1 Section 18. Signs.

3 All signs located within the District shall comply with the following sign regulations:
4
5 18.1. Exempt signs: All signs designated as exempt in Section 25.7.01 -3 of the Sign
6 Ordinance.
7
8 18.2. Prohibited signs:
9
10 A. Signs on roofs, dormers, and balconies.
11 B. Billboards.
12 C. Signs painted or mounted upon the exterior side or rear walls of any principal or
13 accessory building or structure, except as otherwise permitted hereunder.
14 D. Signs prohibited by Section 25.7.01 -4 of the Sign Ordinance, except as otherwise
15 permitted hereunder.

17 18.3. Permitted business signs:
18
19 A. Wall- mounted or painted signs, provided the following standards are met:
20 (1) The sign shall be affixed to the front facade of the building, and shall
21 project outward from the wall to which it is attached no more than six
22 inches in the Villa. e Center and 12 inches in the Peripheral Retail Area.
23 (2) The area of the signboard shall not exceed to 20 percent of the ground
24 floor building facade area or 45 square feet, whichever is less.
25 (3) The maximum permitted height is 15 feet above the front sidewalk
26 elevation, and shall not extend above the base of the second floor window
27 sill, parapet, eave, or building facade.
28 (4) The height of the lettering, numbers, or graphics shall not exceed t10
29 inches in the Villa. e Center and 12 inches in the Peri heral Retail Area.
30 (5) Limited to one sign per business establishment on each building facade
31 fronting a street. In the Peripheral Retail Area, a facade facing 131 Street
32 or Towne Road shall be deemed to be fronting such streets
33 notwithstanding that the front facades face an interior street.

35 B. One wall mounted sign, not exceeding six square feet in area, shall be permitted
36 on any side or rear entrance open to the public. Such wall signs may only be
37 lighted during the operating hours of the business.

39 C. Wall- mounted building directory signs identifying the occupants of a commercial
40 building, including upper story business uses, provided the following standards
41 are met:
42 (1) The sign is located next to the entrance.
43 (2) The sign shall project outward from the wall to which it is attached no
44 more than six inches.
45 (3) The sign shall not extend above the parapet, eave, or building facade.
46 (4) The area of the signboard shall not exceed 15 square feet.
1 (5) The height of the lettering, numbers, or graphics shall not exceed five
2 inches.

4 A. D. Applied letters may substitute for wall- mounted signs, if constructed of
5 painted wood, painted cast metal, bronze, brass, or black anodized aluminum.
6 Applied plastic letters shall not be permitted. The height of applied letters shall
7 not exceed e10 inches in the Village Center and 12 inches in the Peripheral
8 Retail Area.

10 E. Projecting signs, including icon signs, mounted perpendicular to the building
11 wall, provided the following standards are met:
12
13 (1) The signboard shall not exceed an area of ten square feet unless a corner
14 sign which shall not exceed an area of twelve square feet.
15 (2) The distance from the ground to the lower edge of the signboard shall be
16 eight feet or greater.
17 (3) The height of the top edge of the signboard shall not exceed (i) the height
18 of the wall from which the sign projects, if attached to a single story
19 building, (ii) the height of the sill or bottom of any second story window,
20 if attached to a multi -story building and not a corner sign or (iii) 50
21 percent of the distance between the building cornice or roof line and the
22 sill or bottom of any second story window if a corner sign located on a
23 multi -story building.
24 (4) The distance from the building wall to the signboard shall not exceed six
25 inches.
26 (5) The width of the signboard shall not exceed four feet.
27 Oj (6) The height of the lettering, numbers, or graphics shall not exceed
28 ten inches in the Village Center and 12 inches in the Peripheral
29 Retail Area.
30 (7) (7) Limited to one sign for each ground floor business establishment.
31 Projecting signs are not permitted in conjunction with free standing or tree
32 lawn signs.

34 F. Tree lawn signs, including icon signs, installed on a pole in a tree lawn, provided
35 the following standards are met:
36 (1) The sign is located in a tree lawn opposite the entrance to the building.
37 (2) The signboard shall not exceed an area of six square feet.
38 (3) The distance from the ground to the lower edge of the signboard shall be
39 six feet or greater.
40 (4) The height of the top edge of the signboard shall not exceed the height of
41 the wall of the building in front of which the sign is located, if located
42 opposite a single story building, or the height of the sill or bottom of any
43 second story window, if located opposite a multi -story building.
44 (5) The width of the signboard shall not exceed two feet.
45 (6) The height of the lettering, numbers, or graphics shall not exceed eight
46 inches.
1 (7) Limited to one sign for each ground floor business establishment. Tree
2 lawn signs are not permitted in conjunction with free standing or
3 projecting signs.

5 G. Painted window or door signs, provided that the following standards are met:
6 (1) The sign shall not exceed 30 percent of the window or door area except in
7 the Peripheral Retail Area where the sign shall not exceed 40 percent of
8 the window or door area.
9 (2) The sign shall be silk screened or hand painted.
10 (3) The height of the lettering, numbers, or graphics shall not exceed five
11 inches in the Village Center and eight inches in the Peripheral Retail Area.
12 (4) Limited to two window signs and one door sign for each business
13 establishment.
14 (5) Painted window or door signs may be in addition to only two of the
15 following: a wall mounted sign, a free standing sign, an applied letter
16 sign, a projecting sign, or a tree lawn sign or a valance awning sign. A
17 painted window sign at the second or third floor level of a Commercial
18 Structure may only be combined with a tree lawn sign.

20 H. Awning signs, for ground floor uses only, provided that the following standards
21 are met:
22 (1) If acting as the main business sign, it shall not exceed fifteen square feet in
23 area, and the height of the lettering, numbers, or graphics shall not exceed
24 ten10 inches in the Village Center and 12 inches in the Peripheral Retail
25 Area.
26 (2) If acting as an auxiliary business sign, it shall be located on the valance
27 only, shall not exceed five square feet in area, and the height of the
28 lettering, numbers, or graphics shall not exceed five inches in the Village
29 Center and eight inches in the Peripheral Retail Area.
30 (3) Limited to two such signs for each ground floor business establishment, on
31 either awning or valance, but not on both.
32 (4) If acting as the main business sign, it shall not be in addition to a wall
33 mounted sign, an applied letter sign or a projecting sign which is not a
34 corner sign.

36 I. Free standing sign, provided that the following standards are met:
37 (1) The building, where the business to which the sign refers is located, shall
38 be set back a minimum of five feet from the frontage line.
39 (2) The area of the signboard shall not exceed 45 square feet.
40 (3) The height of the lettering, numbers, or graphics shall not exceed tenl0
41 inches in the Village Center and 12 inches in the Peripheral Retail Area.
42 (4) The height of the top of the signboard, or of any posts, brackets, or other
43 supporting elements shall not exceed six feet from the ground.
44 (5) TeIf located in the Village Center, the signboard shall be constructed of
45 wood, with wood or cast iron brackets, and,
1 (6) The signboard shall be architecturally compatible with the style,
2 composition, materials, colors, and details of the building.
3 (6) Intentionally omitted
4 (7) The sign shall be located within €ew10 feet of the main entrance to the
5 business and itsexcept that in the Peripheral Retail Area, the sign may be
6 located within ten (10) feet of the access drive serving the lot on which the
7 business is located. In no event may the location shat of the sign
8 interfere with pedestrian or vehicular circulation.
9 (8) Limited to one sign per building and. In the Village Center, a free
10 standing sign shall not be in addition to wall mounted, applied letters, tree
11 lawn or projecting signs. In the Peripheral Retail Area, a free standing
12 sign shall not be in addition to a free lawn or projecting sign, but may be
13 in addition to a wall mounted or applied lettering sign.

15 J. Business establishments located in corner buildings are permitted signs for each
16 street frontage as if each frontage were a separate business establishment except
17 that if a corner sign is used, no free standing, tree lawn or additional projecting
18 signs are permitted on either frontage.
19
20 K. Businesses with service entrances may identify these with one sign not exceeding
21 two square feet.
22
23 L. One directional sign, facing a rear parking lot, is permitted. This sign may be
24 either wall- mounted or free standing on the rear facade, but shall be limited to
25 three square feet in area.

27 M. In addition to other signage, restaurants and cafes shall be permitted the
28 following, limited to one sign per business establishment:
29
30 (1) A wall mounted display featuring the actual menu as used at the dining
31 table, to be contained within a shallow wood or metal case, and clearly
32 visible through a glass front. The display case shall be attached to the
33 building wall, next to the main entrance, at a height of approximately five
34 feet, shall not exceed a total area of two square feet, and may be lighted.

36 (2) A sandwich board sign, as follows:
37 (a) The area of the signboard, single- sided, shall not exceed five
38 square feet.
39 (b) The signboard shall be constructed of wood, chalkboard, and/or
40 finished metal.
41 (c) Letters can be painted or handwritten.
42 (d) The sign shall be located within four feet of the main entrance to
43 the business and its location shall not interfere with pedestrian or
44 vehicular circulation.
45 (e) The sign shall be removed at the end of the business day.

1 (3) In the Peripheral Retail Area only, a menu sign with a maximum sign area
2 of 16 square feet and a maximum height of six feet for a ground sign.

4 N. A home -based office is permitted one sign provided it complies with the
5 requirements of Section 6.2(F).

7 O. If historically appropriate to the type of business conducted or the architectural
8 style of the building in which the business is located, a retail business may display
9 in windows fronting a street an illuminated window sign in addition to other
10 permitted signs provided the sign area of each sign does not exceed —ten 10 square
11 feet in the Village Center and 20 square feet in the Peripheral Retail Area. Neon
12 signs are permitted as an illuminated window sign.

14 P. Signagc for the Education Building depicted on the Development Plan is
15 permit

17 18.4. Permitted Other Signs:
18
19 A. Signs permitted under Sections 25.7.02 -3, 25.7.02 -5, 25.7.02 -6, 25.7.03 -4,
20 25.7.03 -5, 25.7.03 -6 and 25.7.04 of the Sign Ordinance.

22 B. One identification sign at each entrance to (i) the District, (ii) a designated
23 neighborhood within the District, (iii) an attached dwelling project
24 containing more than six units in not less than two buildings, and (iv) an
25 apartment house, and (v) the Peripheral Retail Area,provided the following
26 standards are met:
27
28 (1) The design of the sign for any attached dwelling project or apartment
29 house shall be consistent with the architectural style of the project or
30 apartment house to which it relates.
31
32 (2) The maximum sign area shall not exceed 75 square feet.
33
34 (3) The area surrounding the sign shall be appropriately landscaped in
35 accordance with the requirements of Section 19.
36
37 (4) The sign may be illuminated.
38
39 (5) Matching signs which border either side of one entrance shall be treated as
40 one sign, but both sign faces shall be used to calculate the total sign area.
41 (6) The identification signs for the Peripheral Retail Area may contain the
42 names of occupants of buildings located in the Peripheral Retail Area
43 provided that, unless otherwise approved by the Commission: (i) the names
44 of the occupants are all in the same size letters and (ii) the letter size does
45 not exceed 12 inches.

1 (7) An identification sign may be installed at only one of the two entrances to
2 the Peripheral Retail Area from 131st Street.

4 C. Traffic directional signs.
5
6 D. One development sign at each entrance to the District and each designated
7 neighborhood thereof, provided the following standards are met:
8
9 (1) The maximum sign area shall be 64 square feet.
10
11 (2) The maximum height of each sign shall be eight feet.
12
13 (3) The sign may not be illuminated.
14
15 (4) The sign shall be removed when 90 percent of the lots in the area to which
16 the sign relates have been sold.
17
18 E. One construction sign for each street frontage of a lot upon which construction
19 (other than construction of a detached dwelling) is in progress, provided the
20 following standards are met:
21
22 (1) The maximum sign area shall be 32 square feet.
23
24 (2) The maximum height of each sign shall be eight feet.
25
26 (3) The sign may not be illuminated.
27
28 (4) The sign shall be removed within seven days after the beginning of the
29 intended use of the building.
30
31 (5) Sign copy shall be limited to identification of the building, architects,
32 engineers, contractors and other persons involved with the construction,
33 but shall not include any advertising or product other than a rendering of
34 the building being constructed.
35
36 F. Signs depicting the site plan of the District assuming completion of development
37 in accordance with the Development Plan and indicating the location within the
38 District of the person viewing the sign, provided the following standards are met:
39
40 (1) The maximum sign area shall be 30 square feet.
41
42 (2) The maximum height shall be eight feet.
43
44 (3) Site plan signage within the Primary Area and in open and recreational
45 space may be illuminated; elsewhere in the District, illumination is not
46 permitted.

2 (4) Site plan signage shall be removed from the Secondary Area when 90
3 percent of the lots have been sold.

5 G. Signs containing a rendering of one or more buildings expected to be constructed
6 on the lot, provided the following standards are met:
7
8 (1) The maximum sign area shall be 32 square feet.
9
10 (2) The maximum height of each sign shall be eight feet.
11
12 (3) The sign may be illuminated.
13
14 (4) One sign will be permitted for each street frontage of the lot upon which
15 construction of the depicted building is contemplated.
16
17 (5) Unless otherwise agreed by the Commission, the sign shall be removed
18 not later than 36 months following installation thereof unless construction
19 of the building has commenced prior to that date and, if construction
20 commences, the sign shall be removed within seven days after the
21 beginning of the intended use of the building.

23 (6) Sign copy shall be limited to a rendering of the proposed building and
24 information relating to the intended construction, availability and use
25 thereof.

27 H. Real estate sales and leasing signs, provided the following standards are met:
28
29 (1) The maximum sign area shall be 20 square feet.
30
31 (2) The maximum height of the sign shall be eight feet.
32
33 (3) Limited to one sign for each street frontage of the lot, with no more than
34 two sign faces per sign.
35
36 (4) The sign may not be illuminated.
37
38 (5) Sign copy shall be limited to announcement of the sale, rental or lease of
39 the premises and shall contain no advertising or promotional material
40 other than to indicate the party listing the property for sale or lease.
41
42 (6) Signs for detached dwellings and commercial structures shall be removed
43 within seven days after the date the unit is leased, sold or occupied.

1 (7) With respect to attached dwellings and apartment houses, when 80% of
2 the dwellings are leased, sold or occupied, real estate signs are limited to a
3 ground sign, a wall sign or a window sign of six square feet or less.

5 I. One (1) general identification sign for the Peripheral Retail Area, provided the
6 following standards are met:
7
8 (1) The maximum sign area shall not exceed 75 square feet.
9
10 (2) The design of the sign shall be compatible with identification signage
11 elsewhere in the District.
12
13 3 The area surroundin the si n shall be a sr() riatel landsca ed in
14 accordance with the requirements of Section 19.
15 (4) The sign shall contain only the words, "WestClay Up Town."
16 (5) The sign shall be located at the northwest corner of 131 and Towne Road.
17 (6) The sign may be illuminated at night.

19 1J. Signs approved by the Commission are permitted in the District in addition to the
20 signs specifically authorized in this Ordinance.

22 18.5. Design Standards for Signs:
23
24 A. Signs affixed to the exterior of a building shall be architecturally compatible with
25 the style, composition, materials, colors, and details of the building, as well as
26 with other signs used on the building.
27
28 B. Sign colors should be compatible with the colors of the building facade.
29
30 C. Signs shall not interfere with vision clearance and shall comply with the
31 requirements of Section 10.13.10.10.

33 D. Backlighting of signs is permitted only in the Peripheral Retail Area.

35 18.6. Premises Identification:
36
37 A. The assigned premises identification of a building shall be displayed in such a
38 manner so that the numerals can readily be seen from the street. Identification
39 shall be displayed on the building, on or near the main entrance door, or displayed
40 on a mailbox near the street in such a manner as they identify its corresponding
41 building.

43 B. Any dwelling or commercial building that abuts an alley or secondary access that
44 could be used by motor vehicles must not only display the premises identification
1 on the front, but shall also display its premises identification visible from the
2 alternate access to the property.

4 C. When numerals representing premises identification are removed or become
5 illegible, such numerals shall be renewed or replaced by the owner or occupant of
6 the building.

8 18.7. Sign maintenance: All signs and sign structures shall be kept and maintained in good
9 repair and in a safe condition.

11 18.8. Permit Procedures: Division VI of the Sign Ordinance shall apply to signs in the District.
