DEPARTMENT REPORT
JULY 20, 2010
1. Docket No. 10060013 DP Amend /ADLS Amend: Regions Bank
(Kite PUD; Greyhound Commons, Ph III). The applicant seeks site plan and design approval
for a bank. The site is located at the southeast corner of 146 St. and Lowes Way, and is zoned
PUD/Planned Unit Development. Filed by Mark Naylor of The Roberts Group, PSC.
The applicant seeks site plan and design approval for a bank building, composed mostly of brick and cultured
stone. The site layout and landscaping very closely resembles the 2009 Key Bank approval. Please view the
petitioner's information packet for further detail.
The original development plan approved for this parcel did not show any street connection to Danbury Estates
neighborhood. Remaining mostly the same, this new development plan, also shows a one -way (west) drive
extension of Danbury Drive, from Danbury Estates. (The original PUD text forwarded from the Plan
Commission to City Council included a section about not having access to the Real Estate from Danbury Drive
nor any other residential street. However, vehicular access was discussed at City Council meetings reviewing
the Rezone and PUD Ordinance for the subject parcel. The adopted version of the PUD Ordinance text excluded
that section about not having access, because that access was viewed as beneficial to the immediate area. Plan
Commission reaffirmed these text changes.) Since the intention of the adopted PUD ordinance is to allow
for a vehicular connection west from Danbury Drive, the Department recommends that the Plan
Commission votes to suspend its rules of procedure and votes to approve the Development Plan
Amendment, after all comments and concerns are addressed. (A Findings of Fact form needs to be signed
by the Commission President.)
Staff's outstanding comments for the petitioner:
1. Please submit a filled out Findings of fact sheet the night of the meeting.
2. The Dept. of Engineering (DOE) has no issues with this item going to committee for further review and has yet
to review the latest revised submittal.
3. The Hamilton Co. Highway Dept is currently working with Kite, A &F, RW Armstrong, and INDOT to
coordinate the road right of way improvements for the US 31 project. It appears that INDOT will be adding a
lane to 146th St.which will push the decel lane further south, and they may need to purchase additional right of
way at the west end of the Regions Bank project site, which could affect the landscaping.
4. The Hamilton County Surveyor's Office is still working on issues with the project engineer on this project.
They don't see any game stoppers, but they could have some issues that may affect the site layout.
5. The Forestry Dept approved the landscape plan, as it complies with the PUD ordinance requirements.
6. The smaller ATM sign was depicted in the sign drawings, but not changed on the building renderings.
7. Need verification of the colors for the wall sign returns; will it be silver?
8. Need to know what the other signs above the drive through will say. Will it be Open and closed? Just
open? Will the letters only shine through at night, or will the entire sign face illuminate?
9. The 21 arrows painted on the ground still seems like too many.
10. DOCS would still like a drawing of the ATM signage before we can support it.
11. DOCS needs a copy of the Recorded maintenance agreement between Kite Danbury Estates.
12. The land owner must revise the roadway plans to reflect the design that IDEM is okay with, to allow a drive
that crosses a mitigated wetland.
13. A commitment regarding the ongoing maintenance of the decorative screen wall around the perimeter of the
site should be made as part of this petition. (The previous bank approval included a similar commitment.)
Also, DOCS requests that the Plan Commission sends the ADLS Amendment portion to the Aug. 3
Special Studies Committee meeting for further review /discussion, and grant the committee the final
voting authority.
