HomeMy WebLinkAboutPacket 9-21-101• Mt mA City of Carmel CARMEL PLAN COMMISSION MEMORANDUM- Date: September 10, 2010 To: Plan Commission Members From: Angelina Conn, Department of Community Services Re: Docket No. 10080020 SP: Heritage Square, lot 6A, replat This replat item is before you this evening in order to get a determination about a sidewalk easement that was added as part of a secondary plat approval by the Plan Commission in 1995. The Plan Commission should determine whether or not the Depaitment of Community Services can administratively approve this replat petition, which will remove the 5 -ft wide sidewalk easement along lot 6A. The original primary plat for Heritage Square was approved by the Plan Commission on 7 -18- 1995, under docket no. 39 -95 PP. This plat did not show or contemplate a 5 -foot wide sidewalk easement along the north side of lot 6, which would connect to the proposed Monon Trail. It only showed a 5 -ft wide side yard building setback. A few months later, on 8 -1 -1995, the Plan Commission reviewed and approved the secondary plat for Heritage Square. (Note that secondary plats are administratively approved today.) All drawings within the secondary plat file do not show an easement along the north property line of lot 6. It only shows a 5 -ft wide side yard building setback. However, the secondary plat was approved at a meeting of the Plan Commission, contingent upon the installation of a sidewalk on lot 6 for pedestrian access to the Monon Trail. The meeting minutes are attached, as well as a scanned portion of the recorded plat. Now, 15 years later, all the lots have been sold and built upon, except for lot 6A. The property owner would like to seek administrative approval to have the sidewalk easement removed from the north property line of the lot, with a replat. The lot is about 30 feet wide and 145 feet deep. Please contact me with any questions at 571 -2417. Committee to consider Docket No. 69 -95 SP, a Secondary Plat application for a Subdivision named Heritage Square. The petitioner seeks approval to construct 10 lots on 2.7 acres of land located at the end of Northwest Third- Avenue in the Old Towne Carmel Area. The site is zoned R-4. Filed by Dan Chapman. Dave Wilcox, Professional Engineer, and Dan Chapman appeared before the Committee representing the applicant. Construction drawings have been submitted for review and conform to the Primary Plat. The installation of a road and the existing home on site necessitates going before the Board of-Zoning Appeals for a front yard, set back variance. Mike Hollibaugh asked about pedestrian access to the common area. Dan Chapman stated that there will be a five foot easement along the northeast property line which will access the Monon corridor. Also, school children would have pedestrian access to Second Street. The walkway will be in the form of a sidewalk and will be landscaped. There is no Homeowner's Association proposed for this Subdivision. Mike Hollibaugh asked that a landscape plan be submitted and the petitioner agreed to comply. Jay Dorman moved to approve Docket No. 69 -95 SP, contingent upon the installation of a sidewalk on lot 6 for pedestrian access to the Monon, and the submission of a satisfactory landscaping plan, seconded by Dave Cremeans.
