Docket Nos. 04070028 OA: Amendment, Swimming Pool Ordinance The applicant seeks to amend Chapter 25: Additional Use of the Carmel/Clay Zoning Ordinance. Filed by the Carmel Department of Community Services. The current City of Carmel ordinance governing private swimming pools (25.01.01(C)(8)) requires access to pools be limited by the use of one of the following: 1. A continual fence or wall, or 2. Other means not less than 5 feet high and deemed impenetrable (such as structures), or 3. A combination of 1 and 2 that completely encloses the pool, or 4. A safety cover to restrict access. This current ordinance is in line with the most recent Indiana Swimming Pool Code (675 IAC 20 -4 -27 (C)). The proposed amendment is more stringent and states that safety pool covers may be used, but alone are not an acceptable means of limiting access to a pool. This proposed ordinance requires all private swimming pools be enclosed by one of the elements listed in 1 -3 above. The Department recommends that this item be forwarded to the Special Studies Committee on September 7 for further discussion. SCANNED PCR- 2004 -0817
