The applicant seeks the following development standards variance approval:
Docket No. 10070008 V Section 5.04.03.C.1 Encroachment into side yard setback
The site is located at 13749 Coldwater Drive on .76 acre and is zoned S1 /Single family residential.
Filed by Sam and Mary Shaw, owners.
General Info: The petitioners would like to build
an addition to their garage. The addition would be
..-01%.* attached. Surrounding uses are residential.
Analysis: The petitioner would like to construct a

20 by 20 garage addition, attached to the existing
1 house, on the north side of their property. The site,
which is zoned Si, has a ten -foot minimum side
yard requirement, with a 30 -foot aggregate. The
4 i _i south side yard measures 16 feet, while the north
side yard would measure approximately 10 feet
V after construction, with a resulting aggregate of 26
\II'''I f feet. Several houses in the subdivision appear to
have similar setbacks, and the deviation would be
only four feet.
Findings of Fact: Reduction of required side yard
1. The approval of this variance will not be injurious to the public health, safety, morals, and
general welfare of the community because: the proposed deviation is minor and will not affect
adjoining properties.
2. The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because: the proposed deviation is minor and will
not affect adjoining properties.
3. The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because: the site is not large enough to permit
the construction of accessory uses without the grant of a variance.
Recommendation:
The Dept. of Community Services recommends positive consideration of Docket No. 10070008 V after all
concerns have been addressed.
