Mr. Regan commented that there is a sign violation involved here.
Mr. Wright said that this is a smaller sign that they are now recit
ing.
Mr. Wright related that he told Mr. Hallcraft, one of the owners,
the present signs must go. Mr. Hallcraft was supposed to have'had the
signs covered up but his orders have not been carried out.
Mr. Regan said he doesn't like the way they have handled thp' situatio,
Mr. York said the Ordinance is the only thing the Board looks atani'
they here put up the signs regardless and are now asking for what the
Board did not do last July. Mr. York said their dollar projection i
not a hardship and advertising is something the Board doesn't have to
consider.
In their request last July there was a 3 to 2 (no-vote) and the
signs were put on after that meeting.
Discussion of sign size followed.
Mr. York asked how far they feel the signs should be seen.
Mr. Wright said two standard blocks away.
Mr. Carl Smith questioned the hardship stating that they knew the
architectural design when the building was bought and that monitary pi
or loss is not the concern of the Board.
Mr. Wright stated that economic hardship is why they are before the
Board.
Mr. Regan related that the Board can judge on economic hardship.
Mr. Regan asked if they would be willing to withdraw for 90 days
and then come back in so the Board can see if the petitioner acts in
good faith.
Dr. Durrer said he feels there is a hardship and that the Bcard shotO
proceed with the vote.
Mr. Wright said the letters are to be red and the signs are not *Oh
back lighted.
Mr. Jim Smith agreed to proceeding with the vote and moved that
BA 4-79, two additional signs for Carpet Fashions, be approved. Second
by Carl Smith.
Mr. Jim Smith amended the motion to include: individual mounted blot
l etters to be placed on the north and south sides of the Carpet Fashion
building. Seconded by Carl Smith.
Finding of fact forms were completed.
The vote was 4 For, 2 Against (Mr. York and Mr. Carl Smith votingNOs
Motion carried.
3a. 800 P.M., Public Hearing on Docket No. BA 5-79, Variance Appli
cation for additional signs for Marathon Oil Company's Speedway
Self-Service and Food Center located N.W. corner of 106th St. and
College Avenue in B-1 zoning.
Filed by Doug Church for Marathon Oil Co.
Mr. Church made the presentation for signs for self service t gaspw
and convenience store.
Mr. David Lowe was present.
Pictures of the signage and plans for the signs giving dimensions
were shown. Mr. Church said they feel the signs are in keeping with
the improvements made.
The Public Hearing opened at 920. No remonstrators were presents
the Public Hearing closed at 9221.
Mr. Carl Smith questioned the sign on the building front.

Both 4a and 5a were heard together.
Mr. Tony Passwater made the presentation to vary lot size in order to
enlarge their business and construct a spray booth for painting autos
according to 0.H.S.A. specifications. The plans were shown.
The Public Hearing opened at 939.
Mr. Robert Smith, representing Don Howard, stated they feel this is
the best for the neighbors.
Mr. Passwater made the presentation for item 5a. It is to be an out-
side parkin;rand storage lot. There will be a security fence and light-
m; with blifiaers on the north, west and possibly the east sides.
Mrs. Miller, 10605 Bellfontaine, asked what is meant by storage.
Mr. Passwater said that cars to be worked on will be parked there.
Mrs. Ann Robinson, 107th St., questioned if this will eliminate all
the cars parked on Bellfontaine now and the trash barrels.
The Public Hearing closed at 9:43 covering both items 4a and 5a.
Mr. York asked what is to the north of this property.
Mr. Passwater said Don Howard's house is to the north. Mr. Howard is
selling half the lot.
,Mr. York asked how many lights will be in the parking lot.
Mr. Passwater said one or two on a pole.
Mr. Regan questioned where the light will be put.
Mr. Passwater said they haven't really decided but that it would
probably be best on the N.E. corner.
Mr. Carl Smith asked if there are any residents living due east of
the parking lot and stated that screening is needed. Mr. Smith asked if
Ailey would consider screening on the east side.
Mr. Passwater said yes. They will have a 6 ft. chain link security
fence with a stocade put on the outside for aesthetics.
The vote on item 5a was considered first.
Mr. Carl Smith moved approval for temporary auto storage adding the
tipulation that Mr. Passwater would be responsible to the lights as he
said he would and that he include a wooden type stocade outside his
hai link fence. Seconded by Frank Regan.
This is a permanent variance to store vehicles temporarily.
The vote was unanimous for approva .Motion carrie
Regarding item 4a, Mr. Jim Smith moved that BA 6-79 be approved as
resented. Seconded by Glen Jensen.
The vote was unanimous for approval. Motion carried.
6a. 845 P.M., Public Hearing on Docket No. BA 8-79, Variance Appli-
cation for outside storage in B-2 zoning for Midwest Railroad Tie
Sales Co. located 9699 Michigan Rd., Lot 10 North Augusta, 1st
Section.

This letter serves to acknowledge receipt of a Secondary Plat received 05/17/10 for review.
After reviewing the Plat the Highway Department has the following comments:
1 An Application for Project Review must be completed and the appropriate review fees
paid prior to any approvals from this office. The application is available on the County
Website.
2. Right -of -Way is required in accordance with the Hamilton County Thoroughfare Plan and
the Hamilton County Road Construction Standards. The R/W for Bellefontaine Street
should be a 35' half. A corner cut at the intersection of 107 Street and Bellefontaine
Street should have a 20' radius.
3. Any reduction of R/W from the standards must be obtained by variance through the
Hamilton County Board of Commissioners at a regularly scheduled meeting. Please
refer to Hamilton County Code, Title 8, Article 17, Chapter 1, Sec. 39 for the variance
process.
4. In the signature block for the Board of Commissioners, please list the following:

Steve Holt, Member
Please check all dates listed for accuracy. Many dates should be 2010 instead of 2009.
The Hamilton County Highway Department has no comments concerning the rezone of

Dear Mr. Barker:
We have reviewed the secondary plat submitted to the Hamilton County Surveyor's Office on
May 17, 2010, for this project and have the following comments:
4. The Home Place Regulated Drain runs north and south under North Bellefontaine
Street, Arm 2 of the Home Place Regulated Drain run east and west under 107
Street, and Arm 4 of the Home Place Regulated Drain run east and west under the
alley south of this proposed plat. The Regulated Drain Easement for these tiles is the
statutory 75' from the center line of the tile.
Please show the Home Place Regulated Drain Easement on the plat based on the 75'
from the actual centerline of the tile.
6. The Home Place Regulated Drain Easement may be eligible for reduction via
Subdivision Non enforcement Agreement. Please contact Mary Garmon, Hamilton
County Surveyor's Office Permits Inspector, to determine an acceptable distance
from the centerline of the tile to propose to the Hamilton County Drainage Board for
consideration.
7. If easement reduction is sought, the proposed easement and Subdivision Non-
enforcement Agreement will need to be approved by the Drainage Board prior to the
plat being approved by the Hamilton County Commissioners.
8. The Hamilton County Surveyor's Office has no comments on the proposed rezone of
the property.

Hi David -1 forgot to add these last few replat comments:
7. Please submit a revised Secondary Plat after making above mentioned changes. Once these changes have
been made and comments addressed, please produce a Mylar copy (with the surveyor's and land owner's
signatures) for signature by this Department. Two paper copies of the plat must be filed with the Mylar prior
to recording, and two paper copies and a Mylar of the recorded plat must be submitted following recording of
the document. Our approval of the secondary plat (signature) will be forthcoming upon revision of the plans
according to the items listed above.
8. The staff has been advised that we cannot present a Secondary Plat to the Director for signature from this
point forward until Ms. Terry Krueskamp (tkrueskampPcarmel.in.gov) in Information Systems has received an
e -mail with an electronic file attached (MicroStation .dgn is preferred, or AutoCad .dwg of the subdivision),
and it (the e -mail) has been copied to myself and Alexia Donahue -Wald awold@ carmel.in.Bov).
9. The Dept would also like a .pdf or .jpg file of the scanned, recorded plat, as we move toward a paperless
office.

Replat:
1. Add the docket no. 10040003 SP to the replat, and remove the PP docket number.
2. Under the zoning section of the replat, please add that it is pending a B -7 rezone (docket no. 10040004 Z).
3. Please add a location map to the replat.
Rezone:
1. Please provide an exhibit showing the zoning classifications of the area. You can use the Carmel GIS map at:

2. Please provide a statement on how the rezone will comply with the Comprehensive Plan, which can be found

3. Please provide a copy of Appendix A: Schedule of Uses in y our info packets, or list what land uses are permitted
now, and what land uses would be permitted with the rezone.
