the City of Carmel corporate bounds. Please replace the Hamilton County Commissioners signature block with a corrected City of Carmel Board of Public Works signature block. 11. The south and east boundaries of this subdivision are required to have a type `B" buffer. Please provide and indicate. Concerns and Comments are as follow: 1. As per the Alternative Transportation Plan, a 10 foot multi use path is required along Town Road and 141 Street. You are required to commit to this improvement at a future date when it becomes a desired link in the pedestrian system. 2. Please indicate how these parcels will access Town Road and/or 141 Street. Badger Engineering 117 West Elm Street Lebanon, IN 46052 RE: Carlson Corner Secondary Plat Project Review #1 Dear Mr. Badger: We have received the secondary plat submitted for review at the February 16, 2005 Technical Advisory Committee meeting. We offer the following comments: GENERAL INFORMATION 1. The project site is located within current City of Carmel Corporate Limits. The following jurisdictions will apply. 2. Jurisdictions: Streets and Right of Way City of Carmel (Towne Road West 141 Street) Water City of Carmel Sanitary Sewer Believe to be Clay Township Regional Waste District Storm Sewer Hamilton County Surveyor's Office,/ City of Carmel Regulated/Legal Drains Hamilton County Surveyor's Office 3. Board of Public Works and Safety Approval Requirements: Water Availability (if applicable) Commercial/Residential Curb Cut. 8%2 x 11 exhibits that indicate the curb cut(s) being requested should accompany any curb cut request. The exhibits should include the proposed curb cut, any existing and opposing curb cut, throat width, radii, overall width at the street, etc. Secondary Plat Approval. As a condition of Board approval, all required Performance Guarantees must be posted with the Department of Engineering prior to submission of the plat to the Board for approval. Consent to Encroach Agreements for any permanent improvement to be installed with dedicated right of way and/or dedicated easements. I am enclosing a schedule for Board of Public Works and Safety meeting dates and agenda deadlines for your use. Please use the Engineering Department deadlines for submissions to the Board through this office. Any submission to the Board requires prior final approval by the Carmel Plan Commission and/or the Board of Zoning Appeals and completion of review by the Technical Advisory Committee. All written requests to be placed on the Board's agenda must include the appropriate Docket Numbers and the date (or dates) of approval by the Plan Commission and/or BZA. 4. Water Availability (acreage) and Connection Fees: We have no idea if any of the proposed lots have been connected to water. It is our understanding that stubs have been provided by Carmel Utilities. Assuming they have not, the following fees would be applicable; based upon the current City of Carmel Fee schedule. TAC Review We request that all comments and comment letters generated by this office be answered in writing. 6. Carmel Utilities does not subscribe to "Holey Moley" and should be contacted directly for all water main and sanitary sewer main locations. 7. Carmel Utilities will provide a separate review of this project for water and sanitary sewer issues. 8. I am including copies of the following with this correspondence: Performance Release Procedures. Permit Data, Contacts, etc. BONDING REQUIREMENTS 9. Upon initial review, it appears the following bonding requirement will apply to this project: Performance Guarantee Asphalt Paths (in dedicated right of way of Towne Road/141 Street) Please provide a detailed (materials, quantities, sizes, unit costs, etc.) Certified Engineer's Estimate for 100% of the cost of labor and materials to construct 10 -foot wide asphalt paths in the dedicated right of way of Towne Road and 141 Street. Post a Performance Guarantee in the amount of the Engineer's Estimate. Three -year Maintenance Guarantees, in the amount of 10% of the Performance Amount, will be required upon release of the Performance Guarantee by the Board of Public Works and Safety. Right of Way Permit and Bonding Any work in the dedicated right of way of Towne Road or 141 Street, other than the construction of the asphalt paths, will require a Right of Way Permit and appropriate bonding. The bond is a License Permit type bond. The bond amount will be determined by the number of instances of work in the right of way (curb cut, water- sanitary -storm work, etc.) $2,000.00 per instance. Open pavement cuts in dedicated streets require Board of Public Works and Safety approval. Contact Fred Glaser of our office for details. Fred is our Right of Way Manger/Inspector. COMMENTS 10. This project was originally submitted for TAC review on December 17, 2003. At the time, this office did not provide comments because we did not receive plans to review. It is our understanding that 10 -foot asphalt paths are required as a condition of approval. In addition, the platted area would be allowed two curb cuts, one on 141 Street and 1 on Towne Road to serve the proposed lots. The Board of Public Works and Safety approved the 141 Street curb cut for lot #lon March 3, 2004. Will this curb cut also serve lot #2? 11. Are there existing residences on lots #2, #3 or #4? 12. Since this is within the City of Carmel jurisdiction, please change the approval/signahue block from the Board of Hamilton County Commissioners to The City of Carmel Board of Public Works and Safety as follows: James Brainard, Presiding Officer Mary Ann Burke, Member Lori Watson, Member Diane Cordray, Clerk- Treasurer 13. Lot #1 appears to consist of two parcels. Why is the lot divided? 14. What does the 20' W.E. designation represent? 15. Towne Road is classified a primary parkway according to the 20 -Year Thoroughfare Plan and therefore the required right -of -way width is 140 feet (70 -foot half). Please increase the half right- of -way width for Towne Road that is shown on the proposed plat as 60 feet to 70 feet. 16. Will the I. E.E. between lots 3 and 4 will serve multiple lots or be the subdivision entrance? The Department of Engineering requests this to be located at least 500 feet from the Towne Road/141 Street intersection unless it will be considered a common driveway for lots 3 and 4. 17. The Department requests that the right -of -way corner cut at Towne Road and 141 Street be located to accommodate a 120 -foot radius roundabout centered on the apparent centerline intersection of Towne Road and 141 Street. 18. What is the unlabelled lot at the southeast comer? 19. Is the right -of -way indicated existing or proposed? Please label to clarify. The above comments are based upon the Engineering Department's initial review of this secondary plat. Please provide our office with a follow -up letter regarding this review. Second and subsequent reviews will focus only on review items. It is critical that our office be made aware of all modifications made on resubmitted plats, particularly if any such changes are considered "new" or fall outside of our initial review. The Hamilton County Surveyor's Office still has outstanding comments on this project from the letter dated October 12, 2004. This comment letter must be addressed before we will give any approval on this project. 2. Comment #11 in the above mentioned letter states that the location of the Stultz and Almond Regulated Drain is incorrectly shown in the construction plans. If the correct location was shown, I believe we will need a 10' R.D.E. dedicated along the ROW of 141` Street to meet the statutory regulated drain easements as called out in 1.C. 36-9- 27 -33. This will push the 15' L.E. back behind this easement and will require revisions to the presented plat. This must be done before we will present any reduction of the regulated drain easement to the Hamilton County Drainage Board. Should you have any questions, I can be reached at 317- 776 -8495.
