Rezone (Orin Jessup Land Company's 1st Addition, lots 142(pt) 144). The applicant seeks approval to rezone 0.31 acres at 10620 Bellefontaine St., from the R -3 /Residence to the B -7 /Business Zoning Classification, within the Home Place Business District Overlay. Filed by Barker Law Offices, on behalf of Howard House, Inc. In 1979, the southern half of this site received Board of Zoning Appeals (BZA) approval to have an outdoor parking storage lot for a body shop, at 10614 Bellefontaine St. A residential bungalow structure currently exists on the northern half of this site, but this proposed rezone would permit more land uses, including multiple family dwelling, office, and retail on the entire site. The Carmel Clay Comprehensive Plan (C3Plan) marks this area of Home Place as a Commercial Vitality Node, to establish areas for community- serving and neighborhood serving commercial development with opportunity to integrate mixed uses. Since the site lies within the Home Place Business District Overlay, the land uses are viewed as compatible with the Overlay's purpose and intent, as written in the Zoning Ordinance: This zone is intended to foster urban neighborhood village -like commercial activity, in keeping with the intention of the Comprehensive Plan. It is to contain office and retail uses that are of an intensity and scale compatible with the surrounding residential areas, both in scale and architecture. These commercial uses should provide services and support the existing residential areas and nearby U.S. 31 Commercial Corridor. The purpose of this section is to provide site design requirements that orient buildings to the street and are pedestrian in scale. The object is to align buildings in. order to create a sense of an outdoor room, encompassing sidewalks and the street. Please view the petitioner's information packet for further detail. After all comments and concerns are addressed, the Dept of Community Services (DOCS) requests that the Plan Commission suspends its rules of procedure and votes to forward this item to the City Council with a positive recommendation.
