RE: CITY CODE VIOLATION - C:ONDITION OF FENCE
Dear Mr. Russo:
This letter is being provided to inform you that an inquiry was made to the Department of
Community Services regarding a possible City Code Violation at 538 Emerson Rd., in the
City of Carmel, a property listed under your ownership. An inspection revealed that the
concern appears to be valid and that the property is in violation of the Carmel City Code §
6-222 (B):
(6) Accessory structures. All accessory structures, including detached garages, fences
and walls, shall be maintained structurally sound and repaired as to not be
dangerous, unsafe, unsanitary or otherwise unfit for human use; or shall not be an
invitation to children and endanger the lives of such children, or which because of
its condition has become a fire hazard and shall not be installed or located such
that they cause, create or result in or represent the potential to cause, create or
result in a Detriment.
As per the Carmel/Clay Zoning Ordinance, Chapter 3, fences are defined as a structure. The
fence sections in the back of your property appear to be supported solely by the surrounding
vegetation. Please either remove the fence sections or repair them so that they are structurally
sound and able to freely stand.
Please bring this matter into compliance by May 5, 2010. Failure to resolve the violation by
the specified deadline will result in further enforcement action by the City of Carmel to
include the issuance of daily citations for as long as the violation(s) persist (and which also
requires a mandatory appearance in Carmel City Court).
