3d. Village of Towne Pointe Signage
The applicant seeks the following development standards variance approval:
Docket No. 10080003 V Section 25.07.02 -01 e) Sign located in street right -of -way
The site is located at the intersection of President St. and Towne Rd. and is zoned S1/Single-family
residential. Filed by Chuck Wright, PE and Kayser Swidan on behalf of Village of Towne Pointe
Homeowners Association.
1 r J,I General Info: The petitioner is requesting to place a sign in
4-;': the median of their entrance. The street is dedicated right of
4 4 way, ther requiring a variance to place the sign in the
r 1 right of way.

Analysis: As depicted in the picture to the left, the green
lines show where the subdivision's property ends and the
s s, t City's right -of -way begins. Most of this entrance has been
4 ro 71 dedicated to the City. Therefore there is no visible place for
the subdivision to place an identification sign. It must be

P k located in the right -of -way. The proposed sign would be
Y 1 x made of brick and limestone and placed to the east of the
r 1 path and out of the vision triangle for drivers. It will be 3'
4 4 -�q��' tall and the sign area will be 6.5 sq. ft. It will be two sided.

Findings of Fact: Sign located in the street right -of -way
1. The approval of this variance will not be injurious to the public health, safety, morals, and
general welfare of the community because: the sign is placed well off the street and does not
block the view of drivers as they turn into or out of the subdivision.
2. The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because: the entry sign will notify the traveler from
the roadway of the subdivision entrance in time to safely turn and not obstruct traffic flow.
3. The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because: placing the sign outside of the right -of-
way would not allow proper identification to drivers in the roadway with enough time to safely
turn into the subdivision, therefore obstructing traffic.
Recommendation:
The Dept. of Community Services recommends positive consideration of Docket No. 10080003 V with
the condition of Consent to Encroach approval (of the sign in the r /w) from the Engineering Dept.
