Petitioner seeks approval of the following Developmental Standards Variances:
V -89 -02 §25.9: Drainage accessory bldg encroaching 7.3 feet into
drainage easement
V -90 -02 §25. 1. 1 (B) (3) (b) (i) (b) 2.7 -foot accessory building setback
The site is located at 10401 Ethel Drive. The site is zoned R -I /Residence and R-
3 /Residence within the Home Place District Overlay Zone.
In deciding whether or not the applicant has presented sufficient proof to permit
the granting of a variance of development standards, the Board shall determine in
writing that:
1. The approval will not be injurious to the public health, safety, morals
and general welfare of the community;
The existing structure will not be injurious to the public health, safety,
morals and general welfare of the community because the drainage for this
site will be provided by two drainage swales located in Drainage
Easements on the north side of each lot rather than in the south Drainage
Easement.
2. The use and value of the area adjacent to the property included in the
variance will not be affected in a substantially adverse manner; and

Because these two petitions are inextricablv linked. the Department recommends
that the Board suspend the Rules of Procedure in order to vote on these two petitions
simultaneously
The structure is question is of solid masonry construction, so moving it would be
nearly impossible
