Naraine The City of Carmel made the Uniform Land Acquisition Offer to Aubrey S. Naraine and Janie D. Naraine to acquire a portion of her property for the above project. The offer was made by certified mail on April 8, 2010. The amount of the offer was $40,900.00 and was based upon the appraisal performed by Dennis Otto with the review appraisal performed by Joseph Traynor. The landowners were advised by Steve Pittman and they declined to accept the offer and made a counter offer in the amount of $62,551.00. The counter offer included back up data that was reviewed by Carmel. IN response, Carmel Countered in the amount of $45,000.00, which was rejected by the landowners. The landowners second counter offer was in the amount of $50,000.00, which Carmel rejected. Through continued negotiations, the landowners agreed to accept an administrative settlement in the amount of $49,000.00. Additionally, the landowners would execute the Right of Entry and give assistance in obtaining the partial mortgage release or satisfaction of mortgage. In support of the administrative settlement we list the following: First, were the condemnation case to proceed to the valuation stage, the landowners could introduce their own appraisals with higher land values. The landowners' advisor is a realtor and has a familiarity with property values. This carries the possibility that the eventual award may be higher than the amount of the administrative settlement. Assuming all other legal review and approvals are approved, it is our recommendation that the City of Carmel approve the terms of the above described administrative settlement.
